A few years ago I was approached by a woman whose identity was stolen by a vengeful ex-husband, and used to run up tens of thousands of dollars in fraudulent debt. She was being sued by several credit card companies at once and her credit rating had hit bottom. She was a factory worker and could not afford extensive legal services, but I took on her case nonetheless, because the subject of identity theft is of great professional interest to me. Eventually, through a combination of negotiation and an aggressive legal defense, I was able to eliminate most of the fraudulent charges, and significantly reduce the rest.
More recently, I helped the shareholders of a multimillion dollar New York corporation settle their dispute with the corporation’s Directors, who had been accused of funneling the company’s money and business opportunities for their own interests. I set in motion a shareholders’ derivative lawsuit (in which the shareholders sue the management in the name of the corporation itself) and a detailed investigation into the Directors’ financial affairs. Through my investigation, I was able to confirm that some of the Directors have caused the company to significantly defraud a major client. As a result of my evidence-gathering, the defendant Directors entered into a settlement with my clients, and agreed to step down from their respective positions. The litigation was well-publicized and, I believe, has caused the CEOs of other companies to re-examine and perhaps change their financial practices.

As former First Assistant Counsel of the New York State Banking Department, and through my subsequent tenure with Bank Leumi Trust Company as General Counsel, Chief Compliance Officer and Senior Vice-President, I, as well as my associates, have substantial experience both in business transactional law and commercial litigation.

I began the law firm in 1989, after an eight year tenure with the New York State Banking Department and a nine year tenure with Bank Leumi Trust Company of New York. My firm has represented businesses and individuals in a broad range of legal matters including litigation in the New York State and federal courts.
We have litigated business disputes for and against corporations, shareholders, partnerships and limited liability companies. We have also represented clients in non-litigation matters, including negotiating employment and purchase and sale agreements, obtaining licenses from various state agencies, forming business associations and entities, and representing clients in business mergers and acquisitions.
My firm has represented employers and employees before the Equal Employment Opportunity Commission, the New York State Division of Human Rights, the New York City Department of Education, and we have both instituted legal actions and defended clients in actions covering a wide-range of employment disputes. Where feasible, we will seek to resolve claims and disputes through alternative dispute resolution, such as through mediation, arbitration and negotiation.
I held the position of First Assistant Counsel of the New York State Banking Department for eight years, from 1973 through 1981. I held the position of General Counsel, Chief Compliance Officer and Vice-President of Bank Leumi Trust Company of New York for eight years, from 1981 to 1989.
I am an arbitrator for the Nassau County District Court. I have arbitrated cases before the National Association of Securities Dealers (NASD, now known as FINRA), the American Arbitration Association, the New York Stock Exchange and other alternative dispute resolution forums. I have also chaired various panels of NASD arbitrators in claims brought by investors who alleged that they had been defrauded, and by brokers who brought claims against other brokers or brokerage firms.
I believe that clients should be fully informed of the law as it relates to their matters, as well as the likelihood of success and possible outcomes of various courses of action. I am in full support of clients wishing to educate themselves in the law. To this end, as a matter of policy, I make sure to keep my clients fully informed of the legal issues involved in their matters, as well as the risks and benefits of instituting litigation. Clients are provided all documents received or produced by my firm which relates to their matters, and there is continuous discussion with clients as to the status of their matters. We truly believe that a fully informed client is our best client.
I regularly review contracts and agreements drafted by clients. Whether the document was drafted by my firm or drafted by a client, the objective remains the same: as the client's attorney, my job is to ensure that the document reflects my client's intentions, protects my client's interests, and conforms with controlling law.
Not every client who comes to me for a consultation can really afford the services of an attorney, and not every legal problem is so complex that with a little guidance the client can’t resolve it on his or her own. Over the past few years, I have provided such guidance to many different people, from corporate executives to ordinary working folks. If you have an important meeting coming up with the boss, for example, and need to know your legal rights, we can provide a “check list” for you to take along and keep handy. If you are having problems with your child’s school, we can discuss the right approach to take in speaking with the administration or a committee. Not everyone who comes to my office for a consultation ends up retaining the firm, but I try to make sure that everyone leaves the office a little more educated and confident than when they came in.
I was raised in a family of professionals. My father was an accomplished teacher of accounting and finance, who also passionately studied literature and the classics of philosophy. As a result, I was imbued very early in life with a respect for learning and an appreciation of moral ethics, justice, and “giving back” to one’s community. Pursuing law as a career was therefore a natural choice which I embraced with great enthusiasm.
Perhaps an experience which had shaped my professional approach more than any other was when I was teaching Junior High School Science in the New York City Public School System in an economically depressed neighborhood during a decade of hard times for many New Yorkers. More than ten years later, I was talking to a telephone information operator, who recognized my voice and asked, “Is this Mr. Newman?” She was one of my students, and she had remembered me after all these years. Teaching is a great way to develop one’s sense of empathy, as well as patience and respect for people who have views different from one’s own. All these qualities are very important to a successful legal career.
Alexis de Tocqueville had described American lawyers as a kind of high priesthood of the New World, serving as they do in the role of intermediaries between a vast and arcane system of laws and rules, on one hand, and a litigious, entrepreneurial populace on the other. In my opinion, civil litigators epitomize this description; they are the true conduits between ordinary citizens and the legal system. So long as there are litigation attorneys to help people resolve their disputes through the courts, and not through other means such as violence, this country shall remain “a nation of laws, and not of men.” That is why I am proud of my civil litigation practice.
Being a litigator in the New York metro area, especially on the border between Queens – the most ethnically diverse county in the United States – and suburban and largely affluent Nassau County, is nothing if not a daily exercise in psychology and sociology. Throughout the course of any given week I come into contact with a dizzying variety of people and their problems, both legal as well as personal. Helping clients navigate the legal process toward resolution and closure is an exciting and challenging process, one which I look forward to every day.

I provide estimates as to the number of hours required on a matter and the anticipated legal fees. In appropriate cases I will "cap" an engagement so that legal fees will be the lesser of the firm's hourly rate multiplied by the number of hours spent, or the agreed-upon "cap."

Because each case varies in complexity and scope, the retainer amounts vary. The amount of the retainer is determined during consultations with the client.
