Example Cases

I am very proud of all the patent and trademark applications that have crossed my desk. It is especially exciting to see the transformation of a client's idea into first an invention, then into a patent application, and then into an issued patent, and finally into a successful business.

For example, a client came to me while a student in college. He had an idea for a protein skimmer aquarium filtration system. I was able to obtain a pair of very valuable patents for the client. On the strength of these patents he built a very successful business that today occupies a 5,000 square foot production facility in San Diego, CA. His business is now the leading manufacturer of skimmer aquarium filtration systems in the USA, selling thousands of units worldwide each year.

At Ross Patent Law Office, our focus is to protect our client's intellectual property. Specifically, we specialize in obtaining patent, trademark and copyright protection for our clients. We take pride in our success rate. We have obtained over 280 patents for our clients!

My father, John R. Ross, opened Ross Patent Law Office in Del Mar, CA as a private practice in 1984. I became a patent attorney in 1997 and joined the practice as a junior partner. Together, as partners, we currently provide intellectual property legal services to clients throughout Southern California, the United States, and the rest of the world.

Previous Employment Summary

Prior to joining Ross Patent Law Office, I was a naval officer in the United States Navy. After graduating from the United States Naval Academy in 1988, I served as an officer onboard two destroyers while deployed to the Western Pacific. I finished my time in the Navy while on shore duty at Fleet Combat Training Center Pacific (FCTCPAC) in Point Loma, CA. In 1993, while still in the Navy and on shore duty, I entered law school at Thomas Jefferson School of Law in San Diego, CA, and later graduated in 1996.

What is your opinion regarding clients educating themselves on legal issues?

It is outstanding when a client has the interest and motivation to educate themselves on patent, trademark and copyright issues. It can make the process easier and more efficient for the client and myself as their application is prepared and then filed.

Are you willing to review documents prepared by clients?

I am very willing to review documents prepared by clients.

Are you willing to coach clients who want to represent themselves?

Depending on the situation, I could be willing to coach a client.

Why did you decide to be a lawyer?

While at the Naval Academy, I majored in Mechanical Engineering. My engineering degree helped me tremendously while I was serving as a Naval Officer (first as a Main Engines Room Officer, then as a Tomahawk Weapons Control Officer). While still in the navy and on shore duty, I attended law school at night to become an attorney. I thought that becoming a patent attorney would be a great way to combine my Mechanical Engineering background with my law degree. I since have been very pleased with my decision to become a lawyer and in particular a patent attorney.

What work experience and education helps you be a better lawyer?

My education at the United States Naval Academy, and then my subsequent service to my country as an officer in the United States Navy, has shaped me into the person who I am today. My military experience taught me to be a leader, to be organized and efficient, and to think calmly under pressure. These are traits that I call upon everyday in my intellectual property law practice.

Why did you decide on your primary area of practice?

I thought that I would be particularly valuable to patent law and trademark law due to my educational background, interest in technology and business, and work experience in the navy. I still believe it is a perfect fit.

What do you like best about your career?

I like working with clients who are excited about their inventions, products, services and companies. I am lucky because I get to be part of that excitement as I help my clients protect their intellectual property rights.

Tell us about your law firm:

My father and I are both partners at Ross Patent Law Office. My father has been an attorney since 1969 and a patent attorney since 1984. He has served as the Chief Intellectual Property Counsel for major corporations. He brings his experience and knowledge to Ross Patent Law Office to help our clients.

My father and I are similar in that we enjoy working directly with our clients on all aspects of their ideas. We both enjoy helping our clients obtain protection for their inventions and trademarks.

What are your strengths and style?

My strength is my focus and my attention to detail. I take pride in doing the job right. I make every effort to communicate with my client and to make sure that my client has a good understanding of the patent and/or trademark application process. I always try to make myself available to my client to provide help and answer any question he or she may have. I consider myself very approachable.

Personal Interests:

I enjoy spending time with my beautiful wife, four children, and dog. I love to play the guitar and have been doing it since I was 11 years old. I still pick it up daily. I enjoy running, surfing and biking. I have managed and coached my daughter's soccer teams, my son's soccer teams and my son's baseball teams.

Fixed-Price Services and Fees

Most clients prefer knowing beforehand approximately how much it will cost to file a patent application, trademark application, or copyright application. I have listed below a range of typical fees most clients pay for our services. On rare occasions the cost may fall out of the range listed below:

Patent Searches: $700 (for a simple search)
The patent search fee will vary depending on how crowded a particular invention is with respect to the prior art (i.e. previously issued patents). For example, if there are a considerable number of patents to review in a given field, then the price will increase. The fee includes a search report and copies of important patents.

Provisional Patent Applications: $1,100 to $1,300 (for a typical provisional application)
This fee varies depending on the complexity of the invention. If the invention is very simple then you are going to be in the low range. This price excludes applicable Patent and Trademark Office fees which are presently $110.

Non-Provisional (Utility) Patent Applications:
The fee for filing a non-provisional patent application (also known as a utility application) varies depending on the complexity of the invention. Once we understand your invention we can quote you a fee so that you know beforehand the cost of the application. Typically, an application for an invention of simple or medium complexity may cost approximately $4900 - $5900. Complex applications may cost more. This price excludes applicable Patent and Trademark Office fees which are approximately $462.

Trademark Application: $495 (simple application)
This fee includes preparation and filing the application for one trademark in one class. This price excludes applicable Patent and Trademark Office filing fees which are presently $325 per class. This price does not include an optional search report.

Office Action Response (for Trademark and Patent Applications):
Client is charged hourly. An average office action response may cost $690 - $1850. This fee varies depending upon the nature of the Examiner's comments and the complexity and time involved in drafting a reply.

Also, it should be noted that I will offer a discount for high volume services. For example, if a client files two simple provisional applications at once, he could be charged $1,100 for the first application and $900 for the second application.

Typical Retainer

I will request a 25 to 50 percent first payment at the beginning of any work.
