Example Cases

Our first client, a 27 year old attorney, had accumulated $28,000 in unsecured credit card debt while attending college and law school. His assumption was that these debts, along with $90,000 in student loans, would be driven down once he obtained a high paying job. This did not happen and having an awareness of the daily burden this placed on debtor and his ability to function, after trying other methods for relief, bankruptcy became the right thing to do. Debtor opted to file for Chapter 13 rather than Chapter 7 so as to pay something back to his creditors and begin restoring his credit score. Debtor has since seen his credit score creeping up as well as a new awareness to financial responsibility.

We regularly assist clients in being able to retain their automobiles and homes despite filing for bankruptcy protection. Most information people read prior to meeting with an attorney misleads them into thinking they will lose all of their real and personal property. That is not correct. When we walk out of the court and are on the steps saying our good-byes, the relief on the faces of my clients and the realization that they can begin again is an extremely satisfying moment for me.

We have also successfully saved the lives of a few dogs sentenced to death in several different states. Our representation of these animals developed through the internet after we had done a favor for a friend of the firm. The decisions to put animals down for alleged biting incidents are made too easily by non-qualified individuals with loud voices. Typically a dog and its owner are denied due process. We step in to verify that proper procedures are followed and that the right decisions are made to conclude the matter. It is not our specialty, but these cases offer a great challenge and are very provocative in small towns.

Firm Focus and History

The firm is focused on delivering personal and superior service to our clients during our effort to bring them financial health. We also handle general law practice cases as they may arise, including personal injury and operating under the influence matters, but remain focused on bankruptcy.

The origins of the firm date back to the mid-1970s. It was then that Attorney McCarthy had begun developing a law practice that emphasized long hours of hard work for bankruptcy and personal injury clients. After more than three decades of success, we are proud that Attorney McCarthy retired as a member of Cohen & Associates. The tradition of the way he practiced law is not only our history, but our priority.

Previous Employment Summary

Just out of law school, I began working on class-action lawsuits on behalf of consumers who were manipulated into losing their long-term savings by life insurance agents in the 1980s and 1990s. This gave me a good foundation for helping individuals with financial concerns.

I continued my career as an attorney working in the insurance industry. For several years I managed worldwide, multi-million dollar claims and litigation on behalf of General Electric. It was there that I was influenced by the GE model for setting high expectations for my performance and client service.

Activities and Awards

I am Vice President of the Board of Directors of the Salem Harbor Community Development Corporation (a non-profit entity). Earlier in 2009, the Salem Five Bank selected me to be a corporator for their Board of Directors. Previous to that appointment, I was named an advisory member to the board of directors of Beverly National Bank. I am a volunteer coordinator for the Salem Alliance of Food Pantries. I also am a member of the adjunct admissions committee for Clark University.

What is your opinion regarding clients educating themselves on legal issues?

There is a lot of opportunity to read about particular legal issues online. Knowing the general principles of the law can be helpful. However, not every situation is the same and the Internet has a lot of incorrect information. Ultimately, the client is hiring us because of our education and experience so it is not essential that our clients know how to solve their legal issues.

I am willing to review documents prepared by clients.

Are you willing to coach clients who want to represent themselves?

I am unwilling to do so.

Why did you decide to be a lawyer?

I like to argue, especially when I have facts that support my position. I grew up in a household of attorneys and had to develop this skill at a very early age.

What work experience and education helps you be a better lawyer?

I worked my way through school in the same way most of the people in my neighborhood did. I was submerged in these non-legal jobs that made the burdens of the day-to-day lifestyle very clear to me. It struck me that if I persisted in getting educated, I could be a voice for the people with whom I was surrounded. Since I had walked in their shoes, I learned how great it would be to have someone you know and trust to help you through difficult times when financial or legal trouble arose. I get energized when I know I can help.

Why did you decide on your primary area of practice?

People close to me struggled with credit card debt and I saw that it involved sleepless nights and stressful days. The game of borrowing from one card to pay another eventually catches up to you.

Helping people with their financial problems is something I wanted to do and practicing bankruptcy law is how I can accomplish that.

What do you like best about your career?

The responsibility of leading someone through the issues they have.

Tell us about your law firm:

The firm itself is located in a 150 year old haunted fire house. This building is on the trail of evening ghost tours in Salem, Massachusetts. In one of the rooms sat an unmarried, childless legal secretary who began her career in the early 1970s. The legend is that she loved her job for almost 30 years and treated her desk area like it was her home. When the lawyer she worked for retired, she had nothing left, in her mind, to live for. Seemingly in good health, she actually died on the job, at her desk, in her chair. Still today she is given a place to come and work and be happy. We try real hard to keep her happy.

Our staff of four attorneys and three paralegals has almost 170 years of combined experience. By being a small firm, we are able to know each case and each person. Our clients actually have small teams working on their matters. As lead attorney, all matters, cases and files are governed by me. I take full responsibility for each client of the firm. Proudly, we have many repeat clients who have come to us with other issues besides bankruptcy, and they trust the firm to handle them.

My fees are in line with other attorneys in the area. I want to help you through your bankruptcy and take your financial problems off your shoulders. Part of that is that I understand money is an issue, so my office will not call and invoice you for fees that are owed. Typical Retainer

Once the down payment of is made, I offer my clients a pay at your pace program. The overall fee depends on the type and complexity of the bankruptcy filing. I know the money struggles we all have and I do not want to be a financial burden to my clients. So I offer a free program where the remainder of the fee is paid. When the client sends in money, we credit their account. Once the entire fee is paid in full, we will prepare and launch the bankruptcy petition. Some clients take nearly a year to pay, and that is the way we operate.
