I attend legal education seminars on a monthly basis as well as continually through the year. I always exceed the required numbers of continuing legal education hours.

Example Cases

A married couple entered my office with approximately $750,000 in assets that were jointly held, but did not have any beneficiaries designated. Through the use of a Revocable Living Trust we were able to minimize their Probate exposure and simplify their Estate considerably. We also were able to ensure that if they become incapacitated, that we named their children to serve for them as Durable Power of Attorney and Health Care Surrogate. Lastly they created Living Wills, which allowed them to inform their family of their wishes in the event of a serious medical condition.

Another example is being able to quickly and efficiently handle a Probate when only homestead real property is involved. Our client's mother had recently passed away owning only her homestead real estate. We were able to substantially reduce our client's probate costs as well as complete the entire estate within 90 days because we were able to prepare a Summary Administration for the client.

Affordable Attorney, Gerling Law Group Chartered was founded by Rodney Gerling and Dana Laganella Gerling as a culmination of their shared vision to create a client centered firm which could service all the legal needs of the average Floridian family, from estate planning and small business creation to personal injury and criminal defense. My past experience includes Civil Litigation prior to opening my own law practice. I handled both Plaintiff Personal Injury matters as well as represented insurance companies on defense of Personal Injury matters and Workers’ Compensation claims.

Activities and Awards

Dana Laganella Gerling has been nominated again for Best Attorney in East Manatee County for 2009. Furthermore, Dana Laganella Gerling was one of the twelve winners of the Women and Men of Manatee County. The United Way Calendar Showcase Event took 19 selected nominees (nominated from people within Manatee County) to raise money for the United Way and in turn earn a spot in the calendar. Dana became Ms. January of the 2008 United Way calendar. Dana was also recently voted one of the top Up & Coming attorneys in Florida Trend Magazine's Legal Elite balloting, and she was featured in their July 2008 publication.

What is your opinion regarding clients educating themselves on legal issues?

I think that everyone should educate themselves on the legal documents that they are considering prior to discussing them with an Attorney. There are many online resources that can give you a great start in understanding what each different estate planning tool can do for you and your family. I do however believe that once you get a general understanding, you need to see an attorney to help guide you through the maze. The concepts can be confusing and you need direction. We are specially trained to help you understand these legal concepts.

Are you willing to review documents prepared by clients?

We are willing to review documents that are prepared by our clients, but we are not willing to provide legal advice regarding that specific document or execute those documents in our office. I strongly believe that Estate Planning, which can be made very simple, is complicated and should be done by a licensed attorney.

Are you willing to coach clients who want to represent themselves?

We do not handle this area.

Why did you decide to be a lawyer?

I initially decided to be a lawyer to help people. Once I got into law school I quickly realized that there were not as many areas of law I could practice to accomplish my goal. I was always interested in Estate Planning and I really love this area of law in that I get come up with solutions and plans that really work. I love to learn about people and their family dynamic and I love helping my clients leave a legacy for their family and friends. Having just had a daughter myself, I truly value family and I also hope that one day my legacy to her will be one that is organized, thoughtful, and memorable.

What work experience and education helps you be a better lawyer?

I am a people person; I love to chit-chat and talk about life and general experiences. I am very easy to understand and talk in plain English, no legalese here. I want to take the Estate Planning concepts and make them simple and understandable to my clients. I want to ensure that my clients feel like I am their attorney and when they leave my office they really understand what they have accomplished. I do not charge an hourly rate for phone calls, I do everything as a flat fee, that way my client's feel comfortable calling me and discussing anything that comes up in their life that I may be able to help them with, well after we have completed their Estate Plan. I understand the grief that comes with the death of a close relative, having lost my Grandmother when I was 18 years old. She was like a second mother to me and I feel that experience helps me guide my grieving client's through the Probate process and helps me be more sympathetic to their needs.

Why did you decide on your primary area of practice?

This is the area of law I was made to practice. My clients and I are on the same page, they appreciate my candor and my ability to explain the hard legal concepts in plain English. This is an area of law where you can truly help people and you get to see the fruits of your labor when their legacy is passed on to their children with saved expenses and efficiency.

What do you like best about your career?

I like being involved in planning for your life. I believe that your Estate Plan, your Will or Trust is one of the most important documents you will create and is a culmination of the life you have lived. You include your children, your precious assets and your legacy to them. It is very rewarding to allow my client's the comfort to know that everything will be taken care of if anything ever happens to them. Many clients walk out of my office with a weight lifted off their shoulders feeling just a little bit more protected.

Tell us about your law firm:

I have two great legal assistants that handle scheduling of appointments and daily administrative tasks. All client meetings are held by either myself or my partner, Rodney Gerling, who also happens to be my husband. All drafting is handled by myself. I like to work one on one with my clients and they always get to talk directly to me to handle any of their concerns.

What are your strengths and style?

I am very upfront and comforting. I have a way of making my clients feel at ease and allowing them to feel confident in the information I am providing. I am fun and add my sense of humor in my consultations. My clients also immediately see my devotion to my own family, as I send postcards of my little girl's picture out and always have my pictures out and ready to show on command.

Personal Interests:

I am a huge animal lover, having two dogs and two cats of my own. I think animals are so precious and help us learn so many of life’s lessons. I love to spend time with my young daughter and husband. I actually love to meet with clients and draft Estate Planning documents, I am very lucky that my practice if also a hobby. I like to golf, however golf does not like me so much, but every once in awhile I hit a great drive and I am back in the swing again. I like to socialize with my friends and treasure my days.
