Continuing Education

I attend continuing legal education seminars and usually exceed my hourly requirements by 20 hours. The topics that I attend are focused on Estate Planning and Bankruptcy. The seminar focuses on complicated cases and usually problems that are not common but are important to know how to address.

Example Cases

One of the most memorable cases I had was a family with a substantial amount of wealth. The husband and wife came in looking to have their estate plan done. After reviewing their assets and talking with them, I knew that this case was going to be more of a challenge than normal. Combined, they were worth $10 million dollars, but the money was not the challenge. The challenge came when I found out how they wanted their assets to be controlled after they had passed. They both had substantial separate property and they wanted to insure that if they should pass that the surviving spouse had use of the separate property money.

The problem was that neither of them wanted the surviving spouse to have the ability to give it to anyone other than the couple’s child, which was completely understandable. I set up the estate in a way that would maximize the tax benefits and still accomplish their goals. After speaking with the couple about their options, and explaining to them the advantages and disadvantages of each of these options, I was able to create an estate plan that they felt would accomplish their goals within the framework allowed by the law and the IRS. The clients walked out of my office understanding their estate plan, and confidant that their goals were going to be met. Since I first met the couple, they have referred many of their friends and family to me.

I want my clients to walk out of my office understanding what their documents will provide them, how they work, and feel confident that their goals of protecting their family and assets will be met. I decided to pursue this area of law after some personal loss showed me just how important it is to have an estate plan. After my brother’s death, who died without a will, I found out firsthand what a nightmare the probate court can be and how expensive it is both monetarily and emotionally. When you have experienced a loss, the last thing you want to do is fight the court to get your brothers stuff. After insuring that all my family and friends had estate plans, I decided to open my own practice. It is my privilege to help families every day. Now that I am a parent, I enjoy helping other parents provide for their children’s future. I am not a big firm that is focused on getting as many clients in the door as possible to support the partner's salaries. I am keeping my firm small so that I can spend more time with my clients and insure that I give what they want and draft the document to meet that goals.

Tax Attorney/Manager at Strategic Tax Resolution
I was entrusted by the managing partner to develop the tax resolution department. I was the Senior Tax Attorney responsible for the negotiations with the IRS for 3,000 active clients with a team of one attorney, six account managers, and three support staff. Increased satisfaction of clients by increasing efficiency through education, and standardizing procedures and documents. I was responsible for evaluating clients with complex finances and construct a viable strategy to provide the client with the best possible outcome. Was entrusted with interpretation of complex tax laws, rules, and regulations in simple terms for our staff, clients, and management. I used my problem solving and negotiation skills to develop new effective tactics and procedures for dealing with the IRS. Unfortunately, the partners made some costly business decisions and are closing the company.

What is your opinion regarding clients educating themselves on legal issues?

The best thing a client can do is educate themselves regarding any legal issue they may be facing. A client that is informed will provide their attorney with the information that the attorney needs, and the client can provide information that the attorney may not ask about. There are times when a client has an issue that needs to be addressed, but that is not in the normal realm of questions an attorney would ask about.

Are you willing to review documents prepared by clients?

I enjoy reviewing clients' documents. Often the documents I see are sufficient, but because most of them are boiler plate documents, they do not address particular issues that the client is facing. I am then able to either guide the client if they wish to draft the section themselves, or I am able to draft language that they can insert into their document. I am in this profession to help people, and I will help them however I can.

Why did you decide to be a lawyer?

I decided to become an attorney because I wanted to help people and provide a service that is critically needed. While in college, I took a variety of courses and took a few Philosophy classes. After that I was hooked. I enjoyed the critical thinking and problem solving. A professor encouraged me to pursue my gifts and apply them beneficially for the public, thus beginning my journey into pre-law, and then law school. Once in law school, I was drawn to children’s issues, in part because my wife is a social worker and worked with children. Then, during my first semester of my second year, I lost my brother. He died without a will, and I got experience in the probate system firsthand. From there, I discovered that I could help children and families by insuring that they have well-written estate plans.

What work experience and education helps you be a better lawyer?

I believe my compassion makes me a better lawyer, at least in this area of practice. I married a social worker because of her large heart, and she has just amplified my desire to help families protect their children and their spouses. My children have made me a better attorney. They have taught me patience, determination, love, and compassion. It is their innocence and all children’s innocence that have inspired me to become better at whatever I pursue. Additionally, I believe dealing with my brother’s estate has given me a unique perspective of the probate system, and how to help my clients avoid the same situation.

Why did you decide on your primary area of practice?

I chose this area of practice because it allows me to help families in a cooperative, non-adversarial arena. It also allows me to meet people in their homes or wherever they are comfortable.

What do you like best about your career?

I love that I can help and interact with people when they are not in a crisis. I worked as a family law attorney and the only time I was able to interact with people was when they were unhappy. I know that many of these people were great people, but because of what they were going through it was an unhappy environment. Now, I get to help people and get to see what truly wonderful people they are. Additionally, this career allows be to be with my children and make all their events.

Tell us about your law firm:

I am a solo practitioner, so my clients deal directly with me. I provide my clients with my cellphone number so that they are able to contact me at anytime. I do not wait until normal business hours to return my clients messages, or answer the phone. If I am able, I answer the phone or call them back as soon as I am able. There are times when I will not be able to return a call right away, but I will return it as soon as possible. I have work at a firm where my paralegal was the only one how talked to the client. I thought that the clients deserved better service and decided that I would not let that happen in my own practice.

What are your strengths and style?

I believe my strengths are my ability to explain complicated issues in everyday language, my flexibility, the fact that I am personable, my willingness compassion, my family, and my balanced approach to life.

Personal Interests:

My personal interests are: painting, all the artwork in my office is my own, surfing, reading, traveling with my wife and children, restoring my 66 Mini Cooper, kickboxing, playing music, and meeting new people.

Fixed-Price Services and Fees

Yes, for a complete estate plan, will, trust, durable power of attorney, and advanced medical directive, I charge $1,500 for most estates under $1,500,000. I can draft individual documents as well. The price does vary depending on the complexity of the document. A will without a trust can range from $400 to $800. Trusts start at $600 and go up from there. Clients that come from Nolo will receive a 10% discount.

$130 per hour, billing in ten minute increments.

Yes. The initial consultation is for up to an hour. If a client is unable to come to my office, I am willing travel to their house or other location.
