I've been attending continuing legal education classes in Texas and throughout the United States since being licensed. My interests have included a variety of bankruptcy topics which are relevant both to personal and business bankruptcy cases. From objections to discharge actions in Chapter 7 liquidations, to treatment of tax liabilities in Chapter 13 and 11 reorganizations, I most always exceed the annual number of required hours.

At The Law Offices of RJ Atkinson, we help people and businesses in Houston file for bankruptcy under Chapters 7, 11, and 13. Previous Employment Summary

I have been practicing on my own since being licensed in 2001 and have never worked at another law firm as an attorney. Before going to law school I worked for a law firm as an administrator, a large company as a purchasing agent, and I owned a small retail store.

What is your opinion regarding clients educating themselves on legal issues?

I think it's great! Anyone who is in need of legal assistance should be self-educated when approaching an attorney. At the very least they should try to familiarize themselves with the basic issues regarding their legal situation.

Are you willing to review documents prepared by clients?

If I think the situation is appropriate then I sometimes review client prepared documents. That stated, I always advise clients prior to any review to do a cost benefit analysis, as my charge to review the documents can sometimes be equal to the cost for me or my firm to actually prepare the documents.

Are you willing to coach clients who want to represent themselves?

If I feel the situation is appropriate then I may consider it. However, keep in mind that everyone involved in the bankruptcy process is a lawyer or has an attorney representing them. The judge is a lawyer and the court has the United States trustee who is a lawyer, the Chapter 7 or 13 trustee is a lawyer or has a lawyer or both, and most all creditors have lawyers representing their interests. If a client wants to represent themselves in a case but is the only one without legal knowledge, they are likely at a grave disadvantage. So, depending on the matter, some cases I may be willing to coach and others maybe not.

Why did you decide to be a lawyer?

To make a difference in the community and in people's lives.

What work experience and education helps you be a better lawyer?

Well after representing over 3,000 debtors, I know the impact that my services have on the lives of people struggling with debt and their family's financial future. I can't say that I've seen it all, but what I have experienced since becoming a lawyer makes me more compassionate towards the bad things that can happen to people.

Why did you decide on your primary area of practice?

Helping clients get out of debt or to reorganize financially usually leaves them much happier and more optimistic than when they first come in. I really like helping people to relieve the pressure of burdensome debt and to start over.

What do you like best about your career?

I love meeting with new clients because every time you meet a different person, you are introduced to a different and interesting story. Being a committed and experienced lawyer who takes my responsibility seriously, I like what I do and know that the results I achieve for my clients will have a lasting impact on their lives.

Tell us about your law firm:

The people I work with are great and they are all team players. My attorneys and paralegals are my backbone and my firm.

What are your strengths and style?

Having done this for awhile, I am able to come up with solutions fairly quickly. My style is very straightforward and I aggressively represent my clients.

I love spending time with my family and friends. I also enjoy music, art, and traveling.

Fixed-Price Services and Fees

Since the one thing that is in common with almost all bankruptcy debtors is a lack of available money, we are sensitive to the situations of potential clients. As such, we offer a flat fee of $700 for most personal Chapter 7 bankruptcy cases. That means the attorney's fee is $700 plus an additional $299 court filing fee which totals $999.

As for Chapter 13 bankruptcy cases we accept most cases for no money down on attorney's fees and file the case for just the $274 filing fee. The fee is fixed by the Bankruptcy Court for Chapter 13 cases.

Hourly Rates

Outside the scope of our Attorney Fee Contract, we have hourly rates which apply. Depending on which attorney is working on what case, our hourly fees for attorneys range from $100 to $375.

Free Initial Consultation?

I offer a free initial consultation for the period of time necessary to assess the facts in a potential case and render the available options we can assist with. Sometimes it takes 10 minutes and sometimes an hour.

Typical Retainer

In order to retain our services, a potential client must provide at least $100.

Understanding Fees

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
