Example Cases

Bankruptcy Matter - In re (redacted) - a couple from the Upstate of South Carolina, met with me wanting to file a bankruptcy petition under Chapter 13 to stop the foreclosure of their home. They had just been denied a loan modification and had very little time remaining before the foreclosure sale. We filed their petition within one business day, just before the foreclosure sale, and proposed a Chapter 13 repayment plan in which they would repay their home mortgage arrearages over time, saving their home.

At Tomblin, Farmer & Morris, PLLC we are dedicated to providing excellence in legal representation. Our firm offers a broad range of legal services to meet our clients' needs with a significant focus of our practice being bankruptcy and Social Security disability matters. Every client is extremely important to us, and we strive to give the assistance needed to obtain the best results possible.

Our firm was established by A. Clyde Tomblin in the 1950s. Joshua and Andrea Farmer joined the firm in 2004 when it became known as Tomblin and Farmer, PLLC. In 2006, Mr. Tomblin retired and became Of Counsel to the firm. During that same time, Mark Morris joined the firm as a partner and the firm's name changed to Tomblin, Farmer & Morris, PLLC. Our firm has for many years served clients in Rutherford County, North Carolina and the surrounding counties. Currently, we have offices located in Rutherfordton, North Carolina; Spartanburg, South Carolina; Shelby, North Carolina and Marion, North Carolina.

Josh and Andrea Farmer have worked at the firm for their entire legal careers. In 2000, prior to his attending law school, Josh started a real estate investment company, Two Mile Properties, LLC which owns and manages rental real estate in the Upstate of South Carolina. He is still active in the management of that company.

What is your opinion regarding clients educating themselves on legal issues?

We strongly support our clients' desires to educate themselves on their legal issues. To that end, we have started our bankruptcy information website, www.carolinabankruptcyhelp.com, where clients can educate themselves on various bankruptcy issues. Bankruptcy is a very complex area of the law, the intricacies of which should not be taken lightly. We offer each of our clients a free consultation (30-60 minutes) during which they meet with an attorney to discuss their specific legal issues and how the law apply to their situation. They do NOT meet with a paralegal as is the custom at some other firms.

Are you willing to review documents prepared by clients?

We will review any and all documents relevant to representing a client in a case. We caution clients that preparing and filing a pro se bankruptcy petition involves significant risk and should not be taken lightly.

Are you willing to coach clients who want to represent themselves?

We offer a free, initial consultation during which the client's matter is discussed and the client is quoted a fee for our services. We are not comfortable coaching clients regarding their pro se bankruptcy.

Why did you decide to be a lawyer?

All of our attorneys are ordained ministers and we consider our practice of law to be our calling to help others in our community.

What work experience and education helps you be a better lawyer?

Each and every case that we handle broadens our knowledge and experience as attorneys and advocates.

Why did you decide on your primary area of practice?

Our attorneys enjoy helping our clients. Bankruptcy and Social Security Disability are practice areas that involve clients who have faced difficult circumstances and, often, have had their lives turned upside down. We can provide sound advice and advocacy for these clients to help them protect their rights and obtain the relief and benefits that they are entitled to under the law.

What do you like best about your career?

I very much enjoy helping my clients solve problems. Many times clients come to us misinformed about their rights under the bankruptcy code. It is wonderful to be able to help people realize that they do have options despite their financial troubles. It is clear that we make a difference to our clients and they are grateful for that.

Tell us about your law firm:

The attorneys in our firm take a personal interest in their clients' matters. You always have access to a case manager and your attorney to discuss your matter. Your phone calls and emails will be returned in a prompt manner. Our office staff is very helpful to attending to all of our clients' needs. Micah Carlson and Kerrick Hudson assist our clients in bankruptcy and Social Security disability matters. Hannah Kidd and Marianne Aguirre assist clients in other practice areas.

What are your strengths and style?

Our attorneys are zealous advocates for our clients and work hard to achieve the best possible outcome for them.

Personal Interests:

I am married to Andrea Farmer, an attorney with our firm. I have one son, Thomas, who is 2 years old. I enjoy spending time with my family. I am very active in my church, especially with the children's and youth ministries. I have traveled extensively to Europe and South America on business-related and church missionary trips.

Fixed-Price Services and Fees

In almost all cases, we quote prospective clients a fixed fee for our services during an initial consultation. We are very flexible with offering our clients payment plans which suit their needs and budget. Our fees for bankruptcy filings vary according to the complexity of the case and are very competitive for our services. In some very complex cases, a fee estimate with an hourly fee arrangement is offered.

Hourly Rates

For those matters which require an hourly rate approach, we charge $200-$250 per hour.

Free Initial Consultation?

We offer a free initial consultation lasting 30-60 minutes, the length being at the discretion of the attorney. Our goal is to completely discuss the client's matter.
