The firm was established in January 2009, and we are Northwest Arkansas' only law firm that exclusively represents consumer bankruptcy clients.

Previous Employment Summary

I have been licensed to practice law for 25 years, first in Florida and now in Arkansas. I have previously acted in the role of General Counsel for a Fortune 500 company but now is firmly established in my new role of helping individuals in Fayetteville, Springdale, and Rogers, Arkansas and surrounding communities get a fresh start.

Activities and Awards

I also associate with the Legal Aid Society of Northwest Arkansas to provide pro bono bankruptcies for clients screened by that organization.

What is your opinion regarding clients educating themselves on legal issues?

Bankruptcy is an area in which "urban legends" abound, and are often patently false. I do not charge for giving advice over the phone and would prefer consumers to call me to check their assumptions before making financial mistakes either inside or outside of bankruptcy. There is no fee for answering questions over the phone.

Are you willing to review documents prepared by clients?

The average bankruptcy petition that is filed in court is 58 pages long containing 11 different forms and schedules. It is very difficult for a person to navigate through this without the assistance of an attorney. Nevertheless, I would be happy to review the forms prepared by someone to see if they will achieve the result desired by that person.

Are you willing to coach clients who want to represent themselves?

I am willing to provide advice to anyone who finds themselves contemplating bankruptcy. Because I do not practice in other areas of law, nor have to answer for my time to partners or superiors, I am free to help people in various different manners in and around the practice of bankruptcy. I tell people all the time they are welcome to call my cell phone and ask questions, regardless of whether they ever actually enter into an attorney-client relationship with me.

Why did you decide to be a lawyer?

I initially became a lawyer to enter the world of public service. After a long detour into the corporate world, I am now working the best possible job: helping people who find themselves in difficult circumstances.

What work experience and education helps you be a better lawyer?

I also have experienced many of the hurts and pains of life that I see my clients wrestling with and trying to get through. I have walked a path that includes deep family wounds and job loss. I understand the language of comfort and encouragement.

Why did you decide on your primary area of practice?

Until I established the Hertzberg Law firm of Arkansas, P.A., the Fayetteville, Springdale, Rogers metropolitan area did not have a law firm dedicated to providing assistance only to consumers who needed bankruptcy representation. Those firms in the area who did the most bankruptcies often delegated most of the client meetings to paralegals or legal assistants. I felt a need existed for a firm that provided high quality service, easy accessibility and affordability to the citizens of Northwest Arkansas.

What do you like best about your career?

The motto of the Hertzberg Law Firm of Arkansas, P.A. is "Proclaim Liberty," which is inscribed on the Liberty Bell as a quote from the book of Leviticus in the Bible. Just as every seven years the debts of God's people were to be cancelled so that they did not have to walk their entire lives in bondage, I love helping people in the 21st century to also "Proclaim Liberty."

Tell us about your law firm:

I am a sole practitioner and all my clients deal directly with me. I have strived to set up a family friendly and child friendly law office. I am one of the few law firms in the area that has a special children's play room adjacent to the main conference room so that children will feel welcome in my office.

What are your strengths and style?

I speak plainly and directly to people. I am not afraid to say "I don't know" or "I made a mistake." I keep my word.

I enjoy doing anything my four children are interested in. I love them hogs!

All of my bankruptcies are done on a flat fee basis and are believed to be among the lowest in the Northwest Arkansas area. No hidden charges and no billing surprises.

The client is never billed hourly.

Free Initial Consultation?

Consultations are always free, whether by phone or in-person and regardless of how many consultations are necessary. Clients are only charged if they specifically retain me to prepare and file a bankruptcy petition for them.

Typical Retainer

Two hundred dollars starts the case for any client.

Understanding Fees

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
