In re Curtis (1st Circuit BAP 2007) drafted, argued and won summary judgment appeal alleging that credit report notations may violate the bankruptcy discharge injunction. In re Pratt (1st Circuit 2005) drafted appellate brief for case that established that passive collection techniques, like refusing to accept surrender of a vehicle, violate the bankruptcy automatic stay.

Firm Focus and History

A native of Kennebunk, Maine, I have been representing consumers in bankruptcies and litigation since before the bankruptcy laws changed. I have represented around 1,000 clients in the bankruptcy process, having worked at the largest consumer bankruptcy firm in Maine for two and a half years, followed by over a year at another major consumer firm in Auburn. I am one of two attorneys in Maine recognized by Bud Hibbs as a consumer advocate. In addition to helping individuals and small businesses through the Chapter 7 process or Chapter 13 reorganization, I represent debtors in prosecuting bankruptcy creditors who violate the laws and represent consumers in Fair Debt Collection Practices Act, Fair Credit Reporting Act, and Unfair Trade Practices Act litigation, both defending against lawsuits initiated by debt collectors, and prosecuting those cases. I also offer non-bankruptcy alternatives, including debt settlement. There are many debt consolidation companies taking advantage of consumers. My firm opened on April 1, 2009, at the convenient location of 415 Congress Street in downtown Portland, just off the Franklin Arterial, between the City Hall and First Parish Church. From this central location, I hope to be able to help clients from Kittery up to the Bangor area. I also have the benefit of being just a five minute walk to the Bankruptcy Court house and a two minute walk from the District and Superior Courts.

Previous Employment Summary

Worked as the only associate attorney at a major bankruptcy law firm in Biddeford/Saco for two and a half years, established the firm's consumer litigation department, managed 150 Chapter 7 cases and 90 Chapter 13 cases at a firm in Auburn, established that firm's consumer litigation practice. Prior to law school, I worked as a Silver Specialist at Skinner, a major antiques auction company in Massachusetts, and ran my own antiques business established in 1989.

What is your opinion regarding clients educating themselves on legal issues?

It is important to understand the legal process you are involved in. However, some areas of the law, like bankruptcy and consumer litigation, should not be pursued without the assistance of a qualified advocate.

Are you willing to review documents prepared by clients?

I am willing to do so, but sometimes reviewing and changing documents can be more time intensive and costly than seeking assistance at the start.

Are you willing to coach clients who want to represent themselves?

I am willing to assist, but caution clients to consider retaining counsel in complicated matters. All bankruptcy clients who want to represent themselves should visit www.meb.uscourts.gov. The local bankruptcy court website is filled with sample forms and information.

Why did you decide to be a lawyer?

I wanted to offer consumers protection against the credit industry. Too many people are taken advantage of by credit card companies and debt collectors. There are laws designed to protect people and I hope teach the creditors that they cannot take advantage of uninformed citizens.

What work experience and education helps you be a better lawyer?

As a native of Kennebunk, Maine, I understand the problems and challenges faced by our state's citizens. I grew up in a lower income household, which was dramatically affected by health issues. I think my experiences give me insight into the events which clients to my door and enable me to better help them.

Why did you decide on your primary area of practice?

I wanted to help consumers use the laws designed to protect them.

What do you like best about your career?

I enjoy helping people, but what I enjoy more is making the creditors realize that the legal system is not there simply to help them make money.

Tell us about your law firm:

I started off at a small firm that now has 4 attorneys and 12 to 15 staff. My mentor was extremely knowledgeable, but as his practice grew, he couldn't offer the one-on-one interaction his clients sought. As a solo practitioner, each client deals directly with me. I know their situation intimately and bear that in mind when meeting with them, preparing their documents, or representing them in court. I think it is important in both bankruptcy and consumer law that clients know that their cases are being handled by an experienced practitioner. I pride myself on offering that service. Because I am in a small practice, I can offer more competitive rates than other attorneys in the area. I encourage potential clients to call other attorneys to compare rates. I am confident that I offer the most experience for the lowest cost!

What are your strengths and style?

I sympathize with my clients and get along well with them. Many bankruptcy attorneys treat the process as a factory, pushing as many clients through as possible. I take the time to get to know clients and that helps me represent them better. I also have a broad range of knowledge. I can represent clients in a bankruptcy and represent them in prosecuting a creditor who violates bankruptcy laws months or years later. I can also advise clients on who to best to rebuild their credit after a bankruptcy. Most attorneys don't offer services beyond the bankruptcy filing. Fixed-Price Services and Fees

I offer free consultations. My bankruptcy cases are fixed price and range from $800 to $2,000, with $1,000 to $1,300 being the average upfront fee in Chapter 7 or 13 (additional fees are paid through a Chapter 13 plan). It is my goal to offer superior services at a lower rate than other specialists in the field. My low overhead and proximity to the Portland courts allow me to do that without sacrificing personal service. Most of my Fair Debt Collection Practices Act, creditor harassment, and bankruptcy litigation is taken on a contingent fee basis; I don't get paid unless we win or settle. For workouts, dischargeability actions, and some litigation, I charge the hourly rate of $185. It usually takes one to two hours to negotiate a favorable settlement on a credit card.
