Example Cases

Practice Area: DUI and DWI
Description: Under age person came to the office charged with DUI, possession of marijuana, and felony possession of a controlled substance. Law enforcement found over five 1.75 liter bottles of varying types of booze in the vehicle along with seven passengers all of whom where underage. According to law enforcement many of the occupants were intoxicated, the client was swerving, almost hitting property, had slurred speech, and refused the roadside exercises and the breathalyzer.
Outcome: This case turned on the evidence battle. I was able to exclude evidence. All drug charges were dismissed prior to trial. Client found not guilty at trial.

Practice Area: Business
Description: The sale of a business went sour after the new owners discovered creative bookkeeping of financial records.
Outcome: My advanced degree in taxation and my background in financial services brought this case to a quick conclusion at the mediation table. Using the tax code as leverage, a settlement was reached and the clients achieved their pre-litigation goals.

Practice Area: Criminal Defense
Description: Many criminal cases begin with a traffic stop, therefore being up to date and knowing how to litigate the validity of the stop and search that follows is crucial to every criminal traffic case, many drug cases, and every case where evidence against a client is obtained through a vehicle search.
Outcome: I have had cases dismissed based on traffic stop issues in multiple cases including reckless driving, DUI, possession of drugs, felon in possession of a firearm, possession with intent to sell, driving with a suspended license etc.

Firm Focus and History

I became an attorney in 2003 and opened my solo practice on November 1, 2008. I focus my practice on trial law specializing in criminal, family and business law. Criminal cases include white collar criminal defense, driving under the influence ("DUI") of drugs or alcohol, criminal traffic, vehicular homicide, DUI manslaughter, sex offenses, drug offenses from trafficking to mere possession, bond issues, violation of probation, theft, child abuse, domestic violence, battery, organized fraud, exploitation of the elderly, and weapons charges. I handle all levels of criminal offenses from misdemeanors to life felonies and criminal appeals.

Family cases include divorce, custody, paternity, modification, domestic violence, child abduction, division of assets, parenting plans, and marital settlement agreements. I represent businesses from start up to litigation after sale. I can assist clients in maintaining their corporate books, drafting documents, estate planning and litigation. Many clients also have used me to provide general consulting regarding business decisions.

I also handle civil litigation or civil trial matters including personal injury, auto accidents, wrongful death, defective products, estate litigation, business litigation, contract disputes, landlord tenant etc.

Previous Employment Summary

Prior to entering law, I had a financial services career at Morgan Stanley and at Banker's Life & Casualty. I have also obtained an advanced law degree in taxation. What is your opinion regarding clients educating themselves on legal issues?

My clients receive every piece of paper that come through my office relating to their case. An informed and educated client makes the best decision for themselves and their family. I take the time to explain the applicable law and in some cases will provide copies of relevant case law and statutes to provide my clients with a better understanding of strategic decisions, and why certain advice is given.

Are you willing to review documents prepared by clients?

I am willing to review documents prepared by clients and in Family Law cases and will ask clients to fill in forms to the best of their knowledge and recollection. I have in the past handed a form back to a client for a signature after review and filed it with the court. Some clients have the time to assist in their cases to a great degree. An involved client helps me to better prepare my cases for trial. Rarely will a client's input add nothing to the strategic planning of a case.

Are you willing to coach clients who want to represent themselves?

I have hired lawyers and represented lawyers. I have been in courtrooms on a regular basis since 2001, and in that time I have noticed that you will almost never see a lawyer represent themselves in court. I do not recommend anyone represent themselves.

Why did you decide to be a lawyer?

I believe that I help people and make a difference in their lives. In addition, I see myself as having a role in protecting our constitution and our way of life by protecting those individuals, who our government would treat unfairly, take advantage of, or otherwise trample or treat like a number.

What work experience and education helps you be a better lawyer?

My LL.M (advanced law degree) from the University of Florida in tax law, and career prior to entering the legal field, benefits clients in both civil and criminal litigation. This background provides insight to the issues facing white collar defendants, family clients, business clients, and estate litigation cases. My education and experience has led many clients to request me to draft contracts, wills trusts and other estate planning documents.

Why did you decide on your primary area of practice?

I chose to practice criminal defense because I believe in the constitution, our form of government, the rights that we as citizens have, and that my actions as in criminal defense secure these rights for all individuals.

I chose family law because I saw the injustice faced by fathers. As a father of four children I believe that my role is to protect children and the rights of parents. In addition, my background lends itself to strategic planning of asset division.

I chose business law because I love helping people achieve their dreams by helping them through start up, expansion acquisition and sales. I have a strong desire to learn about your business and the specific law in that affects your area. My first career was business. I am in business. I have had clients who were the founders of publicly listed companies my service of this area allows me join in the efforts to make the dreams of entrepreneurs a reality.

What do you like best about your career?

I believe that I help people and make a difference in their lives. In addition, I see myself as having a role in protecting our constitution and our way of life by protecting those individuals who our government would treat unfairly, take advantage of, or otherwise trample or treat like a number. When government or the courts aim their big guns at an individual, that person needs a lawyer who is there ready and willing to fight and believes in the cause, not just the fee. I enjoy being in the courtroom litigating or bringing cases to just resolutions for my clients, whichever is better for them.

Tell us about your law firm:

All of my clients deal directly with me. My assistant has been working with me for over two years and has a wealth of knowledge.

What are your strengths and style?

I am committed to putting in the time necessary to be more prepared than anyone else. I will work collaboratively with a team of expert professionals, if need be, to conduct the most thorough investigations possible so that every detail is noted. At the end of the day, you will always know that everything that could have been done was done.

Fixed-Price Services and Fees

My policy is to quote flat fees in the majority of criminal cases. Most other cases are handled on an hourly basis, mention Nolo and receive a 10% discount to the Standard Schedule of Fees.

Typical Retainer

$750 minimum fee for civil cases and second degree misdemeanors. $150 minimum for civil traffic infractions.
