Example Cases

Client sustained significant injuries to her shoulder which required surgical intervention as a result of a car accident. Tomassi Law Associates was able to effectuate a settlement for the full policy limits of the adverse party as well as the client's underinsured policy. Total settlement achieved in this case was in excess of $325,000.

Client sustained injuries to his back as a result of a car accident. Insurance company argued that the client's injuries were preexisting and did not warrant a full policy limit settlement. Our firm was able to successful obtain a recovery for the client for injuries, pain and suffering, lost wages and lost consortium for full policy limits without the unnecessary expense and delay of litigation. Total recovery was in excess of $200,000.

I established Tomassi Law Associates in 2006. After spending over 15 years working as an independent insurance adjuster for insurance companies nationwide, I elected to put my years of knowledge and experience to work for plaintiffs who sustained personal injuries as a result of an accident. My experience as an independent insurance adjuster and private investigator, working directly for the insurance companies throughout the country, provides me with a unique and valuable knowledge base, experience, and perspective in the plaintiff's representation.

I have owned and operated Forensic Business Solutions, Inc., an independent insurance adjusting and private investigation firm, for over 10 years. As an independent insurance adjuster, I worked directly with insurance companies in investigating, adjusting, and settling insurance claims.

What is your opinion regarding clients educating themselves on legal issues?

Client education is an integral part of obtaining a successful resolution to a legal issue. A primary focus for our firm is to ensure that our clients are well informed of the law that affects their case. An informed and educated client is able to rationalize and reason much more effectively and provides for a better understanding of their rights and duties with respect to their case.

Are you willing to review documents prepared by clients?

I am always willing to work with clients in any capacity that he or she desires. I accept legal assignments of all sizes and types to include the review, editing, and/or redrafting of legal documents prepared by clients.

Are you willing to coach clients who want to represent themselves?

I am always willing to work with clients in any capacity that he or she desires and will help clients understand the law and understand the obstacles that they may encounter. However, this depends on the nature and type of case the client is involved in. There are cases where it is advisable and in the client's best interest to retain an attorney to protect his or her legal rights and interests.

Why did you decide to be a lawyer?

I know it is a cliché, but I became a lawyer to put my skills, experience, and knowledge to work to help people. I wanted to be in a better position to offer people who have been injured by the negligence of another the resources and ability to be compensated according; to be in a better position to right wrongs and fight for justice; and to be able to have an active voice in the pursuant for justice and help shape the law that affects our society. What better way to earn a living than to be able to help people and help make a difference, no matter how small, in someone's life?

What work experience and education helps you be a better lawyer?

I have been a business person for over 10 years. I have owned and operated Forensic Business Solutions, Inc., which is an independent insurance adjusting and private investigation firm. Why did you decide on your primary area of practice?

The experience and knowledge obtained over the past 10 to 15 years as an insurance adjuster and private investigator provides me with a unique set of tools and resources to successfully represent plaintiffs in all lines of insurance claims.

What do you like best about your career?

I personally enjoy the interaction with my clients, working with them and for them in bringing about a successful resolution to their case. I enjoy building long lasting relationships with my clients and being a resource for them to tap whenever they need to.

One of the benefits of retaining Tomassi Law Associates is that each and every client deals directly with me. They are not passed off to a paralegal or associate attorney. Each and every client has direct access to me 24 hours a day by office phone, cell phone, and e-mail.

What are your strengths and style?

I operate a "Clients and Results" oriented law practice. I am an aggressive advocate for my clients and I am also an effective negotiator. I bring all of my knowledge, experience, and resources to each and every case in an effort to effectuate a successful resolution to the client's claim.

Personal Interests:

Family. I enjoy spending every possible moment with my family doing various activities and adventures such as amusement parks, picnics, day trips, recreational sports, and going to the beach. I also enjoy recreational golf every now and then.
