I have been the lead attorney on the following appeals that have resulted in rulings favorable to injured individuals:
Delgado v. Trax Bar & Grill In this case, our client was assaulted in a parking lot as he and his wife left a night club. This California Supreme Court ruling sets forth the circumstances under which a night club can be held responsible for injuries to patrons who are attacked by third parties.
Mata v. Mata In this case, our client was an 11 year old girl whose father was fatally shot at a tavern. The Court of Appeal found that the tavern owner could be held responsible for not properly hiring and training his staff to deal with disruptive patrons. This case ultimately settled before going to trial.
Cohen v. Five Brooks Stable In this case our client was injured when she fell from a horse during a guided trail ride at Five Brooks Stable. She was dragged by her horse over a quarter of a mile. The Court of Appeal concluded that although Ms. Cohen had signed a Release before going on the horseback ride, the Release did not clearly and unambiguously inform an ordinary person, such as Ms. Cohen, that its purpose and effect was to exempt Five Brooks Stable from liability for its own employee's negligence. This matter settled after the Court of Appeal issued its opinion.
