Example Cases

In one bankruptcy case, a mother of three was given a surprise bonus by her employer, just after the bankruptcy was filed. Needless to say, the bankruptcy trustee sought to take the money from her in order to pay her creditors back. Attorney Eric A. Morgan negotiated with the trustee and utilized federal bankruptcy case law to safeguard half of the funds—even though the client was arguably legally obligated to turn over everything to her creditors.

In a DUI case, a young lawn maintenance worker was charged with DUI. After a urine test revealed merely metabolized cannabis, Attorney Eric A. Morgan blocked the State's efforts to violate his right to a speedy trial by preparing a writ of prohibition to prevent them from picking the jury and then carrying the case over to the next month. Mr. Morgan stayed up all night preparing the writ, which is a highly unusual pleading. Due to the busy trial docket in that particular court room, the prosecutor was forced to offer the client a plea to the reduced charge of reckless driving, thereby saving the young man from facing a possible DUI conviction over a blood test that merely indicated use of marijuana within 30 days of his traffic stop.
