Example Cases

DUI: Client was stopped for speeding and the officer stated he failed all of the field sobriety tests. The client's BAC was 0.150. We brought a motion in front of the court and successfully had the BAC suppressed (thrown out). The prosecutor still offered no deal better than DUI. We went to trial and successfully argued to the jury that the officer's FSTs were done incorrectly (officers know less about FSTs than the public thinks). We won a very difficult DUI trial and client's DUI was therefore dismissed.

DUI: Client was stopped by the officer for having a rear license plate light out. We successfully argued in court that the officer could not have known that the rear license plate light was out because he viewed it in his rear-view mirror at a distance of more than 60 feet (the law says the light must be visible from 50 feet). Client's DUI (BAC of 0.175) was dismissed.

Firm Focus and History

We exclusively practice criminal law with the focus on DUI law and driving crimes. Our staff has special training in DUI law and we believe in offering to clients in Snohomish, Skagit, or Island Counties something that no other DUI law firm offers: exclusive DUI practice, highly trained professionals in DUI law, and a DUI author (no other attorney based in these counties has authored a DUI book, let alone three). Further, we pride ourselves in creativity - there is no case that cannot be argued! We challenge any other law firm in our counties of practice to provide clients what we provide. Our objective is to be the most successful DUI law firm in these counties, and we believe that we are.

Our firm was founded in 2004 in Mukilteo, Washington and opened a second branch office in Anacortes, Washington in January 2006.

What is your opinion regarding clients educating themselves on legal issues?

I think it is imperative that clients be knowledgeable about the legal process. Our firm provides a book, The DUI Handbook for the Accused, in order to facilitate such knowledge.

Are you willing to review documents prepared by clients?

Any document a client has regarding their case, we review.

Are you willing to coach clients who want to represent themselves?

We provide a free one-hour consultation for anyone charged with a DUI, plus free materials. We provide everyone who talks to us a free handout that details that DUI process - for free.

Why did you decide to be a lawyer?

Because of the challenge it afforded. Also, law is very competitive and this suits my nature.

What work experience and education helps you be a better lawyer?

Through my experience it has become clear to me that every client's case has the opportunity of success, no matter how bad it may initially appear. Therefore, we never give up on any case with the very real knowledge that a better deal is always possible, regardless of one's initial impression.

Why did you decide on your primary area of practice?

As a prosecuting attorney, I had the opportunity to try thousands of cases. The most challenging and technical cases were DUI cases. As a result, the DUI field is where I had the most knowledge and interest. Further, as a published author on DUI this area of law is where my level of expertise is most pronounced.

What do you like best about your career?

The challenge of working on behalf of people to make a potentially very difficult matter better. This requires experience, knowledge, and creativity.

Tell us about your law firm:

Our firm consists of four highly energetic and well trained professionals. The two attorneys, David and Stephanie, focus on the legal needs of the clients and aggressively advocate on behalf of clients in court. The office is managed by Janean who works directly with the Department of Licensing, treatment providers, and court staff.

What are your strengths and style?

My strength is tenacious persistence. No case under my watch is ever settled until I have personally done everything to ensure the best results. I also have a reputation amongst prosecutors and judges for being well prepared, creative, ethical, and knowledgeable.

Personal Interests:

Besides work, my interest primarily focuses around family and community. My wife and I have a young son who we spend a great deal of time with. I also volunteer much time to the local community through my involvement in the Rotary Club. Personally, I love to golf (don't spend enough time on it to be very good) and used to play Australian Football until I got too old. I also love to travel and cars.
