Example Cases

I am proud of the opportunity I had to represent a young man with cerebral palsy, who was also an amputee, who worked as a stock clerk in a grocery store. Due to his health problems, he experienced several periods where he was out of work for a few months at a time. This caused him to fall behind on credit cards and medical bills. When the bill collectors refused to work with him, we filed for protection under Chapter 7 and got the debts discharged. It was gratifying to help him get a fresh start so that he could begin to rebuild his finances.

I am also proud of the work I did for a bankruptcy trustee who wanted to sue a neurosurgeon who had filed a Chapter 7 bankruptcy. The trustee wanted to get an order from the court which would deny the doctor's discharge due to fraud, and to recover money he had fraudulently transferred to a family member before filing his bankruptcy. After a trial, the judge ruled in our favor on both matters. The result was gratifying because the few who commit bankruptcy fraud make it harder on the majority of honest people who need bankruptcy protection.

Previous Employment Summary

Before joining Rutherford Mulhall, P.A., I operated a solo practice concentrating in the areas of Bankruptcy and Real Estate. I previously worked in a small commercial litigation firm where I represented several bankruptcy trustees as well as debtors and creditors in bankruptcy matters. Prior to practicing bankruptcy law, I worked as a criminal prosecutor with the State Attorney's Office in the 18th Circuit and as a defense attorney with the Public Defender's Office in the 19th Circuit.

What is your opinion regarding clients educating themselves on legal issues?

I encourage clients to review as much information as they can, both before and during the representation. Well-informed clients are better able to help me help them.

Are you willing to review documents prepared by clients?

I cannot provide legal advice outside of the representation. If I do represent a client, it is not necessary for the client to prepare any document.

Why did you decide to be a lawyer?

As a lawyer, you get the opportunity to help people solve their problems. Even when you concentrate your practice on one area, like bankruptcy, each client you meet comes with a unique set of circumstances, so you are constantly challenged to provide different solutions.

What work experience and education helps you be a better lawyer?

My diverse work experience before practicing bankruptcy law has made me a better bankruptcy lawyer. Whether prosecuting, defending, or practicing real estate and business law, each experience added to my skill set and I find myself constantly relying upon knowledge I gained working in other areas before practicing bankruptcy law.

Why did you decide on your primary area of practice?

I started working in the bankruptcy field in 2000 when I got the opportunity to work for a very accomplished bankruptcy attorney and trustee. It was my first exposure to bankruptcy practice, and at that time, I was more interested in working for the attorney than in any specific field. As I learned about bankruptcy, I found that it was something I enjoyed doing and it provided a good forum to put my prior legal experiences to use.

What do you like best about your career?

I think that most lawyers will tell you that they chose this career because they like to help people, and I believe that to be true. As a lawyer, you can make a real difference in someone's life. The example I see is when clients who have been struggling with debt come to you for help and you get that debt discharged, you can hear the relief in their voice, and you can see it in the way they look - like a weight has been taken off them. The ability to help clients get that fresh start is a privilege.

I have worked in every situation you can imagine for a lawyer: solo, large firm, small firm, government, and corporate in-house counsel. Rutherford Mulhall offers me the best of all of these. What are your strengths and style?

My diverse legal background, combined with more than eight years of direct bankruptcy experience has provided the knowledge necessary to handle a broad range of bankruptcy issues. Because of this knowledge and experience, I like to foster a confident free-flow of information between my client and me in order to prepare the best course of action to solve the client's problem.

Fixed-Price Services and Fees

Bankruptcies are done on a flat fee basis. Attorney fees for the typical individual Chapter 7 are $1,500 and are $3,000 for Chapter 13. Fees may be paid in installments, but for Chapter 7 cases, all fees must be paid before the bankruptcy is filed.

Hourly Rates

If the client requests representation for a matter not covered by the bankruptcy flat fee, the hourly rate is $250.

Free Initial Consultation?

The bankruptcy consultation is at no charge, and usually lasts 30 minutes to one hour.

Typical Retainer

I don't have a typical retainer. Some clients pay the full fee with the retainer agreement, while others need payment plans.

Understanding Fees

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.
