Example Cases

In the past, I represented a small business owner who experienced many years of difficulty in meeting his monthly obligations and fell into both business and personal debt. Although we were forced to file both personal and business bankruptcy cases on his behalf, he was able to close the business that he was operating at that time in an orderly fashion via a business Chapter 7 bankruptcy case, restructure the debt he had personally incurred through a Chapter 13 bankruptcy proceeding, and eventually emerge from bankruptcy in a stable and better financial position.

Recently, I have seen a number of small business owners who have fallen into a similar position that has also affected their personal and family finances. I am working with these owners to develop a plan, using bankruptcy and non-bankruptcy relief, to restructure their debts and better use their income in the future to protect their property and family finances.

The attorneys Gillman & Gillman, LLC have a combined total of over three decades of Chapter 7, Chapter 11 and Chapter 13 experience representing personal and small businesses debtors. Established in and serving Central New Jersey since 1981, our practice is limited to representing individuals and small businesses experiencing serious debt problems who can use the laws that protect them to get a fresh start by eliminating or restructuring their debts, or providing legal advice in debt matters that do not require bankruptcy filings.

Previous Employment Summary

I have worked in a law office since well before my attendance at law school or my admission to the bar. I have also worked in larger law firms in New York in corporate business matters before returning to New Jersey and making my primary focus the representation of individuals and small businesses experiencing serious debt problems.

Activities and Awards

I have participated in the New Jersey Bench Bar Conference on Bankruptcy as a panel member regarding bankruptcy issues after the changes in the bankruptcy law that went into effect in 2005.

What is your opinion regarding clients educating themselves on legal issues?

I believe that a client should always educate themselves to the point of being able to ask good questions of any professional with whom they may work. I always suggest that my clients bring with them a list of questions they may have when we first meet as I understand that these are important decisions to be made. However, it is very important for a client to then consult with an experienced attorney regarding any legal proceeding as it will give them the ability to make good decisions.

Why did you decide to be a lawyer?

Having grown up watching my father practice law, I always believed that being able to help clients during their most difficult times was something that I wanted to pursue. As I grew older, I was even more drawn to practicing law since I appreciate the intellectual challenge and how this can often work with the practical world in assisting my clients.

What work experience and education helps you be a better lawyer?

I think what makes me a better lawyer is trying to constantly understand my client's situation and having the opportunity to meet with so many individuals in different fields and circumstances. Having worked in a law firm from a very early age, I was aware of how the real world is viewed in legal matters. Despite a lifetime of learning, I believe that the best representation is provided when you constantly strive to learn new and better ways to serve your clients.

Why did you decide on your primary area of practice?

I think that my personal abilities, training and life experience all lead to my primary area of practice in bankruptcy, and consumer and small business debt issues. I enjoy working with my clients in determining the manner in which the laws that exist may better protect themselves, their family and their business. I also find that many clients are not fully aware of all of the laws that may protect them and hope that my representation will better prepare them for future financial matters.

What do you like best about your career?

The greatest enjoyment I get from my career is working with my clients in better preparing and protecting them in often difficult times. Having worked in both a small office and large firm environment, I greatly enjoy the face-to-face relationship that I now have in a small office where I know my clients as individuals and can better serve their needs.

Tell us about your law firm:

I am very fortunate to have an experienced and wonderful staff who assist me in working with my clients. The attorneys in this office have over 30 years of experience in providing legal advice and representation in Chapter 7, Chapter 11, and Chapter 13 bankruptcy cases, as well as other related matters. My staff includes a certified bankruptcy paralegal as well as other staff members who are attentive to client concerns and needs. Due to our experience in these matters, our attorneys and staff are sensitive to the fact that our clients are often experiencing very difficult times personally and try to work with them in navigating and coming through these circumstances.

What are your strengths and style?

I believe the two most important strengths in this area of practice are analysis and empathy. It is essential when I first meet with a client to analyze their circumstances and develop a strategy to attempt to reach their goals. During the course of any legal matter, in litigation and negotiation, it is important to regularly analyze matters to find solutions that best serve your client and be mindful of client resources.

I always try to consider my client's circumstances while representing them. Each client is a different person and it is important to consider that person in best structuring representation.

I believe that my role in representing my client is as an advocate and adviser, and to try to always understand my clients no matter what the circumstance is that brought them to me.
