Example Cases

Family law matters are varied and each unique. I help clients with basic matters such as drafting documents. I also help family law clients with complex property matters involving substantial asset division, property tracing, and non-marital (gifts & inheritances) property claims. Many cases also involve individualized attention to father's rights, mother's rights, children's rights, physical-abuse or control issues, substance-abuse issues, and/or mental health issues.

Example family law cases include: obtaining primary placement of a child with the father client when mother and Guardian-ad-Litem were requesting primary placement with mother; obtaining equal shared placement of a child for mother client when father and Guardian-ad-Litem were seeking primary placement with mother; obtaining property and maintenance awards from Judges more favorable than settlement offers made before trial. I have successfully mediated/negotiated over one hundred divorce/family law matters.

Published appellate court civil cases include:
D.S. Farms v. NSP, WI Ct of Appeals 94-1981 (1995), upholding jury verdict of $1,450,225, for property damage case against electric utility; Hilke v. Three Rivers Dairy and Farm, Inc., MN Ct of Appeals C6-02-1646 (2003), reinstating jury verdict of $627,000 against milking equipment dealer; Allen v. WPSC, WI Ct of Appeals, 2005 WI App 40 (2005), upholding jury verdict in favor of dairy farmer of $1,750,000, based on stray voltage negligence and nuisance claims.

Firm Focus and History

Attorney Barb Miller, my law partner, and I have dedicated our careers to zealously advocating for the rights of individuals and small businesses.

I am a trial lawyer and mediator whose practice areas include: family law; divorce; child custody and placement; personal injury litigation; automobile, boating, and farming accidents; electrocution injuries; civil appeals; mediation/negotiation; and agricultural, business, property, and insurance litigation.

I am committed to my clients and to obtaining the best possible result on each and every case. To each case I bring over 15 years of successful courtroom experience practicing family law in many counties throughout Wisconsin and Minnesota. I have also served as a mediator for many years and I put this experience to use in negotiating positive outcomes for clients.

Barb's practice areas include: family law; divorce; child custody and placement; personal injury litigation; and criminal and OWI/DWI matters.

Barb and I formed Miller and Murray, S.C. in May of 2008. One local Judge referred to our new firm as a "Family Law Powerhouse". Barb and I have 40+ years of combined experience. Each of us had separate long-standing established law practices before forming the new firm. Both of our law practices had been primarily focused on representing individuals in family law matters and that continues to be the focus of Miller and Murray, S.C.

Previous Employment Summary

In addition to representing individuals and small businesses in Wisconsin and Minnesota with family law matters and a wide variety of personal injury and property damage claims, I have extensive legal experience in many other states throughout the country in complex litigation and appellate matters including successfully representing dairy farmers against electric utilities, cooperatives, and large insurance companies on a variety of agricultural issues including economic damage cases involving stray voltage/stray electricity, faulty milking equipment, and deficient feed.

Activities and Awards

I am a member of the local Lions and Kiwanis Clubs, volunteer coach for youth athletics, member of the Wisconsin Association for Justice, and since 1993 have represented disadvantaged individuals pro bono for the Southern Minnesota Regional Legal Services/Ramsey County Volunteer Attorney Program.

What is your opinion regarding clients educating themselves on legal issues?

I am in favor of clients being well-informed on family law and divorce issues. However, clients who are conducting independent research should be utilizing trusted sources, such as Wisconsin State Sponsored Website and Minnesota State Sponsored Website and Nolo.

I prefer to discuss whatever information a client has learned directly with him or her to check on the accuracy of the information the client has received. For instance there are many differences in legal substance and procedure in Minnesota and Wisconsin, and many differences in facts of each and every case. Accordingly, any "advice" or "information" given by a co-worker, neighbor, or family member should be discussed with an experienced family law attorney to verify its accuracy.

Are you willing to review documents prepared by clients?

I am willing to review drafts and documents prepared by clients. However, each document submitted to the Court can affect the outcome of a case. For this reason, it is important to have an attorney review documents prepared before filing them with the Court.

Are you willing to coach clients who want to represent themselves?

I offer consultation services to clients desiring to represent themselves.

Why did you decide to be a lawyer?

I had a teacher in high school who I "debated" with from time to time about assignments and grades, who told me I should be a lawyer some day. I always wanted to go into a field where I could help people and also put my competitive nature to work. I majored in economics and political science at the University of Wisconsin and decided to go to law school after graduation.

What work experience and education helps you be a better lawyer?

As a partner in my previous firm, in addition to practicing family law, I represented dairy farmers across the country in stray voltage and other dairy damage cases against electric utilities, milking machine companies, feed cooperatives, and large insurance companies. In representing dairy farmers in these complex cases, I had the opportunity to compete against high-powered law firms and attorneys in many states across this country. I learned much from the attorneys I battled against and from the Judges I practiced in front of. I believe my unique legal experiences provide me with valuable insight into how to present cases, evidence, and testimony in a manner that gives my client the best chance to win. I also believe my mediation/negotiation training and experience help me to better represent each of my clients.

Why did you decide on your primary area of practice?

Family law is one area where win-win outcomes are sometimes attainable, particularly in the area of legal custody and physical placement of children. I really enjoy trying to think of creative solutions to resolve a case that the client or opposing counsel has not thought of. Obtaining a favorable result for a client that is going through a very difficult time in his/her life is very rewarding for me.

What do you like best about your career?

I enjoy operating a small firm, working one-on-one with each client.

Tell us about your law firm:

My law partner, Barb Miller, also handles family law matters. We are very committed to working directly with each client and are focused on obtaining favorable results for each individual client. We provide our clients with 40+ years of legal and courtroom experience, primarily in handling family law matters. In addition, my legal assistant Kelly has been with me for over 10 years. With 14 years of experience in the legal field, Kelly is extremely knowledgeable and clients find her very helpful when I am in court or otherwise not immediately available.

What are your strengths and style?

I am very focused on obtaining favorable results for my clients. I believe this drive to obtain successful results for clients is a strength of mine. However, my style, at least initially, is not overly aggressive. This is because I believe in most cases my client can achieve the best results through negotiation and/or mediation. Trying to achieve a positive outcome without protracted litigation not only keeps attorneys' fees and costs low for the client, but also allows clients to move on with their life. This is often the best of both worlds. However, if the opposing party or opposing counsel will not agree to settle on acceptable terms, I aggressively represent my clients' interests at trial.

Personal Interests:

I like spending time with my wife and three children. I also enjoy golf, broomball, and Badger Football.

Typical Retainer

The amount of required advance depends on the facts and nature of the case. A typical deposit is $3,500, however, the deposit range is usually between $1,500 to $5,000. Additional deposits may be required as the case progresses. If a potential client is in a bind financially and does not have funds readily available, I have on occasion agreed to divide up the initial required deposit into installment payments.

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
