Continuing Education

Annually, I consistently exceed the number of required Continuing Legal Education hours through individual continuing legal education experiences and through regular attendance at Denver Estate Planning Council seminars. I ensure that my advisement and counsel are current by also enlisting the services of several specialized on line newsletters. I also periodically teach Continuing Legal Education seminars on ethics, estate planning and representing the buyer in business sale transactions.

Current cases of interest include: Contesting a Guardianship and Conservatorship of a highly independent business person, advising a family whose parent will require more advanced, intensive support and care than anyone had anticipated, planning with a family for the future needs of their developmentally challenged child, and administering an estate of a self-made entrepreneur here in the Denver metro area.

Firm Focus and History

Horen, Lockwood & Masters, LLP began as an estate and business planning focused firm as Schmidt & Horen in 1993 in downtown Denver. As we have added new partners and new areas of service, we have also relocated to the Southern Metropolitan Denver/Northern Douglas County area, allowing easier access for our clients.

We believe that every person's life is his or her own journey, which occasionally requires the support and counsel of experienced, visionary experts. Accordingly, our firm is dedicated to helping individuals and families plan for the future, protect their hard earned assets, and administer the estates of loved ones. We work with families in Guardianship and Conservatorship actions as part of the overall process of planning for and responding to the intermediate stages of one's journey. We also collaborate with business clients in helping their businesses grow and develop.

Estate Planning:

I assist clients in formalizing their dreams, goals, and plans for passing their legacies to their families by creating estate plans that are customized specifically to each client's needs. With forty years of expertise in this area, I listen to clients' concerns, educate and counsel them as to the most effective and efficient ways to meet those needs and collaboratively create the documentation which seeks to implement those plans well into the future. I believe every person is here to follow his or her own journey and I am available to assist with the best counsel I can provide.

Probate/Estate Administration

Our estate administration and probate clients span a wide range of people and backgrounds from extensive estates to relatively simple matters. In each situation I rely upon my continuing education and expertise to guide clients through the challenges of economically, effectively honoring the wishes of their loved one. The highest accolade I can receive is to hear that the wishes of their family member were honored.

Business Formation and Transactions

I work with our business clients to select the correct type of entity for pursuing their business dream, and create documentation formalizing and guiding that entity so that the structures we create serve our clients, many of whom are entrepreneurs, in the best possible way. I truly enjoy assisting our business clients with matters varying from contract negotiations to exit planning with a range of planning and transactions in between.

I have always focused on the people issues of estate and business planning, business transactions and estate administration. Over the past 40 years, my practice has brought me tremendous opportunities to hone my skills in these areas while adding expertise in Guardianships and Conservatorships.

Activities and Awards

I have personally received the AV-Rating for High Professional Legal Standards & Ethics from Martindale Hubbell for over twenty years, including 2009. In 1994 I earned the designation of Accredited Estate Planner from the National Association of Estate Planning Councils. As Schmidt & Horen, LLP our firm was AV-Rated for High Professional Legal Standards and Ethics from 2002-2008 by Martindale Hubbell. Horen, Lockwood & Masters was AV-Rated for High Professional Legal Standards and Ethics for 2009 by Martindale Hubbell. In 2007 and 2009 I received accolades as a "Super Lawyer" from Law and Politics Magazine and 5280 Magazine as being in the top 5% of lawyers in Colorado. In 2009 I received the accolade of "Best Client Satisfaction - Wealth Management" from 5280 Magazine and Colorado Biz Magazine. Further, I have received recognition for my extensive Pro Bono work from the Colorado Bar Association.

What is your opinion regarding clients educating themselves on legal issues?

I have always valued and respected those who plan ahead and seek to leave a legacy for the future. This now means researching what documentation is available online and from various resources. I am delighted when clients have done this kind of thinking and preparation because they are better prepared to see the implications of various types of estate planning.

Are you willing to review documents prepared by clients?

I am always happy to work with clients who have initiated legal work on their own. We often work with families who started an estate administration, for example and, in spite of their dedication found details, such as tax implications or filing requirements, a bit daunting. Our firm is happy to step in under these circumstances.

Are you willing to coach clients who want to represent themselves?

While the courts here in Colorado have certainly worked to make self-representation a reachable goal, for many that remains outside their interests or expertise. I am always happy to step in to these situations as well. Further, we collaborate very openly with clients, their support networks and existing counsel, often adding a degree of expertise or insight which may not always be immediately apparent.

Why did you decide to be a lawyer?

I have always admired and respected people with vision and determination who decide to make a difference in the world around them, be it for their families, their communities, or their country. Accordingly, I was drawn to the law and to estate and business planning and administration as a field of practice, knowing I could lend key assistance to these visionaries seeking to move from success to significance. It is one of my greatest honors to have been able to work with people with this mindset and attitude for the 40 years I have practiced law.

What work experience and education helps you be a better lawyer?

I am extremely active in my community, including past service as a Scoutmaster, member for six years and president for three years of the St. Thomas More Parish Finance and Administration Committee, and numerous fund raising activities supporting organizations such as The Denver Symphony, St. Mary's Academy, Regis Jesuit High School, The Little Sisters of the Poor and the Universities of Colorado and Denver. I am currently active in: Marked Men for Christ; Highlands Lodge, #86, A. F. & A. M.; Denver Consistory Scottish Rite (33°, past presiding officer and currently an Executive Committee member) and York Rite Bodies; El Jebel Shrine and the Royal Order of Scotland. These varied activities bring me into constant contact with a wide range of people with extensive backgrounds of their own. My friendships with such a range of people help me better understand a variety of perspectives and contribute to my being able to flexibly solve problems.

Why did you decide on your primary area of practice?

Personal family experiences and an awareness of my own desires to build close working relationships with families over time really helped me to choose estate and business planning and administration as my niche. Seeing in my own life and that of my family the difference that good planning makes had a strong impact on my choice of practice areas. I also knew that, once I started working with clients, I was excited to see how their visions of the future developed and evolved over time.

What do you like best about your career?

Clients come to me at many different times of their lives needing assistance, guidance, or support. I love growing along with our clients and seeing how their plans come to benefit future generations while also giving the visionaries incredible piece of mind.

Tell us about your law firm:

Our practice consists of five other attorneys upon whom I may call for their unique expertise, and our paralegal support staff which is well attuned to the needs and desires of our clients and myself. This range of skills within a consistent mindset of service and meeting the needs of the individual allows us to provide tremendous service for each client.

What are your strengths and style?

I am a committed listener and always take time to fully comprehend situations before offering suggestions or expertise. I am steadfastly loyal to our clients and will do whatever is appropriate to be of assistance. Perseverance is one of our firm's strongly held beliefs in that we stay with our clients and do not abandon them when issues become heated. Finally, my experience helps me to understand that the best planning incorporates events that might never have been foreseen but that happen.

Fixed-Price Services and Fees

We work with clients on both a fixed-price basis and an hourly rate basis depending on the complexities of the matter. I also delegate many tasks which other attorneys do themselves to our well-trained staff of associates and paralegals, often reducing costs dramatically.

Hourly Rates

$275 for my time, $175 for associates' time, and $95 for paralegal's time.

Free Initial Consultation?

I always enjoy meeting with clients for up to an hour at no cost for an initial consultation. This allows us to get to know each other, understand what has been done and what needs to be done. I typically conclude these consultations with a bid for the word that needs to be done.

Typical Retainer

I typically request a retainer which is commensurate with the time devoted to the matter and the complexity of the issues. My request for a retainer is also a vehicle by which the client demonstrates that they are as committed as we are to completing the project.

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
