McCunn and McCunn, LLP was started in 2007. We are a father and son team combining 37 years of estate planning experience and 12 years of business management experience.

What is your opinion regarding clients educating themselves on legal issues?

Educated clients focus on the project before them and have a clear list of objectives. This makes it so much easier to advise and provide targeted, affordable services that deliver specific results.

Educated clients take their legal issues seriously, recognizing the law rarely gives second chances. They identify specific issues to resolve, prepare proactively, follow court procedures, and take personal ownership in solving relationship issues. Educated clients use litigation as a necessary tool for resolving serious areas of risk and conflict, not a means of paying back what has been forwarded onto them.

Are you willing to review documents prepared by clients?

Absolutely. If you cannot afford an attorney, definitely call for a document review to ensure that you will not damage your rights with poor paperwork. Legal documents and judicial council forms must be drafted properly to ensure that the court will address your critical issues. Nothing frustrates the court quicker than poorly drafted documents or an attempt to raise issues not first presented via the proper documentation. Improper documents can lead to lost rights and needless expense.

Are you willing to coach clients who want to represent themselves?

Yes. We provide each client with a written letter outlining how to respond to the procedure they will face at court. We provide training, including the use of outside experts, outlines of the case issues with the appropriate facts and law, and can even do a "dry-run" in our office. We prepare our clients so that they are ready for their court appearance and don't need to come up with answers on the fly.

Why did you decide to be a lawyer?

I decided to become an attorney to have closer contact with people. After years of negotiating contracts, advising businesses and finally going through a divorce, I saw the personal and professional value in being an attorney who could understand clients' needs and translate legal and technical terms, while keeping services affordable.

What work experience and education helps you be a better lawyer?

My work experience negotiating and settling large contracts with Silicon Valley businesses such as Hewlett-Packard and Cisco honed my skill for settling tough issues. These management skills allow for strong control over even the toughest cases while tracking specific objectives like financial budgets. Further, the experience of working with many people on complex matters helped me develop strong relationship management skills, which enable me to defuse tough issues while remaining focused on end results.

Why did you decide on your primary area of practice?

The areas of estate planning, family law and business law have a common core goal: provisions for managing your personal and financial circumstances through all the vicissitudes of life, including emergency, incapacity and death. It provides me great personal joy to use my life experiences, financial planning and personal skills to help a family through such circumstances.
