Continuing Education

I attend continuing legal education seminars on the topics of estate planning, elder law, general litigation, and contract drafting. I also teach continuing legal education seminars on international law. I exceed the amount of continuing education hours through home study.

Example Cases

I handled a guardianship case in which the wife, who had nominated herself as guardian, passed away shortly before the hearing. Thus, I worked with the family and friends to determine an alternate guardian and separate conservator.

I often deal with couples who own large portions of land, usually farm or ranch land. They are concerned with protecting as much of their assets as possible for their heirs while maintaining the ability to meet their needs going forward during retirement. This often results in one or more trusts being set up and gifting schemes designed to maximize the couple's exemption limits under existing and foreseeable gift and estate tax laws.

Firm Focus and History

Too many attorneys generalize their clients' estate planning needs; I focus on the individual needs of my clients, using the various types of trusts that are available to maximize my clients' ability to avoid or defer taxes, whether it be income, gift, or estate tax. At the end of our engagement, I expect my clients to have a clear view of the ways in which their assets are being protected for them or for their heirs.

Previous Employment Summary

I practiced in Lewiston, Idaho (June, 2006 to December, 2007) with the firm Creason, Moore & Dokken PLLC. I concentrated there on estate planning, tax law, and general transactional work. I then worked with Banducci Woodard Schwartzman PLLC in Boise, ID from January, 2008 to October, 2008 as an associate attorney in complex commercial litigation.

What is your opinion regarding clients educating themselves on legal issues?

The clients who come to me with a foreknowledge of at least the basics of estate planning or other areas of law that I practice are the most enjoyable to represent. I find that they are the clients who are usually willing to listen to, and incorporate, my suggestions for a sound estate plan. This is so, because they understand the principles upon which I base my suggestions. That said, I am very careful to ensure that all of my clients understand everything that I do for them.

Are you willing to review documents prepared by clients?

I am willing to review documents prepared by clients, but charge my normal hourly rate for this service.

Are you willing to coach clients who want to represent themselves?

Because of the nature of my practice, I do not coach my clients beyond review of documents that they have produced. I am willing to meet with clients and review any estate planning strategy that they have compiled on their own, but will charge my normal hourly rate for this service.

Why did you decide to be a lawyer?

I have always been a "people person". I enjoy seeing the resolution of a problem. This is probably why I am drawn to this area of law. A good estate planning and transactional attorney should have the goal of keeping clients out of court if possible.

What work experience and education helps you be a better lawyer?

I worked for several years as a land surveyor. Due to my knowledge of boundary and title issues, I am able to approach estate planning for those possessing real property with certain insight not available to others. I received a superior legal education at Duke and had the opportunity to study international law intensively, which has allowed for a more complete analysis of the law, both domestically and internationally. As a former soldier in the Utah Army National Guard, I am especially sensitive to the needs of those who serve, and have served, in the armed forces of the United States.

Why did you decide on your primary area of practice?

I am drawn to problem solving, not problem creating. I do not thrive on contention. Because of this, I decided to engage in an area of law that facilitates greater harmony between persons, whereas litigation and other areas of the law have the capacity to exploit contention.

What do you like best about your career?

As a solo practitioner, I am able to look at accepting cases and/or matters that a firm would not consider from a business standpoint. I also have the ability to perform as much pro bono work as I feel that I should offer. Because of this, I have devoted my time to helping such organizations as Kuna Youth Softball and Baseball Association and the Kuna Kiwanis Club. This overall freedom allows me to give a more "human" perspective to my practice of the law.

Tell us about your law firm:

I am a solo practitioner, so all of my clients deal directly with me.

What are your strengths and style?

I am very conversational with my clients. I have a tendency to develop friendships with my clients, which results in greater care for their welfare. I am often presented with clients who may themselves have physical or mental challenges or have relatives, for whom they are seeking help, with such challenges. I believe that I have the ability to connect with those persons through compassionate treatment. Beyond this, I review my work numerous times to ensure that it is accurate and complete.

Personal Interests:

I read extensively regarding American colonial history. I then use this knowledge to re-enact the colonial era.

I also fish extensively and enjoy the occasional game of golf.

Most of these activities include my wife and my children, whom I love dearly. I am very actively involved in family activities and in service to the young men (ages 12-18) in my church. I have been involved in Boy Scouting for many years.

The majority of my estate planning services are offered as a flat fee based on the needs of the client. More complicated estate plans may be billed at my hourly rate. Please contact for more information.

Free Initial Consultation?

I provide up to one half-hour free consultation. I will consult with my clients and determine what may be necessary in their estate plans. Then I generally quote a flat fee for estate planning services. In the event that more extensive services are required than can be quoted in a flat fee, I request a retainer based on the expected services to be rendered and charge my normal hourly rate.

Typical Retainer

The retainer varies according to the service offered. For flat-fee service (I generally try to reduce my fees to a flat fee), I expect payment in full up-front, which I will keep in my Lawyers Trust Account until completion of service.

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.
