Firm Focus and History

I left a good job as an associate at a boutique law firm in 1992 and started my law office that year in the District of Columbia. I moved to Salt Lake City, Utah in 1995, continued with my practice in Salt Lake City, Utah and surrounding areas along the Wasatch Front. I began handling consumer bankruptcy issues here in the Northern Utah area in 1995.

I have more than 20 years of experience as an attorney. My focus in bankruptcy matters is to help you pursue, where necessary, protection under either Chapter 7 or Chapter 13, as one way to help you relieve the stress of being unable to make ends meet and stop creditor harassment.

After graduating from The University of Michigan Law School in 1986, I worked as an associate attorney at larger, well-established law firms and then worked at a small boutique firm in the District of Columbia.

What is your opinion regarding clients educating themselves on legal issues?

I believe that a client who educates himself or herself with good information from reputable sources, like Nolo's publications on bankruptcy, will help the process and help us to our job more efficiently and effectively.

Are you willing to review documents prepared by clients?

I do not offer that service. In the case of a bankruptcy client whom I represent, I believe that it is important to be involved in the entire process in order to obtain and report information that is required under the Bankruptcy Code in the best and most appropriate way possible.

Are you willing to coach clients who want to represent themselves?

I also do not offer that service and for the same reasons that I do not review documents prepared by client.

Why did you decide to be a lawyer?

I believed, and continue to believe, that a lawyer can help other people get through their problems and resolve them through the proper legal process. In the case of bankruptcy, that means getting through the current stressful situation and moving on with their lives without the constant worry of a mountain of debt and persistent badgering by creditors.

What work experience and education helps you be a better lawyer?

For the past 20 years, I have been practicing in a variety of substantative areas, including bankruptcy, civil litigation, and criminal defense. All of that experience allows me to look at a client's financial problems through a number of different lenses, with an eye toward resolving them in the best possible way. In addition to bankruptcy, I can handle adversary proceedings, pursue lawsuits under the Fair Debt Collections Practices Act when a creditor oversteps the law, and defend against lawsuits filed outside of the United States Bankruptcy Court.

Why did you decide on your primary area of practice?

My areas of practice allow me to think about problems and help people work through them and solve them through whatever means are necessary and appropriate in a given situation.

What do you like best about your career?

I am able to apply a wealth of training and experience in helping individuals get past their current financial difficulties and the anxiety, stress and even depression that can go along with them.

Tell us about your law firm:

I am a solo practitioner and all of my clients deal directly with me. I communicate with my clients directly and prepare all filings personally. In doing so, I treat people as individuals, not as a commodity or another sale in a pipeline of bankruptcy or other cases.

What are your strengths and style?

I am involved in client's case from the first phone call, to the initial consultation, to the final resolution. I know what we need to do and I handle all responsibilities of getting the work done personally. My clients are able to communicate with me directly and can reach me at my office, at my home office, on my cell phone or through email. I return client communications promptly.

Personal Interests:

I enjoy participating in athletic events that challenge my body and will. For example, I enjoy participating in triathlons (completing the 2008 Silverman Full Distance Triathlon; 2008 Ironman Coeur d'Alene; 2008 (Spring) Ironman Arizona; 2007 Silverman Full Distance Triathlon; 2007 Ironman Coeur d'Alene; 2007 Ironman Arizona; 2006 Silverman Full Distance Triathlon). My wife and I completed the Logan to Jackson ("LOTOJA") bicycle race as a relay in 2008. I also enjoy trail running (completing the 2005 Squaw Peak 50 Mile Trail Run; 2004 Squaw Peak 50 Mile Trail Run; 2003 Wasatch Front 100 Mile Endurance Run; 2003 Squaw Peak 50 Mile Train Run; 2002 Wasatch Front 100 Mile Endurance Run; and 2002 Squaw Peak 50 Mile Trail Run).

Fixed-Price Services and Fees

I typically charge a fixed fee in bankruptcy matters. My fee depends on the complexity of the case. In Chapter 7 cases, there is a filing fee of $299 charged by the Court and my fee typically starts at $1,200. In Chapter 13 cases, there is a filing fee of $274 charged by the Court and my fee typically starts at $2,750. Fees in every case, however, are determined individually.

Hourly Rates

Where appropriate, as in adversary proceedings, I may offer an hourly rate. My normal hourly rate is $250 per hour.

Free Initial Consultation?

I offer a free initial consultation for one hour.

Typical Retainer

I typically require a flat fee in advance. In cases in which I require an advance against fees and costs, it will depend on the complexity of the case.

Understanding Fees

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
