Example Cases

The typical bankruptcy case requires an appointment to educate the client about the pros and cons of filing bankruptcy based on what they own and what they owe. I never pressure clients to file and will simply provide information to help them make an informed decision. Filing either a chapter 7 or Chapter 13 bankruptcy generally requires one appearance in front of the bankruptcy trustee who examines the petition and client under oath. Sometimes an appearance in Federal Bankruptcy court is required. The typical Chapter 7 case is usually closed in under 6 months and the typical Chapter 13 case lasts three to five years. I always let the client know my full expectations for any case regardless of whether it involves bankruptcy, family law, criminal law or another area.

We also handle family law matters including simple divorce, separation agreements, property division, child custody and support, and spousal support. A simple divorce can often be accomplished without a court appearance. Custody, property division, and support issues often require several court appearances.

Activities and Awards

Before joining the Law Offices of John T. Burns, I was a summer associate with Maloney & Meier, a criminal practice in Charlotte, NC, and the District Attorney's Office in Charlotte, NC. During law school, I had the opportunity to handle trials for the District Attorney's Office in Winston-Salem, NC, and intern for White & Crumpler, a leading law firm in Winston Salem, NC. Also, while at Wake Forest School at Law, I served as a research assistant for Judge James J. Brown. Since joining the Law Offices of John T. Burns, my practice consists of bankruptcy, family law, criminal law and general civil litigation.

What is your opinion regarding clients educating themselves on legal issues?

I encourage clients to educate themselves and to ask any questions they may have of an attorney.

Are you willing to review documents prepared by clients?

I will review anything a client has prepared.

Are you willing to coach clients who want to represent themselves?

I often encourage clients to file matters in small claims court because there is an absolute right to appeal most decisions. However, I have never counseled a client to undertake a bankruptcy or complex family law case without an attorney.

Why did you decide to be a lawyer?

Going to law school was a great way to spend more time in an academic environment, and I knew a law degree could be used in many ways.

What work experience and education helps you be a better lawyer?

As a general practitioner. I can help my clients with most of their legal matters. Often, my family law clients ask about bankruptcy or drafting a will, or a traffic ticket their son has. Our firm handles bankruptcy, divorce, criminal law, wills, power of attorney, and litigation.

Why did you decide on your primary area of practice?

Most of my time is spent on bankruptcy, divorce and criminal law. Each area of law allows me to help people get their life back in order.

What do you like best about your career?

I enjoy the variety of being a full-service law firm. Some days, I am on the computer while other days, I am in court. I also get to meet and help people solve whatever issues have brought them to my office.

Tell us about your law firm:

Our office consists of two attorneys and three support staff who are experienced and helpful.

What are your strengths and style?

I find it is best to let the client tell me the whole story before interrupting and giving advice. A full-service law firm also allows me to focus my caseload depending on the market conditions.

Personal Interests:

I enjoy keeping active in the gym and by running. I also enjoy watching and attending Carolina Panther games and rooting for UNC and Wake Forest basketball.
