Example Cases

Defendant doctor unnecessarily removed the ovaries of a 29 year old woman, which later caused the need for an emergency hysterectomy. During the hysterectomy, the doctor sliced into the woman's bladder several times, requiring extensive surgeries to repair it. The doctor had a criminal record which had led California's medical licensing board to impose probation of his license to practice medicine. Nonetheless, the medical group and the HMO kept the doctor on their list of "preferred" providers. Plaintiffs sued the doctor for the two negligent surgeries and the medical group and the HMO for keeping the doctor on their list of providers.

Defendant's employee made an illegal lane change on the freeway propelling the plaintiff from the highway and causing her car to roll. As a result of the collision, plaintiff suffered eight left rib fractures, an open left humerus fracture with a degloving injury of the left forearm and elbow, a left clavicle fracture, left zygomatic complex fractures with a left orbital wall fracture, left temporal bone fractures, and left seventh nerve palsy.

Norman Doe was walking in a marked crosswalk when a tow truck driver struck him. He suffered head trauma, pelvic fractures, a broken wrist, and broken ribs. Norman Doe had to spend three weeks in a hospital to recuperate. The head injuries impaired his sense of smell and taste as well as his ability to concentrate and to control his emotions.

Mr. Doe (deceased) approached his neighbor and started a heated argument over a parking spot. The argument escalated and the neighbor punched Mr. Doe, who fell and struck his head against the concrete sidewalk. Mr. Doe sustained fatal injuries from the head trauma. After filing a lawsuit, Mrs. Doe recovered the policy limits of the neighbor's homeowner's insurance policy.

The plaintiff lived in defendant's apartment complex in a first floor apartment with a sliding glass door that led from the apartment to her patio which was separated from the parking lot by a wooden gate. Because the plaintiff did not own a car, she seldom used the sliding door to access the parking lot and she rarely walked from her patio into the parking lot at night. One night, the plaintiff walked out of her sliding glass door toward the parking lot. None of the three lights that should have illuminated the parking lot were lit. Plaintiff tripped over a parking beam and suffered a dislocated knee, fractured femur, ligamental knee disruption, and sensory loss on the top of her foot.

What is your opinion regarding clients educating themselves on legal issues?

I think that there are many areas where it is more efficient and a client will get a better result if they are able to educate themselves. I also think that there is a danger that something may be missed in particular circumstances if clients attempt to handle all aspects of a claim on their own. For years, we have referred people who call us with simple matters to Nolo Press.

Are you willing to review documents prepared by clients?

Our firm works on a contingency basis. Therefore, we prefer to prepare documents on our own. It costs the client nothing extra and assures that the job is done to the highest standards.

Are you willing to coach clients who want to represent themselves?

We have given people who call in some advice on the best course of action when we are not representing them. Often, we have referred them to Nolo Press. However, we are not interested in coaching clients over time.

Why did you decide to be a lawyer?

I pride myself on standing up for individuals against companies, corporations, and others who hesitate or refuse to take responsibility for their actions. I was inspired to go to law school by my father, who founded our firm.

What work experience and education helps you be a better lawyer?

I became a lawyer in 1994. Ever since, I have exclusively represented people who have been injured or wronged. I represent plaintiffs in general civil litigation matters arising out of car accidents, trip and fall accidents, defective products, medical malpractice, and construction cases. My emphasis is on serious personal injury cases.

Why did you decide on your primary area of practice?

It is important to me to obtain justice for the "little guy."

What do you like best about your career?

The best thing about my career is making a difference in people's lives. We are often the difference between someone living disabled and in poverty and living disabled in relative comfort.

Tell us about your law firm:

Along with Barry, Molly Harrington is my law partner. She is an excellent attorney, a smart woman, and a mom. We make a very good team. Our associate is Jim Yu. He is very smart and a very hard worker. Our office staff includes a paralegal, who has worked with Barry Balamuth for over 23 years, a secretary who has worked Barry for nearly 30 years, another secretary with the firm since 1999 and a part-time office assistant. We pride ourselves on being friendly, patient, and competent.

What are your strengths and style?

Compassion, the ability to listen, the ability to combine assertiveness with civility, an innate sense of justice and a willingness to go to the mat for 'the little guy.'
