Papers and Publications

I was interviewed by the Columbus Dispatch for three articles in 2008. The first article was about the increase in seniors filing bankruptcy, which ran in July. The second topic involved 18 to 34 year-olds starting life in debt, which ran in the first part of August, and the third article covered my perspective on the loan modifications by Countrywide Mortgage.

Example Cases

In cases I've handled, I've dealt with motions by the government to force my clients into repayment plan Chapter 13, instead of a fresh start Chapter 7, which is what they were seeking. The government was never successful in forcing any of my clients to convert their case from a Chapter 7 to a Chapter 13. I stand up to the government based on my work and analysis.

Firm Focus and History

My firm is dedicated to helping people in financial distress. I take pride in allowing my clients to keep their dignity and self-respect during tough economic situations. We give personal service to all of our clients. At my firm, all clients meet with an attorney, not a paralegal.

I have been at the same location since 1992 and I have been practicing bankruptcy law since then. I have filed thousands of cases in my career as a lifelong Columbus, Ohio, resident.

At trial, I influenced the way that bankruptcy is practiced under the new law. I influenced the way the new government mandated "means test" was calculated. Specifically, the issue was commonly referred to as "the surrender issue." The government was arguing that if a house or car was being surrendered, the monthly payments for those debts should not be included in the calculation. This would have caused almost all cases with surrendered property to be Chapter 13 reorganizations instead of Chapter 7 liquidation, and a fresh start. It was a case of first impression in this Jurisdiction. The Court ruled in my favor by allowing those deductions, hence paving the way for a fresh start under Chapter 7 (In re Graham, Judge Preston, March of 2007).

I am one of very few attorneys to take on the government and win. I did not charge my clients anything for the trial because taking it to trial was only the right thing to do.

What is your opinion regarding clients educating themselves on legal issues?

I have links within my website to help people get a snapshot of the bankruptcy
process. Because it is so complex, I always give free consultations in person.

Are you willing to review documents prepared by clients?

This is not applicable to my practice.

Are you willing to coach clients who want to represent themselves?

I believe that with bankruptcy, it is almost impossible for people to represent themselves. The details to file are very complex and time sensitive.

Why did you decide to be a lawyer?

From a very young age, I knew I wanted to be a lawyer. I was heavily influenced by my cousins since they are all lawyers. My family has seven lawyers, two of which were former U.S. District Attorneys in Manhattan.

What work experience and education helps you be a better lawyer?

Being a product of Columbus City Schools has influenced how I relate to my clients.
I was raised on the eastside of Columbus and relate well to a diverse spectrum of the
population. Having worked in low income neighborhoods for a nonprofit organization, I truly have a feeling for what the people having tough economic problems feel and what they need.

Why did you decide on your primary area of practice?

I believe that our economic system is broken and that the banks and credit cards are prompting people to amass excessive debt. I am trying to break this cycle by educating and counseling my clients about whether they should file for bankruptcy or not.

What do you like best about your career?

I enjoy watching my clients walk out of my office with hope and helping them to sleep at night. When people walk through my door, they are scared, worried, and stressed. When they leave, almost all of them feel much better than when they walked in.

Tell us about your law firm:

Eden Sarver Esq. and I have worked together for five years. She took a two year sabbatical from my office to clerk for Judge Calhoun, the Senior Bankruptcy Judge. After her two year clerkship with Judge Calhoun, she came back to my office. Eden is one of the few, if not only, former judicial law clerks, in private practice under the new law.

What are your strengths and style?

I am a straight shooter. I will never paint a rose only to have it wilt. My honesty in business dealings is my strength. My clients may not always like the analysis of their case, but appreciate my honesty. I meet face-to-face with all of my clients.

Personal Interests:

I have been doing triathlons since the mid-1980s. I like to cycle, swim and have been boxing for 25 years. I have two teenage boys and coached soccer when they were younger. I still enjoy watching their high school soccer games. I am also an avid Ohio State sports fan.

Fixed-Price Services and Fees

For a consumer Chapter 7, the range is from $750 to $1,500.
For small businesses, the range is from $1,000 to $5,000. These are flat fees for all work. I don't nickel and dime my clients. The fee quoted is the fee paid with no hidden fees. Some attorneys charge for reaffirmation agreements in a Chapter 7. My fee is for the whole case not just parts.

$200 per hour for post confirmation Chapter 13 work.
