The continuing legal education seminars I have attended focus on the field of bankruptcy law. I attend seminars sponsored by the American Bankruptcy Institute and the National Association of Consumer Bankruptcy Attorneys. Since I have been Board Certified in Consumer Bankruptcy Law by the American Board of Certification, I am required to take coursework exceeding the state minimum requirements for continuing legal education. I have also lectured on legal topics in bankruptcy law.

Example Cases

At the Sader Law Firm, we regularly file Chapter 7 and 13 cases very quickly in an effort to stop a foreclosure or end a garnishment (see our Frequently Asked Questions). If a client is prepared and helps us obtain the information necessary, we can file cases on very short notice, even on the same day, if needed. We have also worked with clients who own or operate small businesses such as restaurants, retail stores or who may own apartment units and need to either restructure or close the business. Through the bankruptcy system, we can assist clients with the details of closing a business, dealing with creditors (including the IRS) and discharging the debts so that the individual owners can move on to other opportunities.

Firm Focus and History

The firm began in 1997 when its founders desired to start a practice of law focused on individuals, not just companies. The firm's goal was to allow its attorneys to provide top quality work while working directly with their clients. The firm's focus has remained on working with individuals and small businesses to help them alleviate financial problems. To date, the Sader Law Firm has represented thousands of individuals and small businesses in the Kansas City area and in the outlying areas of Missouri and Kansas.

Our attorneys maintain a significant bankruptcy practice. We focus on the needs of individuals and small businesses in Chapters 7 and 13 and routinely help clients avoid foreclosures, stop garnishments and end harassing treatment from creditors. As a small firm, we pride ourselves on our personal relationships with our clients. At the Sader Law Firm, clients deal with their attorneys directly and not through administrative staff. We generally provide our services on a flat fee basis (see our Fee Schedule) and all initial phone conferences are free.

Previous Employment Summary

I began my legal career in 1984 with a small, general practice firm in downtown Kansas City, Missouri. My experience with the firm allowed me the opportunity to gain courtroom and litigation experience in a significant way and with many different types of cases. After two years, in 1986, I joined a larger firm where I began the firm's bankruptcy practice. I developed an extensive Chapter 7, 11 and 13 practice on behalf of debtors and creditors.

What is your opinion regarding clients educating themselves on legal issues?

I encourage clients to take the time to educate themselves on legal issues. However, I also caution clients to avoid getting their bankruptcy information "off the streets." The laws changed drastically in 2005 and information from those who filed under the old law may be inaccurate now. The same is true for obtaining information from old books or articles. Clients need to educate themselves, but need to make sure the information they obtain is from a reputable and knowledgeable source. At the Sader Law Firm, we have prepared a list of Frequently Asked Questions for those considering bankruptcy.

Are you willing to review documents prepared by clients?

I prefer clients fill out a set of forms that I have prepared that ask, in plain English, for all the information needed to fill out the required bankruptcy court forms. These forms correspond closely to the actual forms and allow me to evaluate a case quickly and accurately.

Are you willing to coach clients who want to represent themselves?

I am not willing to provide advice to those who want to represent themselves. Given the complexity of bankruptcy law, the potential for a misunderstanding is too great.

Why did you decide to be a lawyer?

I enjoy meeting all types of people and solving problems. The ability to use the courts to help those in need is very satisfying.

What work experience and education helps you be a better lawyer?

While working these last 20+ years as an attorney, I have also been privileged to serve as a local city councilmember in my city. I have had the chance to deal with all types of people and issues. Through that experience as well as practicing law, I have been given the tools to find solutions for people, whether through the resources of a city government or the courts. I know how to listen to people and enjoy helping solve their problems so that they can go on to do what they really want to do. I try to make the law work around my clients' lives to help them achieve their goals. I also try to do things simply, quickly and with a minimum of red tape. After all, making things unnecessarily difficult does not help anyone.

Why did you decide on your primary area of practice?

My bankruptcy practice has given me the satisfaction of helping many individuals, couples and families solve serious personal problems caused by financial issues. I like to think I have helped many marriages and kept families together by helping them deal with, and often times get rid of, their financial problems. The ability I have to help clients get rid of stress, worry, anxiety and fear is very satisfying and rewarding.

What do you like best about your career?

I enjoy the ability to use the power of the law in a positive way to help my clients. I also appreciate the trust people place in me as their attorney and enjoy using that trust to counsel them in regard to solving their financial problems and informing them about the opportunities available to them in the future.

Tell us about your law firm:

All of the attorneys at the Sader Law Firm dedicate a significant portion of their practice to consumer and small business bankruptcy issues. Since all of our attorneys deal personally and directly with our clients, each one knows the importance of listening to our clients and trying to answer questions simply and accurately.

Our administrative staff is courteous and knowledgeable and can answer most routine questions. Our Office Manager, Connie Montemayor, supervises the office staff and has worked on bankruptcy matters for over 20 years. She has tremendous familiarity with the bankruptcy forms and requirements, documents needed, and electronic case filing - which is how all cases in Missouri and Kansas are filed. Since so much of our practice is focused on consumer and small business bankruptcy, all of our staff members are familiar with the problems and questions clients may have.

What are your strengths and style?

I am able to evaluate a client's situation by reviewing the financial numbers and listening to a client describe what he or she wants to accomplish, and determine quickly what is the best course of action. Sometimes I may counsel clients to file a bankruptcy or close a business and other times I may suggest to fight it out. As I like to tell my clients: "I can have two clients in front of me with the exact same financial problems, but what may be right for one may not be right for the other." I have an ability to help clients move forward and make decisions that are in their individual best interest - I enjoy helping them reach those often difficult decisions.

Personal Interests:

My wife and I have three children aged 18, 16 and 12 and a large extended family in the Kansas City area. In between driving to and attending games, concerts, practices and family events, I enjoy being involved in community affairs and politics and consider myself somewhat of a political junkie. I also enjoy the Chiefs, Royals and KU sports as well as Kansas City Bar-b-que!

Fixed-Price Services and Fees

Yes, at the Sader Law Firm, we have flat fees for many of our services (please see our Fee Schedule for more information). For an uncontested Chapter 7, whether for an individual or a couple, there is a flat fee of $1,500 plus court costs and credit counseling fees - which total $403. For a Chapter 13, the case can be filed for as low as $295 plus court costs and credit counseling fees - which total $378. We do charge a total of $3,000 for a Chapter 13; however, the balance after the initial payment of $295 can be paid through the client's payments to the Chapter 13 Trustee. We do reserve the right to alter the Fee Schedule for complex cases, however, written retainer agreements are used in all cases and clearly state the fees charged.

Free Initial Consultation?

Yes, we offer free phone consultations. These phone consultations offer an opportunity to evaluate whether a bankruptcy would be helpful in a particular case. If a client prefers, initial in-office consultations are $200 and are unlimited in time.

Typical Retainer

To open a file, an in-office meeting is required. There is a $200 initial payment required at any such meeting.

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
