Example Cases

Our estate planning practice encompasses a wide variety of family and economic situations: single individuals, married couples young and old, same sex couples, second marriages, people facing retirement, grandparents, people for whom complex estate and asset protection planning is beneficial and others whose estates are quite limited.

We assist families with disabled children who require legal guidance and counseling at several intervals in life: when the children reach the age of majority and the parent(s) seek appointment as legal guardian(s); when assets must be protected, in supplemental needs and special needs trusts, so as not to interfere with governmental benefits and entitlements; and when the parent's age and need to arrange for the future advocacy and care for their child.

We do Medicaid planning and prepare Medicaid applications. We design and help form strategies for individuals and families to protect and preserve the maximum portion of their assets before qualifying for Medicaid benefits.

We represent our clients in securing guardianship for ill and incapacitated loved ones and assist the guardian in the preparation and filing of reports and annual accountings.

On the litigation front, we represent executors in probate proceedings, administration proceedings, and trustees, working to ensure that the decedent's intent is carried out. We represent fiduciaries against whom claims have been made for improper conduct in the administration of an estate or trust and bring actions against executors, administrators and trustees who have acted improperly.

Larry and I have each been admitted to practice for more than 25 years. We are both seasoned litigators and practitioners who combined our separate practices to form Berwitz & DiTata LLP in 2000, dedicated to the practice of what we call "Preventative Law," helping clients avoid the mistakes that waste wealth and diminish dignity.

The law firm of Berwitz & DiTata LLP is uniquely qualified to help solve problems relating to estate, retirement distribution and Medicaid planning, probate and estate administration and elder law. Our senior partners, Lawrence N. Berwitz and I, are seasoned counselors and litigators, and we devote our practice to:

Previous Employment Summary

Having practiced law for almost thirty years, I am still proud to say that my first job out of law school was as an Assistant District Attorney in New York County (Manhattan), one of the largest and most prestigious prosecutors' offices in the country. After fulfilling my commitment and completing that service, I moved into private practice at a small New York City based firm and worked my way from associate attorney to partner. I left that firm, with one of my partners, to join a much larger firm. It was only after I really understood "big firm" economics that I realized that the kind of work that I enjoy most is the one-on-one interaction with my clients that can be best achieved in a small and, therefore, more intimate legal environment.

Activities and Awards

I belong to the National Academy of Elder Law Attorneys, the American Business Women's Association, the Mineola-Garden City Rotary, and the Garden City Assembly, and serve on the Community Advisory Board of The Amsterdam at Harborside, a life care community which is planned for construction in Port Washington, New York, the first of its kind in Nassau County. I am a member of the New York State Bar Association and serve on its Trusts & Estates and Elder Law Committees, and serve on related committees of the Nassau and Suffolk County Bar Associations. I am a frequent lecturer and author articles on issues concerning estate planning, asset preservation and elder law.

What is your opinion regarding clients educating themselves on legal issues?

We enjoy working with clients who are interested in the issues and have educated themselves. Generally, they are the most appreciative of our services, our creativity and our dedication.

Are you willing to review documents prepared by clients?

Clients who prepare their own documents assume a substantial risk - that the documents will be inadequate or will fail to address significant issues. More often than not, the time necessary to review such documents, report to the client the nature and extent of their shortcomings, and then draft appropriate documents will exceed the time it would have taken to have drafted appropriate and protective documents in the first place. Remember, we practice "Preventative Law," we help our clients avoid the mistakes that waste wealth and diminish dignity.

Are you willing to coach clients who want to represent themselves?

We have found that when people who attempt to represent themselves speak about their matters, they invariably omit facts and circumstances or miscalculate the importance of information that is, in fact, vital. As a result, they are rarely as well-informed as they might think. Often, this leads to disappointment when they do not achieve the results they anticipate. Once again, we practice "Preventative Law." We help our clients avoid the mistakes that waste wealth and diminish dignity. Sometimes this means that we strongly discourage them from self-representation.

Why did you decide to be a lawyer?

Because I enjoy being an advocate. I am a good listener and problem solver and I believe that, when you do something which you truly love doing, it's not "work."

What work experience and education helps you be a better lawyer?

I began my career as an Assistant District Attorney in New York County (Manhattan), one of the largest and most prestigious prosecutors' offices in the country. As an Assistant District Attorney, I received training to enhance my litigation skills and learned how to "think on my feet." I learned how to handle every aspect of a case, from intake, the initial interview, through the trial and even appeal. Most important to my career was the in depth training I received: how to prepare and present a case, how to examine and cross-examine witnesses, how to negotiate, how to anticipate problems and resolve issues in the most advantageous light. I bring this training to the table every time I sit with a client. I try to anticipate the issues that may arise, now and in the future, in order to protect our clients and assist them in accomplishing their goals.

Why did you decide on your primary area of practice?

After I left the DA's office and went into private practice, for a number of years I handled commerical matters. My clients were corporations and their representatives were, for the most part, officers and employees for whom the work that I was doing was just"part of the job." My goal was to assist individuals and families in complex and personal issues which, if not properly addressed and resolved, have the potential for obscuring life's pleasures. Our practice does exactly that.

What do you like best about your career?

That I am a member of a team of caring and committed individuals who enjoy working together to achieve a common goal: to assist our clients with complex and personal issues which, if not properly addressed and resolved, have the potential for obscuring life's pleasures.

Tell us about your law firm:

We have the most wonderful team of assistants and paralegals. Each is uniquely qualified and brings to the team an individual skill set, perspective and sensitivity. Our goal is to make clients feel cherished, handle their matters expertly and efficiently, and ensure them that no matter is trivial and no question unimportant.

What are your strengths and style?

I am straightforward, outspoken and compassionate. I am not afraid to address the issues with which I am presented in a forthright manner. I am a problem solver and a good listener. I genuinely enjoy what I do - and I think that our clients know and recognize that.

We do have flat fee arrangements with our clients in certain areas of our practice. Because we believe that our clients are unique and their matters should be given personalized attention, the fees reflect the work that we will perform and are not "packaged."

We charge $350 for an initial consultation and these generally last from 60 to 90 minutes.

No, we do not have a "typical" retainer because in establishing this amount we take into consideration, among other things, the work involved and its complexity.
