Example Cases

I have handled many consumer bankruptcies under Chapter 7 and Chapter 13.

I successfully invalidated a foreclosure sale after the sale had occurred by obtaining injunctive relief against the foreclosing bank and barring the bank from completing the transfer of title to the high bidder at the foreclosure auction. This lead to a favorable settlement for my client and allowed him to keep his home. Please see: In re Strayton 360 B.R. 8 (Bankr. D. Mass. 2007).

I opened the firm in 1997 right out of law school.

My focus is to provide my clients with thorough and zealous representation. My philosophy is to treat each client with dignity and respect, to listen to their concerns, and answer their questions. I am available to address any issues at-hand, whether it is the more immediate matter of stopping calls, lawsuits or garnishments or the final result of a discharge of their debts.

The Massachusetts Bankruptcy Center works in conjunction with Town & Country Legal Associates whose attorneys specialize in these specific areas of law: personal injury, estates, wills and trusts, real estate, divorce and family law and civil litigation. My goal is to be able to provide my clients with the most effective representation possible. By having the resources of specialists, our clients save money by addressing any issues with my firm instead of outsourcing the matter to another law firm.

Activities and Awards

I was recognized by Massachusetts Lawyers Weekly newspaper in August 2005 as one of 15 "Rising Stars" of the Massachusetts Bar who have been in practice for less than ten years but have already distinguished themselves. I was recognized for taking difficult cases and overcoming unusual obstacles for my clients.

I was then honored at the Moakley U.S. Courthouse in Boston, MA in September 2005 by David L. Yas, Esq., Publisher/Editor-in-Chief, Massachusetts Lawyers Weekly for being selected as a Rising Star/Up & Coming Lawyer, based in part upon attaining professional success in managing several legal businesses throughout the Commonwealth and for prevailing in a difficult asylum case against the U.S. Government in Immigration Court.

What is your opinion regarding clients educating themselves on legal issues?

Knowledge is power. My staff and I strive to educate our clients throughout the process, so they may maximize their fresh financial start.

Are you willing to review documents prepared by clients?

We are always willing to review documents that may have an impact on our clients' cases, which helps keep the bankruptcy process smooth.

Are you willing to coach clients who want to represent themselves?

Clients choose my firm because they believe that the best person to represent them is an attorney. With the complexities of the new bankruptcy laws, people who wish to represent themselves need to be thoroughly knowledgeable about many aspects of bankruptcy. Many of the pro se clients who filed themselves have come to my firm to fix their problems. A typical example is that a client's case may have been recently dismissed, which means that a Motion to Vacate the Dismissal will need to be prepared and filed to reopen their case. The work involved in correcting what the pro se debtor has done or not done costs the client more money than had they gone to an attorney in the first place. Debtors who file pro se end up paying more in the end or they may jeopardize their ability to receive a discharge, too. If a client misses one thing in bankruptcy, the case may get dismissed.

Why did you decide to be a lawyer?

I have had an interest in the legal field since I was in high school and decided to pursue a career in law. And yes, I would do it all over again.

What work experience and education helps you be a better lawyer?

It was not necessarily the "legal work" that has made me a better lawyer over the years. Some of my past positions dealt with customer service, and during that time, I learned that carefully listening to concerns enables me to better serve customers. I have found that listening is a very important skill in being a better lawyer.

Why did you decide on your primary area of practice?

I enjoy bankruptcy because it is a field that touches and overlaps with many areas of the law in which I have experience. Many clients own real estate, some go through a divorce, and some have personal injury cases. Bankruptcy is one of the unique areas of law where knowledge in other areas of the law can assist you in doing the best job for your client. The difference between competence and excellence is the ability to do many things well.

What do you like best about your career?

No two days are the same. I enjoy the dynamic environment the practice of law provides.

Fixed-Price Services and Fees

Most of the bankruptcy cases my firm files are based on a flat, fixed fee. More complex cases are charged at an hourly rate. Special low rates are available for low income clients. My firm offers flexible payment plans.
