My continuing education requirements are fulfilled in many ways including comprehensive seminars offered by both the local and national bar associations. Additionally, as a member of the National Association of Bankruptcy Attorneys, I am frequently given notice on important new case law and its effects on consumers.

Lastly, the New York Bar has a fantastic internet list serve where some of the top practitioners share their vast experience and often groundbreaking case law. Annually, I try to fulfill more than the required number of hours of continuing legal education.

Example Cases

We have had the privilege of helping many elderly clients save their homes from foreclosure and, at the same time, assist these individuals in re-working their budgets. Many young people find themselves overwhelmed by the credit card debt incurred while they were students at a 2 or 4 year local college. They are often disappointed with the job opportunities available to them after their studies are completed, and the student loans are due for repayment. The combination of student loans and mounting credit card debt with percentages often 20% higher then the come on rate is devastating. At times our office has found itself facing a novel issue of law, for example the extension of a judgment beyond the 20 provision of the CPLR.

Our firm was established in 2002 by two unique individuals with vast prior business experience. The purpose of the firm was to combine our talent and experience in order to help consumers and small businesses succeed.

Why did you decide to be a lawyer?

I have spent many years in both the real estate and financial services industry. Quite often consumers are faced with situations that require a competent attorney. While there may be an abundance of attorneys in practice, many of my clients expressed negative experiences regarding the lack of compassion they have found in the legal community. As a person who has directly experienced hard economic times in the early period of my life, I can relate to the isolation and despair associated with law suits, bill collectors, process servers and the general inability to meet one's required financial burden. Bankruptcy offers people an opportunity to change their circumstances for the better. Bankruptcy is surrounded by myth and misinformation. My desire to become an attorney was fueled by my experience during hard economic times. I feel my experience in my field and my compassion for people in need qualify me as the right attorney to help those burdened by debt.

What work experience and education helps you be a better lawyer?

I have a significant background in real estate development, commercial financing and credit. This gives me an inside view as to what the other side thinks. I know the moves before the opponent makes them.

Why did you decide on your primary area of practice?

The area of bankruptcy is shrouded in myth and falsehood. I chose to go into this area of law in order to shed light on the great opportunity that bankruptcy provides and to ease the fears of debtors.

What do you like best about your career?

The best thing about my career is helping people get the help that they need to get out of debt and on track to financial stability.

Tell us about your law firm:

We have a great staff of helpful, smart people. Our office manager, Stephanie Giryluk, is the first point of contact for most of our clients. Our on-staff powerhouse, Dana Chrisomalis, can find a solution in current case law to any problem.

My partner, Lawrence Garvey, brings significant business and litigation experience to the firm.

What are your strengths and style?

I am caring, compassionate, and sympathetic. However, I am also aggressive and challenging in court.

Personal Interests:

I am married with two kids and a dog. I live in New Jersey and when I am not playing with my children, I am usually playing the drums, shooting, flying radio-controlled helicopters or waxing my car.

Typical Retainer

Our retainer agreement is a relatively simple one but does combine all of the required provisions of the Bankruptcy Reform Bill of 2005. Our typical retainer agreement for a Chapter 7 filing runs between $1,500 to $1,800 plus any required court fees.
