Example Cases

Dissolution of Marriage: Obtained temporary child custody for father, negotiated a reasonable parenting plan that gave each parent generous time and helped avoid a long, exhausting litigation over the children. Narrowed the case down for trial, and presented the judge with expert evidence about market value of property to give my client a fair division of property with favorable payment terms on the settlement. Client obtained marital rights in assets that wife was claiming were outside the marriage as separate property.

Defending post-decree modification of child custody: Represented a mother who lost temporary custody due to her being arrested twice for violating restraining order stemming from relationship problems with new male partner. Successfully met and disproved father's allegations about her character and fitness, when at trial the court found that she had properly dealt with areas of concern and that grounds for changing custody were no longer present, thus requiring both kids to be restored to her custody.

Child support: Court granted our motion to dismiss a request for college child support when the moving party failed to bring the request before age 18 and support had already expired. Wrote legal brief showing the judge some appellate case law, and overcame the opposing lawyer's misplaced belief that the court had not lost jurisdiction over the issue. Court granted attorney fees against opponent, paid to us as prevailing party.

What is your opinion regarding clients educating themselves on legal issues?

Be a smart legal consumer. Find out as much as you can by reading articles at the library or online. Seek out a free consultation with more than one local lawyer. The legal system does not have to be confusing or frustrating. Knowing a little about the legal process and what the court needs will help you present your case with focus and organization. I would much rather represent a client who has taken the time to educate him or her self about the law, compared to the person who has merely an un-informed sense of entitlement.

Please take with a grain of salt any comparisons to or advice coming from your cousin's co-worker's court case. People mean well when they tell you how to handle your case, but every case is as different as we are as individuals and families.

Are you willing to review documents prepared by clients?

I am more than willing to meet with someone who just wants their documents reviewed. Our local courthouse has a facilitator for that purpose, but a lawyer can give you much more in terms of ideas, sample clauses, advice, strategy, and predictions about what the court is likely to do.

Are you willing to coach clients who want to represent themselves?

I have helped many people file their own cases who are capable of doing their own papers, but who want the added input of a lawyer's review. Modern rules allow limited representation where the lawyer can have less than full involvement. For example, using the lawyer to speak in court and act as attorney of record, when the client has done the paperwork. Another example is when an attorney does strategy sessions with someone who is representing himself or herself in court.

Why did you decide to be a lawyer?

In college I was attracted to the language and logic of law.

What work experience and education helps you be a better lawyer?

Before I was a lawyer I had experience in both criminal procedure and in real estate and land titles. I was married ten years before having children, and am now the father of an elementary age boy and girl.

Why did you decide on your primary area of practice?

I became interested in family law early in my legal career. I found great satisfaction in helping people with their important personal legal issues. I enjoy the frequent court activity in family law compared to a purely office practice, such as transactions.

What do you like best about your career?

No two days are alike, although there is enough repetition to get very efficient at paperwork and procedure. Each client has a fascinating personal story that often needs to be told in court. I appreciate being in a position of trust, where people can rely on me. I appreciate being partially responsible for successes both small and large in what matters most in my clients' lives. I also appreciate the chance to build long-term credibility with our local judges so they can confidently use my work to give people the best results.

Tell us about your law firm:

I am a sole practitioner, and my clients deal only with me. Occasionally I will employ an assistant on large or intensive projects. My office is shared with several other independent attorneys working in family law and various other areas of law.

What are your strengths and style?

Strengths: I use thorough preparation and close familiarity with the facts. I am efficient at legal research. I am creative enough to look for options and solutions where none is apparent. I apply a direct and no-nonsense approach in court designed to keep control of the case while persuading the judge to be comfortable making rulings that are favorable to my client. I avoid unnecessary conflict, litigation, expenses, and certain tactics and games. My personal approach with clients is caring, thoughtful and realistic. My approach towards lawyers, professionals, and court employees is firm but reasonable. I try to maintain good relations despite any conflict happening within a case.

Personal Interests:

I enjoy bicycling and bike commuting. I am a Boy Scouts leader and very involved parent. I appreciate music and art. I like camping, hiking, and spending time in the great outdoors of this beautiful land.

Fixed-Price Services and Fees

Flat fees are available when the attorney's time and work is predictable. Uncontested matters, even for divorce and non-parent custody, or modifications of parenting plans and child support, can sometimes be done for a fixed fee. A flat fee is often set a little higher to allow room for the lawyer to spend more time on the "mildly contested" matters that will need brief negotiations or various revisions to agreements.

Hourly Rates

$170 per hour. Trial time is $190 per hour. Discounts are available for modest incomes.

I am careful and responsible with my clients' money.

Free Initial Consultation?

Free one-hour office consultation, with no charge and no obligation. Brief advice is available by phone or email.

Typical Retainer

$2,000 for a contested divorce with property and children. The minimum retainer for smaller matters is between $500 and $1,500 depending on the issues.

Understanding Fees

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
