Bankruptcy
We represent individuals and families across the state who are struggling financially. We represent many people who have fallen behind on their mortgages, and work with them to save their homes.
CT, Nov 1987
Bar Number: 307106
The Federal and State courts of Connecticut, New York and Washington D.C.
The Connecticut Bar Association and the Hartford County Bar Association.
Connecticut does not have a continuing legal education requirement, but the attorneys at Beckett Law, LLC, actively seek out educational opportunities to stay abreast of changes in the law.
We frequently handle cases for individuals who have suffered a life changing event (divorce, illness, loss of employment), which has made it impossible for them to pay their bills. Many of our clients try absolutely everything to avoid bankruptcy. We have seen many sad situations where a client has gone through his/her entire life savings and retirement accounts to avoid bankruptcy, only to end up filing anyway. About half of our clients have mostly unsecured (for example: credit cards, personal loans, etc.) debt and those cases typically move forward very quickly, with a "discharge" by the Court approximately 100 days after filing the bankruptcy petition. We have had many grateful clients who have been able to start over without the stress of unpaid bills hanging over their heads. Many of these clients express regret that they did not come to see us sooner. I have never had a client say he/she wishes she hadn't filed.
The other half of our clients are behind on their mortgages, and facing foreclosure. Unfortunately, because of the easy refinances in recent years, many of these people have pulled out all of their equity but they still want to keep their homes. We help them propose a plan to pay the arrearage back to the bank over 3 to 5 years, which gives them breathing room. Many times, we are able to get rid of the unsecured debt altogether. Because creditors cannot harass them while they are in bankruptcy, these clients have a chance to get back on their feet while enjoying complete protection from creditor calls, letters, lawsuits, etc. The majority of our clients do save their homes.

I opened my firm in 1993, after being trained at a large area firm for 5 years. Attorney Bauder was a law clerk at the firm while in law school, and has been an attorney with the firm for over 2 years.
Our firm concentrates its practice in 3 key areas: Bankruptcy, Real Estate and Estate Planning. The amount of time spent in any one category at any given time is determined, in large part, by the economy. In 2007 and 2008, Bankruptcy clients exceeded 50% of the firm's total, with Real Estate and Estate Planning comprising the balance of our clients. We pride ourselves on excellent client responsiveness, and have an employee devoted entirely to responding to client inquiries in a timely manner.
Upon graduating from law school, I worked at Eisenberg, Anderson, Michalik and Lynch in New Britain where I handled tasks in the litigation department. I handled a number of municipal matters, as well as many personal injury, bankruptcy, real estate, and general litigation matters during my time there.
I am a member of Wealth Counsel, which is an association of estate planning attorneys across the country. I have also been a speaker at a number of public and private seminars on estate planning matters.
We believe strongly in working with our clients in a partnership and we want our clients to understand everything about their files. We encourage clients and prospective clients to visit our website, which is very informative, and to educate themselves to the extent they can on the matters affecting their lives. We try to write documents in "plain English" so that clients can more easily understand the intent, and we never want a client to sign a document that they he or she doesn't understand.
Although we are always willing to review documents prepared by clients, we do so on an hourly basis. Unless a client has a legal background, documents prepared by a layperson are frequently laced with landmines and we do not recommend their use. The cost to "fix" a document that has been prepared by a layperson often exceeds the fee we would have charged to start from scratch. It is not always easy for a layperson to understand the need for 100% clarity, and/or that a word may not mean what they think it means in a legal document. What may seem crystal clear to the writer may appear to be significantly less so when viewed through the eyes of a legal professional.
We do not coach clients who wish to represent themselves.
I became a lawyer to help people, as I have seen many people taken advantage of by "the system" due to a lack of understanding of their rights.
My family had a farm where I worked growing up. I believe I have a lot in common with my clients, who are generally working people. I have been an attorney for more than 20 years and I've seen many situations arise in that time. My experience in resolving these issues benefits current clients as I am more able to easily and efficiently resolve their problems. I come from a family of readers, who instilled a life-long love of learning. I continue to read constantly, and am always trying to increase my knowledge in the areas of law in which I focus my practice. I think this emphasis on continuing education, which is not required by our State Bar, benefits the clients we serve.
I initially chose to work in litigation, which I did exclusively for about the first 10 years of my career. However, after having children, I chose to change focus and work more closely with individuals and less with companies and municipalities. The areas of practice I have chosen in the last 10 years revolve around financial matters, which I find serves a huge need. Many of the people we work with, and even some attorneys, do not fully understand how finances work and being able to help people in that area is very gratifying. We know our bankruptcy clients have much better and less stressful lives after filing with us, and we know our estate planning clients feel a similar satisfaction once they know their affairs are in order.
I enjoy being self-employed, with the ability to choose the clients and people I work with. We do not necessarily accept every client that walks through our door. We try to work exclusively with clients who need our help and who will put in the effort necessary to teach us about themselves. We like clients who are willing to learn about the law, so that together we can produce the best results.
I have a wonderful assistant whose sole job is to respond promptly to client questions and concerns by telephone. Although, at one time, I was able to personally respond to each call myself, I can no longer do so because of the time I spend in meetings, court proceedings, and the like. Our firm believes in the team approach, and there is always someone at the firm who is familiar with the file. Even if the attorney is unavailable, the client does not need to wait for a response. We have 3 full time assistants, and 4 part time assistants, all of whom have a specific job but we do a considerable amount of cross-training as well. Our firm computers are completely networked, so everyone has access to everyone else's files, and we are about 80% "paperless" so frequently information can be relayed to the client immediately, without the need to pull the physical file.
Our strengths are our ability to teach clients about the law, so that they really understand what is happening with their matter. We hear complaints too often from clients who have transferred from other firms, that their prior attorney "didn't explain" anything. We have learned from that, and make every effort to provide educational materials to clients and prospective clients, and to keep our website up to date, so that clients can be well informed. Another strength is our ability to write in a way clients understand, and not in "legalese." Another frequent complaint is when we take over an estate planning matter and clients tell us that they have spent a lot of money and have a lot of paperwork, but don't understand what any of it means. To us, that is a failure on the attorney's part and we work hard to make sure that our clients fully understand everything we prepare. We also prepare summaries of complex documents so that there is less to digest and the clients can focus on the substance without necessarily getting distracted by the less important clauses and paragraphs.
My primary interest is horseback riding; I ride for pleasure, but spend a lot of time at shows on the weekends with my oldest daughter. My youngest also rides, so it is truly a family affair. We are animal lovers, with a golden retriever, an Afghan hound, a Cavealier King Charles spaniel, and a cat at home. We also enjoy swimming, hiking, and other sports activities. I have been a Girl Scout leader for my oldest daughter's troop for 4 years. We are avid gardeners, and all of our clients see the results when they visit the office.

We do not have fixed price fees, as that would be unfair to both the lawyer and the client. Each situation is unique, and each person has his/her own set of issues that the attorney may address. We charge a lower fee for a simple case, and a higher fee for a more complex case. We work almost exclusively on a flat fee basis, which we will quote after assessing the situation and estimating the amount of time the matter will require.
$225 to $300 per hour depending on the attorney and the type of matter.
We offer a 30-minute no-fee consultation which is usually sufficient for the attorney and prospective client to meet, discuss the broad parameters of the issue, and make a decision as to whether they are a good fit. If the consultation takes more than 30 minutes, we charge $50 per 15-minute block of time.
$175 for a Chapter 7 bankruptcy and $500 for a Chapter 13 bankruptcy.
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.
Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
