Bankruptcy
I prefer to handle Chapter 7, 11 and 13 bankruptcy cases. I also handle foreclosure appearances and settlements that avoid declaring bankruptcy.
NY, Jan 1980
Bar Number: 1675321
New York State Courts; Federal U.S. Supreme Court; Southern and Eastern Districts of New York.
New York State Bar; Westchester County Bar; Northern Westchester Bar; Hudson Valley Bankruptcy Bar, National Association of Consumer Bankruptcy Attorneys; American Bankruptcy Institute.
I regularly attend local and national seminars on bankruptcy law, and other topics which connect with bankruptcy cases, such as matrimonial and real estate law. In addition, I teach at continuing legal education seminars, on bankruptcy law. The courses taken, and credits earned, have always exceeded the minimal requirements.
Since opening my own practice in 1982, I have written several articles for local bar association journals and newsletters on bankruptcy; and the interplay and interaction between bankruptcy, divorce and real estate.
In the past couple of years, I have successfully represented clients who have sold their homes as part of a bankruptcy, and recover funds for themselves, including necessary moving expenses, when faced with imminent foreclosure and loss of their entire investment. One of these cases involved a heavily emotional and contested divorce proceeding in which I was able to obtain certain agreements and results between the spouses that their divorce counsel was unable to accomplish. The two banks holding mortgages agreed to wait until sale; and the resulting sale allowed my client to recoup a substantial sum of money from the proceeds of sale.

The Law Office of Nathan Horowitz, Esq. opened in June 1982 in White Plains. In 1994, I recognized a need for my services in Putnam County and opened a satellite office in Carmel, New York. Through the 1990's, Nathan Horowitz represented clients throughout the New York metropolitan area, including New York City, the entire Hudson Valley (Westchester, Rockland, Putnam, Dutchess, Ulster, Sullivan and Orange Counties) and Nassau County. At the current time, I continue to serve clients in these areas, except for Long Island. I appear in the bankruptcy courts in Poughkeepsie, White Plains, Manhattan and Brooklyn.
Since 1982, my office has focused on providing financial relief to individuals and families and developing a personal relationship with the client. I am still providing legal services to one of my original clients and their children. This includes complete relief from overwhelming credit card or medical debt, but also payment plans to save a home or to pay back taxes.
While the primary focus of my practice is under the bankruptcy code, Nathan Horowitz, Esq. provides a range of legal services, including buying or selling homes, condominiums and co-ops, creating or buying a business and simple wills.
Associate Attorney with Pinks & Feldman, Esqs., Melville, New York, from June 1980 to April 1982. The practice focused on collections and bankruptcy law
Regularly invited speaker for the New York State Bar Association, including a "Bridge The Gap" Seminar specifically tailored to newly admitted lawyers, to help the change from academic study to actual practice of law.
Invited to serve on New York State Bar Association Committee to develop proposals for New York State Legislature and Congress for addressing sub-prime mortgage and foreclosure crisis.
The best consultations are those clients who have either read my website or have otherwise obtained some basic knowledge of how bankruptcy works. Even if the client has misunderstood something about the law, it is usually easier to correct a misconception if the client has educated himself or herself.
Although I am willing to review documents prepared by the client, the client should understand that the time and effort to review and correct can be at least as much, if not more, than had they supplied the information to me and my office prepared it.
That is not the nature of my practice; and the new bankruptcy law provisions strongly discourage, if not prohibit, the practice.
I always seemed to have a skill of seeing both sides of an argument and addressing positions opposed to my own.
My legal experience since 1980 has been paramount in addressing a very broad variety of legal concerns faced by clients, especially individuals and families having financial difficulty. I can truly empathize with my clients, having experienced a short period of time where both my wife and I were unemployed, prior to opening my own law office in 1982.
My first law office position introduced me to the bankruptcy code and practice, and provided me with the special knowledge and skill to open my own office. It has always been a tremendous feeling to see the relief on clients' faces in the first consultation when they understand the relief that is available to them, and by the successful conclusion of the proceeding.
Providing the initial financial relief to clients, and more so, when I hear later from clients that they are doing much better are some of the best things about my career. I have represented many clients in buying a home or starting their own business after a bankruptcy.
I am a sole practitioner. As such, from beginning to end, the client receives my personal service and attention. All questions are directed to me and responded to by me. My practice is located within a suite of other attorneys practicing in real estate, divorce and litigation. This provides a tremendous additional resource when the client has an issue or a question in these areas of law.
My greatest strength is the personal attention I give to my clients. My style, or philosophy, is simple: understand the need and get the work done. I have stayed in my office past midnight, when necessary, to complete a bankruptcy filing and provide the needed relief to a client.
I enjoy skiing and bicycling with family--both immediate and extended.

Yes we have fixed-price fees. For consumer bankruptcies (Chapters 7 & 13), a fixed fee is quoted at the initial consultation, which will cover all usual and customary procedures and events in the bankruptcy. The fees for clients may range slightly based on the individual's situation. If additional issues arise, such as objections or other contested proceedings, hourly rates will apply, and will be specified in a written retainer agreement.
$300 to $350 per hour.
The initial consultation is $130 with no time limit. If the consultation is less than one hour, full credit is given against the actual fees charged.
I am generally officially retained upon receipt of half of the quoted legal fee, at which time I will take all calls from creditors and prepare the client for the required initial credit counsel briefing.
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.
Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
