Continuing Education

Through extensive reading and teaching a survey course at Georgia State University College of Law, "Sexual Identity and the Law," I stay abreast of gay and lesbian legal issues. I also keep current on developments in mainstream law by a regularly attending continuing legal education courses in family law and estate planning, including the annual Georgia Estate Planning Institute.

Example Cases

I assist numerous gay clients with property division issues where, as a couple they co-owned property together and are now breaking up. I also assist same sex, unmarried couples with disputes about custody and co-parenting that arise in break ups. To safeguard relationships, I work to help clients develop Joint Ownership Agreements and plan for their relationships to avert nasty breakups with disputes about money, custody and/or property.

Firm Focus and History

I opened my own firm in 2004 so that I could structure my practice to focus on gay and lesbian legal issues.

The firm of Jane Morrison, P.C. is dedicated to providing individualized, quality legal services to Atlanta's gay and lesbian community. I established my practice to focus on the needs of gay and lesbian individuals, to address our relationships as couples without the legal rights associated with marriage, and to better serve those members of our community who may need or prefer legal assistance that fully takes into account and supports your identity as a gay, lesbian or transgender person. Jane Morrison, P.C. does not discriminate on the basis of sexual orientation. Many of the firm's clients are straight. Many straight clients appreciate and benefit from a different perspective on the law.

Previous Employment Summary

I entered the practice of law in 1994 and initially worked as a prosecutor and criminal defense attorney. I was instrumental in founding Stonewall Bar Association, Georgia's gay and lesbian bar association in 1995 and served as the second president of the organization. In 1997, I went to work for Lambda Legal Defense and Education Fund, the national gay and lesbian civil rights law foundation, to open the organization's Southern Regional Office in Atlanta. I served as Regional Director for Lambda Legal's operations in the south for three years until returning to the practice of law with a small civil practice firm in Atlanta, McCrary & Associates. I opened my own firm in 2004 to better focus my work in gay and lesbian legal issues.

Activities and Awards

I was one of the original board members of Stonewall Bar Association, Georgia's gay and lesbian bar association in 1995 and served as the second president of the organization. I received Stonewall Bar Association's award for Longtime Service to the Community in 2001.

In 1997, Lambda Legal, the national gay and lesbian civil rights law foundation, consulted me in opening the organization's Southern Regional Office. I served as Regional Director for Lambda Legal's operations in the southeast for three years. I am now a member of Lambda Legal's Board of Directors.

From 2000 to 2002, I served as Judge Pro Hac Vice in the City of Atlanta's Municipal Court and then as a part time Magistrate Judge in Fulton County State Court from 2003 to 2007.

I am 2001 graduate of Leadership Atlanta and have served on the board of directors of the Historic District Development Corporation, a community revitalization organization in the Martin Luther King, Jr. Historic District in downtown Atlanta.

I am a current adjunct faculty member at Georgia State University College of Law where I teach the course "Sexual Identity and the Law" on an annual basis.

What is your opinion regarding clients educating themselves on legal issues?

I am always pleased when a client knows the issues and has taken time to educate him or herself about legal issues. I enjoy taking time to explain the law to non-lawyers, so that clients have a firm understanding of the issues and potential outcomes.

Are you willing to review documents prepared by clients?

I often ask clients to prepare initial statements, chronologies and other summaries. I then work with clients to craft a document in a format that is appropriate for the legal issue at hand.

Are you willing to coach clients who want to represent themselves?

I have an ethical duty to a client to be sure that he or she understands the risks of self-representation. I must also balance my professional duty to be honest with the Court and other attorneys about my involvement in a case. I generally do not "ghost write" pleadings or other documents.

Why did you decide to be a lawyer?

I chose to study and practice law to address the unfairness that exists for gay men and lesbians in our legal system. That was in the aftermath of the 1986 U.S. Supreme Court decision Bowers v. Hardwick. I am thrilled by the progress that has been made since then by groups such as Lambda Legal to address many of those inequities and I am committed to furthering basic fairness. My practice allows me to realize justice for individual clients in this emerging and changing area of law.

What work experience and education helps you be a better lawyer?

My years as a part-time judge in municipal and county magistrate courts provide me with a great perspective of the court room and the law in general. My prior work as a lobbyist for civil rights legislation makes me aware of the importance of good statue and rule based law. I stay current with gay and lesbian legal issues through the course I teach at Georgia State University College of Law: "Sexual Orientation and the Law." My involvement with Lambda Legal, as a prior staff member and now as a member of the national Board of Directors, keeps me tied to the community and the gay and lesbian civil rights movement.

Why did you decide on your primary area of practice?

I focus my practice in the gay and lesbian community because the law often overlooks the issues that arise in our day to day lives and leaves us without basic and essential protections.

What do you like best about your career?

It is meaningful to me to be involved in the effort to win gay and lesbian rights and to now be able to put hard won victories to use to directly help clients.

Tell us about your law firm:

As a sole practitioner, I work directly with my clients. I am pleased to provide my clients with the support of a fully staffed office including my ABA certified paralegal, Kevin Cauley, and my administrative assistant Chandra Jordan.

What are your strengths and style?

I enjoy explaining the law to clients and do a good job of keeping clients informed about the legal process in which they are involved. I will always be straight forward about challenges, the likelihood of success, and what is at risk.

I love to litigate and am an aggressive advocate. At the same time, I understand that clients' needs are sometimes best met though patient negotiation. In both litigation and negotiation I work thoroughly and diligently to meet clients' needs.

Whatever the case or issue, I remain directly accessible to my clients and am personally and professionally committed to them.

I am a classical musician by training and enjoy distance running and gardening.

Fixed-Price Services and Fees

Most of my work is performed on an hourly basis.

I perform some estate planning services at fixed rates. I offer a fixed fee of $750 for a Basis Estate Planning package to prepare a simple Last Will and Testament and Georgia Advance Directive for Health Care. Services include: 1) an in-person consultation and interview session to assess clients' needs, 2) basic document formulating and drafting, 3) circulation of drafts for the clients' review, 4) a telephone conference to review the drafts and answer your questions and concerns, 5) a formal execution session with requisite notary and witnesses to ensure that the documents are properly executed and "self proving" 7) delivery of bound originals to you 8) electronic and paper storage of fully executed copies. All interviews, consultations and formulation of documents are performed directly by me, as your attorney.

I charge at my hourly rate for additional estate planning services that may be required to address issues such as extensive or complex bequests, contingencies, testamentary trust provisions, extensive holdings, large estates, etc.

My standard hourly rate is $250 per hour.

Free Initial Consultation?

I charge $250 for a consultation. If your case involves document review in advance of our consultation or other related and/or follow up services, there will likely be an additional charge based on my hourly rate of $250 per hour.

The amount of a retainer varies by type of case and whether litigation is expected.
