I have argued many cases in front of the Nevada Supreme Court on behalf of my clients including:
-Knauss v. State Farm regarding the stacking of medical payments coverage.
-Ippilitto v. Liberty Mutual Auto Insurance Companies resulting in a "must offer" rule which requires insurance companies to offer underinsurance to their insured in an amount equal to their liability limits.

I worked for Albert D. Massi from 1984 until Cap & Kudler was formed. I met Don Kudler while working for Mr. Massi in 1994. The focus of Mr. Massi's firm during that time was representing injured clients in personal injury cases. Since starting Cap & Kudler, Mr. Kudler and I have continued to work in the personal injury field and have also broadened our practice to include transactional issues (contract interpretation, counseling clients, and non-personal injury litigation involving individuals and businesses).
Cap & Kudler was established in 2004 by Allen A. Cap, Esq. and Donald C. Kudler, Esq. after the two had worked together several years for Albert D. Massi.

It is helpful for clients to understand the legal issues involved with their cases. I attempt to educate my clients on those issues. Our website contains information for our clients to use regarding the types of matters we handle. I also maintain a Blawg (legal blog) to provide information about personal injury law and related issues to my clients at.

I enjoy assisting my clients resolve their legal problems. Many of my friends are lawyers who encouraged me to join the profession.
My training in the human body helps me to understand how injuries occur, how they can be treated and how to explain the injuries and treatment to my clients and juries. My participation in competitive sports has given me the discipline to see things through and to attend to my clients' needs to their fullest.
The anatomy, physiology and science involved in auto accidents and other personal injury cases interests me and allows me to use what I have learned over the years to represent my clients.
I enjoy the time I spend with my clients in person and on the phone. I want to understand their injuries and how they are personally affected by those injuries. I communicate with my clients as we work together during their recovery and the various phases of the settlement and the litigation process. I enjoy fighting with insurance companies that have their own financial interest in mind. I also enjoy the time I spend with other attorneys, even those who are adverse to my clients.
There are two attorneys in the firm, Donald C. Kudler and myself. There are two secretaries. They each work for both attorneys. There is a receptionist who takes the calls and directs them to the proper attorney or secretary. Clients talk to the secretaries for items such as scheduling or quick questions we may have. In some cases, statements may be taken by a paralegal. We have a bookkeeper to keep track of the retainer fees and to prepare distributions of proceeds from settlements or litigation. The attorneys talk to the clients about legal issues and prepare clients for meetings and hearings. The attorneys and staff make every effort to call clients back within the day. We understand how important their issues are to them. We keep our clients informed about the status of their cases.
My strength lies in my preparation. I take every case, every client, every issue and every hearing seriously and make sure that I know everything necessary to be best prepared to help my clients. My style is straight-forward, and no-nonsense.
I continue to be interested and personally involved in weight training and physical fitness. I enjoy reading different kinds of things. Occasionally, I read books and articles that are useful in representing my clients. I also enjoy listening to music and watching entertainment.

Our personal injury clients are represented on a contingency basis. They pay 33 1/3 percent of the gross recovery (plus costs) for cases that settle before the initiation of mediation, arbitration or lawsuit or 40% of the gross recovery (plus costs) for cases that settle after any form of litigation is initiated. Our traffic citation clients pay a flat fee depending on the complexity of the case. The rest of our clients pay an hourly rate that varies with the complexity of the case.

We offer free consultations for personal injury cases for the time necessary to discuss the case, the issues involved in the case and any plan for representing the client. Our fee for other clients starts at $200 for an initial consultation of up to an hour. Fees will be higher if there is a need for longer consultations and/or preparation time for more complex issues. Because we understand that our clients' time is as valuable to them as our is to us, we may want time to review documents and the relevant prior to the consultation in order to conduct the consultation in a meaningful and efficient manner.
Retainers start at $2,000 and vary with the complexity of the case. In certain cases, flat fees will be less and are required to be paid up front.
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.
