Example Cases

We handle all types of insolvency cases for debtors and creditors alike. I have successfully litigated several major Chapter 11 cases for debtors, major banking institutions and various municipalities. The following cases that I have handles have been officially reported and published as follows:

1. In re Kleinsleep Prods., Inc. 78 F 3d 18, 2nd Cir. 1996, reversing 173 B.R. 296, S.D.N.Y. 1994. Status of landlord's claim after rejection of assumed lease in Chapter 11 case.
2. Pico v. State, 116 N.J. 55, 1989, reversing 224 N.J. Super 446, App. Div. 1998. Whether the weather immunity under New Jersey State Tort Claims Act bars a claim of gross negligence.
3. Ananko v. Harsanyi, 91 B.R. 231, D.N.J., 1988. Whether a foreclosure sale can be a "fraudulent conveyance" under the bankruptcy code.
4. Kohn v. Hursa, 87 B.R. 313, Banker. D.N.J., 1988. Abstention of bankruptcy case pending outcome of state court divorce proceedings.
5. Brown v. Szakal, 212 N.J. Super. 136, Ch. Div. 1986. The rights of custodial parents to direct religious upbringing of a child.

What is your opinion regarding clients educating themselves on legal issues?

A client educating themselves is a big plus, and I unequivocally recommend Nolo publications.

Are you willing to review documents prepared by clients?

We review all client prepared documents that are relevant to their representation.

Are you willing to coach clients who want to represent themselves?

I am not willing to coach clients because then the presentation of the case, which is vitally important, is out of our control.

Why did you decide to be a lawyer?

I knew I would be a good lawyer and I am.

What work experience and education helps you be a better lawyer?

The experience of playing hockey to win coupled with attending semi-annual NACBA conventions helped make me a better lawyer. I also attended Max Gardener's Bankruptcy Boot Camp, which gave me additional experience in this field.

Why did you decide on your primary area of practice?

In my second year of law school, I approached one of my professors for a summer job at her firm and I was hired as the firm's first summer intern. The firm turned out to specialize in insolvency matters. I was mentored by Harold Okin, Esq., the Dean of bankruptcy lawyers in New Jersey at the time.

What do you like best about your career?

I like seeing the relief on a client's face when he or she successfully emerges from bankruptcy and is grateful for the result achieved.

Tell us about your law firm:

I have a lovely wife who is my law partner and approaches law from an empathetic point of view, a trait that is frequently lacking in attorneys at large. I have a paralegal that attends NACBA conventions and has completed Max Gardener's Bankruptcy Boot Camp.

What are your strengths and style?

My strengths are analyzing clients' situations and planning an overall strategy to assist them to overcome their problems as quickly and practically as possible.

Personal Interests:

I am an avid skier and love to play both hockey and tennis. I am a Trustee of the Congregation of B'nai Israel in Fleischmanns, NY.

Fixed-Price Services and Fees

Our fees are set at the first conference and depend on the complexity of the matter. Although these fees vary, in general, the price for an individual Chapter 7 case is $2,500 and for a Chapter 13 $3,500.

Hourly Rates

On average, our hourly rates are $350, but this varies according to the complexity of the case.

We have standard retainer agreement forms for Chapter 7 and 13 cases.

Nolo's Licensing Check
