Example Cases

Truck Car Collision Resulting in Death of 17 Year Old. David and Jean Elliott sued several defendants for wrongful death after their 17-year-old daughter was killed in an accident with a dump truck on May 20, 1999 at the intersection of Clarkson Road and Baxter in St. Louis County. The defendants included driver Harold Kelley III and Harold Kelley Trucking. L.E.G. Brown Hauling, a small trucking company, was added as a defendant because Kelley was working for the company at the time of the accident. The Elliott's settled with the defendants for a total of $2.1 million.

Motorcycle Car Collision--$1.75 Million Judgment and $250,000 Settlement
In October, 2001, Richard Zempel took a motorcycle ride down the river road in Alton, Ill. His 11-year-old son, Graham, was riding on the back. After the Zempels crossed the river into St. Charles on the Golden Eagle Ferry and proceeded down Highway B, a Jaguar driven by R.J. Slater pulled out from a stop sign into their path, causing Richard Zempel to skid 84 feet into the side of Slater's vehicle. Although they were wearing motorcycle helmets, Richard and Graham Zempel both suffered traumatic brain injuries, with Richard Zempel's injuries requiring medication for the rest of his life and causing sleep disturbances. Due to the brain injuries, neither had any recollection of the accident. Slater maintained that he never saw the motorcycle before pulling out and was unable to provide any testimony about the location or speed of the motorcycle. After a four-day trial, the jury awarded $1.75 million to Richard Zempel and $175,000 to his wife, Elizabeth. The case involving the son was settled for $250,000.

Medical Malpractice—-Laparoscopic Gallbladder Removal Resulting in Death
Vaughn v. Dr. Yzadi, alleged negligent laparoscopic gallbladder removal. Defendant doctor misidentified the common hepatic duct for the cystic duct and the hepatic artery for the cystic artery and clipped and transected the common hepatic duct and right hepatic artery. The surgeon further cut the ducts a second time where they went into the liver while dissecting the gallbladder away from the liver. This also caused a thrombosis in the portal vein which stopped the flow of blood to the liver and led to the eventual death of the patient. The case settled immediately prior to trial for a confidential amount in 2002.

Medical Malpractice—Failure to diagnosis Pulmonary Embolism Resulting in Death
Lee v. Barnes-Jewish Hospital, et al., failure to diagnose deep vein thrombosis which led to a fatal pulmonary embolism for a 35 year old woman. Her husband and children settled for a confidential amount at mediation.

Product Liability—Defective Breast Implant Resulting in $4.5 Million Jury Verdict
The plaintiff underwent a mastectomy of her right breast in 1982 due to recurrent mastitis. Her surgeon recommended reconstruction with silicone gel implants in both breasts, so that they would look the same. She received Surgitek smooth wall extra thin implants. Ten years later she noticed movement of her right implant. Then in 1993 pain in her left breast was diagnosed as mastitis. Her treating physician, Dr. Roger Khouri, believed the implants were causing an inflammation that was aggravating the mastitis. When Dr. Khouri operated to remove the implants, he found that the left implant had ruptured and caused an intense inflammation in her chest tissue. He performed a mastectomy of her left breast. The doctor then reconstructed her breasts by taking tissue from her abdomen and part of her rectus muscle. The woman subsequently developed abdominal wall and incisional hernias, which were repaired in 1994. Mesh was placed in her abdomen for support. After a second hernia repair, the woman developed permanent abdominal wall weakness, which requires her to wear external support constantly. It was determined that additional surgery would be too risky. In her products liability action, the woman claimed the Surgitek smooth wall implant was defective because it was made with an extra thin shell making it more susceptible to ruptures. She also alleged the implant was negligently designed because of the thin wall and that the implants were not adequately tested when the company moved from a thicker to a thinner wall. The jury returned a verdict in favor of the woman on the products liability claim for $2.25 million with 100 percent fault to the defendant and punitive damages of $2.25 million were also awarded.

The Lowe Law Firm was established in 2003. Since that time, the firm's principal, Jeffrey J. Lowe, has tried cases and obtained million dollar verdicts and settlements. The firm only does personal injury cases on a contingent fee basis so we are only paid when we recover monies for our clients. We advance all of the expenses and only recover those expenses from any settlement or judgment. The firm does a variety of personal injury work including truck accident, motor vehicle accident, medical malpractice and product liability cases. Our product liability cases in the medical field include medical products such as knee replacements, defibrillators, and ventricular assist devices. The firm also has experience in pharmaceutical liability work including the pharmaceutical products Bextra, Vioxx, Celebrex, Trasylol, Fen Phen, Fosamax, Zyprexa, and many other recalled drugs.

What is your opinion regarding clients educating themselves on legal issues?

I have no difficulty with clients educating themselves on legal issues. Just like many patients like to educate themselves regarding medical issues when seeing doctors, I believe it is helpful. I do believe, however, that in the end they should follow the advice of their lawyer regarding the analysis of the legal issues.

Why did you decide to be a lawyer?

I decided to become a lawyer because I enjoy helping people and analyzing complex legal issues. For my first five years of practice, I worked primarily on behalf of corporations defending claims brought by individuals. During that time, I began doing some plaintiff's work, and I found I enjoy helping injured people and their families more than keeping them from obtaining just compensation for their injuries. That is why I now only represent plaintiffs in litigation.

What work experience and education helps you be a better lawyer?

I worked my way through college delivering flowers and working as an investigator. Upon graduating college, I decided to take some time off and I worked at a warehouse. These life experiences helped me because I can understand the difficulties that people face when they are injured and have no income or are living paycheck to paycheck.

Why did you decide on your primary area of practice?

My primary area of practice is personal injury. I chose it because I want to help injured victims and their families recover just compensation for their injuries. I also enjoy learning about medical and scientific issues. When I finish working on a particular case, I have developed a great deal of medical or scientific knowledge on that particular area.

What do you like best about your career?

What I enjoy most about my career is helping people. I get a great deal of satisfaction when someone has been injured and I am able to get a recovery that will help take care of them for the rest of their life.

Tell us about your law firm:

I work with three other attorneys and one attorney that is of counsel. My secretary has worked for me since 1991 and knows the legal business inside and out. I have worked with my paralegal since 1995 and she also has a great deal of medical knowledge and is attentive to the needs of the clients.

What are your strengths and style?

I am a hands on attorney. I am capable of handling a case from beginning to end, including appeals. Early in my career I worked on behalf of major corporations as an injury defense lawyer, so I understand their mindset when it comes to negotiation and litigation of injury claims. I am very knowledgeable about the law and am detail-oriented. I believe I am sensitive to the needs of the clients. I have experience trying complicated cases to a jury.

Personal Interests:

The profession of being a trial attorney is very demanding. My primary interests are with my family. We live 35 minutes outside of St. Louis on a farm with four horses, four dogs, and three cat and enjoy the outdoors.
