Example Cases

Gender and age discrimination class action on behalf of over 3,000 female financial advisors which resulted in a $31 million dollar settlement and significant changes to company practices (Kosen v. American Express Financial Advisors).

First sexual harassment case ever certified as a class action (Jenson v.Eveleth Mines), which was the subject of a book (CLASS ACTION: The Story of Lois Jenson and the Landmark Case that Changed Sexual Harassment Law), and a 2005 Movie (North Country, starring Charlize Theron).

Race discrimination class action where I successfully directed the prosecution of the claims of over 1,200 African American class members (Aburime v. Northwest Airlines).

ERISA class action on behalf of over 75,000 participants challenging the management of 401(k) funds which settled for $26 million (Franklin v. First Union).

Schaefer Law Firm, LLC, aggressively asserts the rights of employees and consumers who have been victimized by illegal corporate conduct. We provide the very highest level of advocacy to our clients. Once we commit to a case, we are prepared to pursue it to judgment. We will not be deterred by the size of the defendant or the tactics often used by defense counsel. The experience, expertise and commitment of the firm's lawyers is unmatched in this field.

I founded the firm in 2006. I have twenty years of experience in representing individual, groups or classes of employees in often groundbreaking litigation throughout the country. I opened the firm to continue this work and to develop a team with the same level of devotion that I bring to this representation. The firm has rapidly grown to seven lawyers, with expertise in every area of employment and consumer law, as well as significant trial experience.

Previous Employment Summary

Following law school, I was an associate at Leonard, Street & Deinard from 1988 to 1993, an associate at Sprenger & Lang from 1993-1995, and a partner/owner of Sprenger & Lang from 1995-2005. I was Managing Partner at Sprenger & Lang from 2000-2003. I joined Mansfield, Tanick & Cohen as Of Counsel in September 2005 and also opened my own law practice, the Schaefer Law Firm, in order to be free to pursue any worthwhile class or individual case throughout the country, on my own or through "Co-counsel" relationships with other lawyers.

Activities and Awards

I have lectured and published extensively in the employment area, training lawyers on all aspects of class action litigation, discrimination developments, jury selection, maximizing damages, sexual harassment and expert witnesses.

I have also been selected for inclusion in the annual publication of Woodward/White's The Best Lawyers in America from 2002 to the present, and have been named a Minnesota Super Lawyer in 2003 and 2004.

What is your opinion regarding clients educating themselves on legal issues?

I welcome my clients educating themselves on legal issues, and encourage them to take an active role in assisting us with the prosecution of their case. I want my clients to be fully informed and as committed as the firm to securing a just result.

Are you willing to review documents prepared by clients?

I'm always willing to review documents prepared by clients, and often seek to have them prepare factual summaries that are necessary for the firm attorneys and staff to fully understand their case.

Are you willing to coach clients who want to represent themselves?

I am not willing to coach clients who seek to represent themselves. If I am going to commit to representation, I have to control the level of advocacy in the case.

Why did you decide to be a lawyer?

I decided to become a lawyer because I wanted to be an advocate for employee rights. Good employees invest so much of themselves into their work. When this isn't valued appropriately, or when discrimination infects decisions affecting their career, this has a devastating consequence, for the employees and the company. My work involves repairing this damage and ensuring that it doesn't occur in the same way in the future.

What work experience and education helps you be a better lawyer?

My clinical experience in law school taught me how to connect with clients, to really listen to their concerns and get to the heart of how their rights had been violated. I was also a hearing representative in the unemployment compensation area, conducting hundreds of "mini-trials" that were critical to the development of my trial skills.

Why did you decide on your primary area of practice?

I was drawn to employment law because it has a real impact on people's rights. I wanted to represent employees because their voices are too often ignored in our legal system. With a focus on employment and consumer law, I knew I could develop the expertise necessary to have a real impact.

What do you like best about your career?

The privilege of advocating and securing justice for someone whose rights have been violated by a large corporation is always an incredibly satisfying experience. To assemble and work with a team of legal experts who have the same degree of commitment to this work is also rewarding.

Tell us about your law firm:

In just over two years, the firm has grown to seven lawyers and five support staff. This growth is a testament to both the demand for our services and the success we have achieved. Our commitment, expertise and results demonstrate that we are the best choice as advocates for any victim of illegal workplace or marketplace conduct.

What are your strengths and style?

My primary strength as an advocate in this area is my depth of experience in all aspects of employment law, and my track record in this field. I have prosecuted numerous ground-breaking class action cases in this field, and have never lost an individual case which I've litigated to judgment before a jury. My style is aggressive and thorough, yet respectful. Opposing counsel knows that I will leave no stone unturned in advocating for my clients and that I am always prepared to try a case to judgment when necessary. They also know that I will engage them whenever a "window of opportunity" arises to discuss possible settlement, so long as the proposed resolution represents a reasonable compromise for all sides.

Personal Interests:

My personal interests include active involvement in the "peace education" movement for adolescents (through an organization that I run called the Lake Country Institute), bicycling, hiking and camping with my 8-year-old daughter, Linnea, as well as painting (watercolor and oils) and carpentry.

Hourly Rates

My hourly rate is $375 for individual work, $475 for class action work.

Free Initial Consultation?

We do provide a free initial consultation, usually via telephone.

Typical Retainer

I don't offer fixed price fee arrangements. Typical retainer is contingent fee (at one-third or 40%, depending on the nature of the case and the client's ability to pay costs. There is also usually a modest initial retainer fee to cover costs (amounting to $1,000 - $3,000, depending on the nature of the dispute). Per diem representation is also available, at standard hourly rates.
