I handle both consumer and small business cases. I limit my practice to Chapter 7 and Chapter 13 cases. I also represent a few creditors in bankruptcy related matters.
Significant case: TNB Financial Inc. v. James F. Parker Interests 243 F.3rd 228 (5th Cir. 2001)
TNB Financial involved the issue of who was going to be financially responsible for the disposal of hazardous waste left over after an automobile engine rebuilder went bankrupt and left a tremendous amount of contaminated oil for the landlord to clean up before he could release the property. I represented the creditor who held the lien on the equipment and the landlord wanted our collateral sold and the proceeds used to pay for the clean up. On appeal, the Fifth Circuit found that my client was not responsible and the landlord had to foot the bill for clean up of the hazardous waste oil.
Husband and wife are both employed and have 2 children at home. Husband has a stroke and cannot go back to work and is declared disabled. Now, they have all of their credit card, mortgage debt and auto debt that they are still responsible for but have about $2000 less a month to pay it with along with over $100k in medical bills from the stroke and the rehab process. The bankruptcy will eliminate the medical bills and the credit card debt, stop the harassment from creditors and leave them in a position to pay off their house and vehicles and try to be as normal a family as they can.

I have been licensed to practice law since 1979. I began practicing bankruptcy law in 1984. By 1987 I had decided that I would practice bankruptcy law only. I continue to practice bankruptcy law exclusively. I am a Board-Certified Consumer Bankruptcy Attorney who assists individuals and small businesses file for bankruptcy relief.
I have been a sole practitioner since 1990. Prior to that, I was a partner in a multi-city bankruptcy firm. I also worked at several other firms prior to that time. I also operated a non-law related business for three years in the early 1980's.
