What is your opinion regarding clients educating themselves on legal issues?

I like my clients to be prepared and knowledgeable. The more a client is aware and understands what attorneys do, the better the attorney-client relationship.

Are you willing to review documents prepared by clients?

If clients bring in documents they've prepared for us to use in their case, that's fine.

Are you willing to coach clients who want to represent themselves?

No. It may violate terms of the current statute. I can't coach anyone to file a case.

Why did you decide to be a lawyer?

I've always enjoyed helping people and doing bankruptcy work is one way I can do that. It's not the most expensive area of law and it's not glamorous, but it's necessary work. One thing I've always said is that my clients usually leave here happier than when they came in.

What work experience and education helps you be a better lawyer?

It's something I do every day. We do only bankruptcy work. I've represented more than 30,000 people in my career. I've been doing this work for 32 years. I got Board certified as soon as Tennessee offered Board Certification for attorneys in 1994.

Why did you decide on your primary area of practice?

It was serendipitous. When I got out of law school, I thought I was going to do research and worked for the Tennessee legislature for a year. After that, I worked for the Lawyers Cooperative Publishing Company in New York. This company purchased a code service from another company and decided that Congress would never get around to doing anything about bankruptcy law. I began to work on the bankruptcy law of 1898 and finished my work there in September, 1978.

I moved back to Nashville and two months later, Congress passed the Bankruptcy Code. I met Keith Lundin, who was the Chapter 13 Trustee and then 4 years later became the judge and he referred some bankruptcy cases to me. In 1978, I was one of the first lawyers in Tennessee to advertise. I was appointed by the Board of Professional Responsibility to administer a disbarred attorney's open cases and this led to more bankruptcy cases. By 1983 I was doing nothing but bankruptcy.

What do you like best about your career?

I like that I can help people to save their homes and cars, etc. I get a lot of gratitude from this work, more than other areas of law. I represent vulnerable clients and we try to give them every advantage we can.

Tell us about your law firm:

I am the managing partner of Rothschild and Associates. My associate David Nave and I are certified as specialists in bankruptcy law. Our experience offers clients skilled legal services in a complicated area of law. We are able to address clients' concerns related to new bankruptcy laws, homestead exemptions, and other issues.

We offer responsive representation to individuals during stressful times. We strive to ensure bankruptcy relief meets our clients' objectives and encourage clients to be involved every step of the way.

What are your strengths and style?

I'm compulsive about getting my work completed. I don't leave until I have all my calls done. I think it's important to make sure that all clients are treated with respect. We serve them.

Personal Interests:

I'm a bicyclist. I love to take cycling vacations and I've taken a number of national and international biking trips.

It varies depending on the complexities of the case. The range for Chapter 7 Consumer cases is $800 - 1,500. For Chapter 13 Consumer cases the range is $1250 -$3000.
