Example Cases

I have successfully handled securities fraud litigation, financial crimes, money laundering, arms dealing, foreign corrupt practices violations, business loss, homicide, sex crimes, conspiracy, and narcotics offenses. I was U.S. counsel in a case at the International Criminal Tribunal for the Former Yugoslavia in the Hague. I regularly consult with lawyers from throughout the world and represents the interests of businesses and individuals.

We were retained by a prominent businessman from California who was questioned by the FBI relating to an international bribery investigation which involved a high ranking foreign government official. After a lengthy investigation by our office and the pre-indictment presentation of compelling evidence to the Government we were able to convince the Prosecutor that our client was not the correct target of their interest, the investigation was re-focused on other individuals and the case against him was abandoned.

A physician came to us after being contacted by the FBI. The Agents insisted that the physician was involved in a kick-back scheme involving his prescription activities. After a thorough examination of all of the evidence, including several videos of our client interacting with the undercover pharmaceutical representative, we presented our legal analysis and findings and conclusions to the Government and successfully argued that no case could be proven against our client. The case was dropped.

Previous Employment Summary

In 1991, while also managing my own criminal defense practice, I was instrumental in starting the Manhattan School for Children, an award winning public school in New York which both of his children attended. In 1992, I helped found the first Institutional Review Board (IRB) to review clinical research proposals for their ethical impact on participants at Gay Men's Health Crisis in New York City. In 1994, I completed post-graduate work in Medical Bio-Ethics and the Humanities at the Columbia College of Physicians and Surgeons and Einstein School of Medicine.

In 1996, under contract to the City of New York, I built a new public defender's office in The Bronx known as The Bronx Defenders, and thereafter supervised 25 lawyers and the necessary support staff to handle 13,000 cases per year.

Thereafter, I started Arsahck, Hajek & Lehrman.

Activities and Awards

I was elected President of the New York State Association of Criminal Defense Lawyers in 2007. I am AV-Rated by Martinadale-Hubbell. In addition, I am the elected representative of the National Association of Criminal Defense Lawyers (NACDL) to the Council of the International Criminal Bar (ICB), a member of the Board of Directors of the International Criminal Defense Attorneys Association - USA (ICDAA), and Co-Chairman of the International Committee of the NACDL and a member of the Board of New York Sun Works.

What is your opinion regarding clients educating themselves on legal issues?

I always encourage my clients to be active participants in their own defense. None cares more about the client's case than the client...I come in at close second.

Are you willing to review documents prepared by clients?

I generally ask my clients to prepare certain documents such as chronologies. Any material that a client prepares, I will review, although I will retain the right to decide what gets filed and what does not.

Are you willing to coach clients who want to represent themselves?

In a criminal case, self representation is nearly always a huge mistake and I will not participate in a process which I believe is detrimental to a client's best interests.

Why did you decide to be a lawyer?

In my first years out of college I worked at a think-tank in Cambridge Massachusetts studying social science issues. After several years I felt the need to leave the Ivory Tower and get my hands dirty...there was no turning back.

What work experience and education helps you be a better lawyer?

Raising my children and being as good a father and husband as I can be has provided the best education for my work.

Why did you decide on your primary area of practice?

I like representing the underdog. Being David to the Government's Goliath is appealing.

What do you like best about your career?

The satisfaction of knowing that my advocacy makes a difference in a person's life.
