I attend continuing legal education seminars on Bankruptcy, Immigration and Estate Planning.
I handle Chapter 7 and Chapter 13 Bankruptcies. Bankruptcy can afford different types of relief for various circumstances. For instance, clients' wages can be garnished or a lien can be placed upon their bank accounts in order to satisfy a creditor's judgment. The filing of the bankruptcy will stop a wage garnishment as well as prevent a creditor from placing a lien on any accounts in the debtor's name. A bankruptcy filing will also stop a foreclosure proceeding by allowing the debtor to repay the mortgage company all monies owed to them over a period of time. As long as a bankruptcy petition is filed prior to the sheriff sale date, a home can be saved from foreclosure. Sometimes, all debtors require is the chance to recover from a financially difficult period of time.

Since there are many intricacies associated with the practice of law, coupled with the fact that the bankruptcy laws have changed drastically over the past few years, I would caution against pro se filings. Filing a bankruptcy petition without proper representation by an attorney of the relevant jurisdiction can expose a debtor to a complex and damaging situation if certain exigencies exist.
