Many people are financially strapped in these troubled times. They may have credit card debts, overwhelming medical bills, a business that failed, or have a house that is worth less than what is owed on it. These problems may be compounded by a job loss or an injury or accident. Filing for bankruptcy protection under either Chapter 7 or Chapter 13 may be the best option in such cases.

Chapter 7 is a relatively quick process lasting several months that is designed to provide freedom from unsecured debts such as credit cards, medical bills, payday loans, and personal loans. It is sometimes called "liquidation" because the bankruptcy trustee appointed by the court has the option of selling or liquidating any non-exempt assets in order to partially repay creditors. However, liquidation doesn't actually happen often. Many people who file Chapter 7 bankruptcy do not have any non-exempt assets and are able to keep all of their property.

Chapter 13 offers a plan of reorganization of debts payable from earnings while under the protection of the bankruptcy court. It can last from 3 to 5 years. Chapter 13 can stop a foreclosure and allow a debtor to catch up on mortgage payments, or protect property that might be lost in a Chapter 7 case. Under certain circumstances, a second mortgage or home equity line of credit on a property may be reduced to unsecured debt, commonly called lien stripping.

My office can help with both kinds of bankruptcies. I personally handle all cases. Unlike many law firms, I do not hand the matter over to a paralegal or assistant.

I charge a flat fee depending upon the size and complexity of the case. My fees for a Chapter 7 begin at $1,200, and for a Chapter 13 at $3,600. My office also accepts Visa, Mastercard and Discover credit cards.

I offer a free one hour initial meeting. Thereafter, my hourly rate is $250 and if the case proceeds, the hourly fees will be credited towards the flat fee.
