Perhaps the single most important aspect of any divorce is custody and visitation of the children. There are two types of custody, legal and physical. Legal custody relates to the decision making ability of the parent. Physical custody means that the child lives with that parent and the parent is responsible for sheltering and sustaining the child.
Sole custody means that one parent makes all the decisions for the child relating to health, education and religion and also has physical custody of the child. Joint custody means that both parents make decisions together and the child spends time in both households. It is also possible for one parent to have sole legal custody, but for parents to have joint physical custody through liberal rights of visitation.
New York courts tend to award joint custody in instances where both parents can work together and cooperate in order to make decisions that are in the best interests of the child. In situations where parents do not get along or harbor hostility towards each other, courts will more likely award sole custody to one parent. Statistically, sole custody is awarded to the mother in about 70% of cases, 20% of cases end up in a joint custody arrangement and in about 10% of cases, sole custody is awarded to the father.

If no settlement is reached, the divorce moves into the next stage, called the discovery stage, where both parties exchange information. Mrs. Rubin was born in Odessa, Ukraine. She holds a Bachelors Degree in Business from Pace University and earned her Juris Doctorate from Touro College, Jacob D. Fuchsberg Law Center. After graduation from Pace, she worked as a marketing executive in various aspects of the financial services industry with a primary focus on assisting clients with financial and estate planning including all aspects of real estate, long term strategy, wealth management and business administration. Mrs. Rubin was honored with the opportunity to work for the financial arm of the Israeli treasury in this capacity. Recognizing the natural connection between financial services and the law, Mrs. Rubin decided to pursue a legal education. While attending law school, she was honored with the CALI Award for Excellence in Federal Taxation.
