Example cases

Represented Plaintiff in personal injury forklift accident. Plaintiff was a semi-truck driver and went to Defendant's location to transport a load. While on location, Plaintiff utilized a forklift to "help" Defendant employees load his trailer. Whether a result of a malfunction or inability to operate this particular fork truck, the forklift would not stop and a crash ensued. Injuries and damages included severely fractured leg, inability to work remaining 10 years of work life expectancy, inability to utilize leg as fully functional and loss of quality of life. Jury Verdict: 40% Plaintiff 60% Defendant. Total Damages $700,000 for a resulting Verdict of $420,000 to Plaintiff.

Bankruptcy Client received Chapter 7 Discharge after litigating the Means Test calculation where the U.S. Attorney's Office sought to exclude certain expenses from the Means Test longform calculation in the Northern District of Indiana. Clients came to Wischmeyer Law Office knowing their situation was complicated and knowing that it would take an attorney willing to fight for his clients to receive their fresh start. Although most cases do not require litigating Means Test issues or other issues, it was invaluable and appreciated by the Client to know Jason fought for what was in their best interest; rather than force them into a bankruptcy mill's "typical" format and not receiving the Chapter 7 discharge they needed.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

This depends on the client, type of case and part of the case the client wants assistance. Particularly in litigation cases, there can be an advantage to a client having the attorney involved early in the process; rather than just handle the trial alone to insure that the case strategy and workup are consistent with what may be necessary to provide a client with his/her/its best option for trial and case success.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

All legal work is divided between the attorney and paralegal assigned to the case and any outside vendors or experts to insure the most cost efficient representation allowing the client's legal work to be performed by the lowest billable rate capable of providing the legal work necessary for the client's case.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Mediation, arbitration and collaborative law are utilized any time that these litigation alternatives will assist a client with resolving his/her/its case cost-effectively, more quickly and within the client determined determination of a successful outcome.

Does your firm provide pro bono legal services or otherwise participate in your community?

Yes. We have provided some pro bono legal services and our office has been very active in the charity and community service organizations in Shelby and Marion County, Indiana.

Wischmeyer Law Office supports clients educating themselves prior to hiring an attorney; however, cautions clients that there are many nuances in the law that might affect how the law applies to their legal issue and it is important to give their attorney all the informaiton applicable to the Client's case not just what the client believes to be important as a result of their own legal issue education.

Jason Wischmeyer

A graduate of Indiana University School of Law in 2002 and the Kelley School of Business in 1999, Jason Wischmeyer represents small businesses, large corporations, and individuals in a variety of legal matters throughout Indiana. Jason advises clients to avoid disputes and litigation; however, he has proven to be a skilled trial attorney having litigated and successfully tried several jury trials and bench trials in the state and federal courts of Indiana. In 2009, Jason left a regional litigation law firm to form Wischmeyer Law Office - a law firm that works collaboratively with its client for mutual success and growth offering a variety of fee structures. Outside of the law firm, Jason enjoys time with his family and has been active in various community organizations including Girls Inc., Rotary Club, serving as a Court Appointed Special Advocate (CASA) and providing counsel and campaign advice in the world of politics.
