Medical Malpractice

Kentucky Medical Malpractice Defense Attorneys

Malpractice defense for healthcare professionals and facilities
At Wellman, Nichols & Smith, PLLC , we provide medical malpractice defense to medical professionals, hospitals and insurance companies throughout Kentucky and parts of Tennessee. Our firm has built its reputation on principles of honesty, integrity and communication.
With more than 75 years of combined experience, the attorneys at Nichols, Smith & Wellman, PLLC defend medical professionals in all types of medical malpractice in Kentucky and Tennessee, including:
Medical malpractice
Hospital liability
Dental malpractice
Nursing negligence
Nursing home liability

Medical malpractice
Each day, physicians carry out their jobs with the knowledge that the procedures they perform may not achieve intended results. When results do not match expectations, victims and their families often look for someone to blame. We understand the impact that a claim of malpractice can have on the individual involved and we are there to help the physician as well as defend against the lawsuit.
Our attorneys have a proven track record of success defending these cases and have earned a reputation as tenacious advocates among other counsel and judges across the Commonwealth. We routinely work with quality experts to review the cases and fully prepare our clients for deposition and trial. We are proud that medical malpractice defense is the primary focus of our law firm.

Hospital liability
Hospital defense requires an understanding of theories of liability that sometimes differ from the theories of medical malpractice. Knowledge of the current issues and theories of defense is imperative to obtain a favorable result for the hospital and its insurer. Our attorneys have decades of experience successfully defending hospitals in cases involving professional negligence, premises liability, credentialing, EMTALA and vicarious liability.

Dental malpractice
Dentists and oral surgeons are coming under increased scrutiny as dental procedures become more complex and invasive. Dental implants, root canals, crowns, cosmetic dental procedures and even routine cavity filling can become the basis for dental malpractice claims. Dentists and oral surgeons have many of the same issues and concerns as physicians, but it is important to have an attorney familiar with the terminology, the procedures and the unique challenges presented by dental malpractice as well. The attorneys in our firm have successfully defended dentists and oral surgeons for many years, and we are the exclusive choice statewide for some dental and oral surgery insurers.
At Wellman, Nichols & Smith, PLLC , our legal team works hard to effectively defend dentists, oral surgeons, periodontists, endodontists, orthodontists and other dental professionals against frivolous malpractice claims.

Nursing negligence
Nurses, nurse practitioners and nurse anesthetists have increasingly found themselves the target of malpractice claims. Most are going through the process for the first time. Our attorneys understand the needs of these practitioners and we have successfully provided representation to nurses of all kinds in various settings for many years.

Nursing home liability
Allegations of nursing home abuse and neglect are serious and should be treated accordingly. Signs and symptoms can be misinterpreted by family members and lead them to wrongly believe their loved one has been abused or neglected. As a result, nursing homes, the individuals who own or operate them and even the employees of a nursing home may find themselves facing groundless claims of nursing home malpractice.
With so much at risk, it is imperative to have representation by attorneys who have an understanding of the statutes, regulations and theories of liability that are unique to the operation and defense of nursing homes. Our attorneys have the knowledge and understanding to defend these challenging cases.
