Product Liability

Manufacturers, distributors, merchants, and resellers have a responsibility to manufacture products free from defects and problems which render the product unreasonably dangerous to consumers and their families.

Unfortunately, thousands of injuries and deaths occur each and every year due to faulty and defective products.

The key to proving liability in an Indiana product liability case lies in determining whether or not a product is defective and the probability of an accident occurring given regular, reasonable use of the product.

If a person dies due to faulty or defective products, a wrongful death case may be filed. Remember your time is limited to file such a claim. The statute of limitations is two (2) years from the date of the injury, so it is important to file your claim immediately.

Also, in product liability claims, there is a statute of repose. This separate time limit prevents an injured party from bringing a product liability claim if the product in question is older than ten (10) years. However, there are exceptions to this rule, such as when the manufacturer alters the product within ten (10) years. There are many types of product defects that can result in liability for manufacturers and suppliers. Below is a list of some of those product defects:

-Design Defects: A product contains a design defect if the design of the product is unsafe. One example would be if a coffee cup is designed such that the bottom melts whenever a hot liquid is placed inside it. Design defect cases often require proof of an alternative design that is safer and economically feasible. When injuries result from a product with movable parts such as on-the-job amputations in industrial equipment accidents, the alleged design defect is often the failure to include a guard or emergency stop button.

-Manufacturing Defects: A product has a manufacturing defect if the product's design is sound but the production process results in an unsafe product. As an example, if a desk is assembled at a factory without several screws as required in the design blueprints, it possess a manufacturing defect.

-Warning Defects: A manufacturer has a duty to warn the user of reasonably foreseeable dangers associated with the use of the product. If a product does not have sufficient instructions or warnings about its use or the dangers potentially associated with its use, and an injury results, the product has a warning defect. For example, if you purchase a lawnmower that does not have safety warnings in regards to cleaning the discharge shoot, and the blade cuts you when you are cleaning the discharge shoot, then there could be a warning defect.

Many product liability cases involve a combination of all three of the above. The old saying among design engineers is, first, design away the danger; if you can do that you guard against the danger; if you can not do that, warn of the danger.

*A Note about Medical Negligence
Medical negligence refers to the failure of a physician, medical professional, hospital or other medical service provider to meet the standards of conduct relating to their profession. The standards of conduct are based on what a medical professional with requisite training and skills would ordinarily be expected to do. Some states, including Indiana, have imposed laws that cap or limit the maximum amount of money an individual can recover in a medical malpractice suit. Stephen Wagner

Stephen M. Wagner grew up in Indianapolis and attended Brebeuf Jesuit Preparatory School where he graduated as co-valedictorian in 1987. Mr. Wagner graduated cum laude from the University of Notre Dame in 1991 with B.A. in Politics, Philosophy, and Economics and received his J.D. cum laude from the Indiana School of Law Bloomington in 1994. After being accepted to the Attorney General's Honors Program, Mr. Wagner worked for the Department of Justice in 1994-1995 as staff counsel for the Federal Bureau of Prisons in Philadelphia, Pennsylvania. In 1996 Mr. Wagner returned to Indianapolis to practice with the firm of Riley Bennett & Egloff where he worked primarily in the area of insurance defense litigation.

In June, 1997 Mr. Wagner left Riley Bennett, and the defense bar, to found the Wagner Law Firm, P.C., where he practices exclusively in the areas of plaintiff's personal injury, worker's compensation, civil rights, class action litigation and medical malpractice. In June, 2000, Mr. Wagner joined Jason R. Reese to form Wagner Reese, LLP, a firm dedicated to representing injury victims throughout Indiana and nationwide.

In 2004, 2006, 2007, 2008, 2009, 2010, 2011, 2012, and 2013, Mr. Wagner was selected by his peers as an "Indiana Super Lawyer", an award presented to the top 5% of practicing attorneys in Indiana as published in the Indianapolis Monthly and Super Lawyer magazines. Jason Reese

Jason R. Reese has devoted his entire legal career to representing victims of personal injury, medical malpractice and wrongful death claims. Mr. Reese was born in Davenport, Iowa and grew up in Northwest Indiana. He attended the University of Arizona on academic scholarship and graduated at the top of his class magna cum laude.

Mr. Reese received his law degree with honors from Indiana University School of Law--Bloomington in 1997. During law school, he clerked for the Cook County State's Attorney's Office - Felony Trial Division in Chicago, Illinois.

After law school, Mr. Reese first practiced with a prominent Lake County law firm, concentrating in the areas of personal injury and professional malpractice litigation. He also volunteered pro bono for the U.S. Federal Public Defender's Office defending Spanish-speaking criminal defendants. Mr. Reese was also elected to the Board of Directors of the Lake County Bar Association.

In 1998, Mr. Reese moved to Indianapolis and, since then, has successfully tried several personal injury cases to juries and judges in various counties throughout the State of Indiana. He is currently a member of the American Association for Justice and serves as an elected member of the Board of Directors for the Indiana Trial Lawyers Association. For several years, Mr. Reese participated in the prestigious American Sagamore Inn of Court as a Barrister member. He also serves on the Executive Committee of the Indianapolis Bar Association Litigation Section.

Mr. Reese is involved in several pro bono and community activities in the Indianapolis area. He serves as President of the Board of Directors for Centerpoint Counseling, a not-for-profit organization that provides free counseling services to family and children in Marion County. He is a member of the Westminister Legal Services team and serves on the Board of Directors for the Neighborhood Christian Legal Clinic. The clinic is a faith-based, non-profit organization that provides critically-needed legal services to over 10,000 low-income Hoosier families per year.

At the 2003 annual Indiana State Bar Association convention, Mr. Reese was recognized as the "Outstanding Young Lawyer of the Year" for his excellence as a lawyer committed to his profession and the community. Mr. Reese has been repeatedly named an Indiana Super Lawyer and was recognized by attorneys throughout the State as a lawyer in the top 5% of his practice areas as recently published in Indianapolis Monthly and Super Lawyer magazines. In 2007, Mr. Reese was name "Forty Under Forty" by the Indianapolis Business Journal as one the most dynamic business and community leaders in the Indianapolis metro area.

Mr. Reese recently obtained a $1.1 million jury verdict in Richmond, Indiana on behalf of a mother that lost her baby due to alleged medical malpractice. The defense never made any settlement offers.

Mr. Reese has handled high-profile cases and has been interviewed by Indianapolis affiliate stations for NBC, CBS, ABC and Fox networks. Mr. Reese and his partner Steve Wagner have been aggressively serving clients together throughout Indiana and Nationwide for more than a dozen years. Enrique Flores

Enrique Flores Jr. was born in California, raised in Texas, and attended The University of Texas at El Paso where he majored in History and Spanish. He was part of a team that was awarded Best Team for the Model Organization of American States in 2003. The team was also recognized by the Texas Legislature in Bill 78(R) 1753. Mr. Flores received his Juris Doctorate from the Indiana University McKinney School of Law in 2007.

Before joining Wagner Reese, LLP, Mr. Flores practiced at Schiller Law Offices, LLC and was a law clerk in the Medical Licensing Section of the Consumer Protection Division of the Indiana Attorney Generals Office. Mr. Flores is admitted in the Southern District of Indiana and the Supreme Court of Indiana. He is a member of the Indiana State Bar Association and its Latino Affairs Committee, as well as the Indianapolis Bar Association.

Mr. Flores has a long history of and commitment to philanthropy and community involvement. While obtaining his Juris Doctorate, Mr. Flores taught Spanish at inner city Catholic schools. He has met with members of the Hispanic community for free consultations at local churches, and regularly attends Hispanic community events including Indy Expo and Fiesta Indianapolis. Mr. Flores has volunteered for the Archdiocese of Indianapolis to assist current Resident Aliens apply for Naturalization. Mr. Flores also volunteers as a Judge at Reach for Youths Teen Court.

Judy Pippin

Judy Winn Pippin was born and raised in Muncie, Indiana. Ms. Pippin received her B.S. at Ball State University in 1988. She attended Ball State on a local academic scholarship.

Ms. Pippin received her J.D. from Indiana University Robert H. McKinney School of Law at Indianapolis in 1992. In the summer of 1990 Ms. Pippin attended a semester of law school in Shanghai China as part of the international studies program. In 1991, Ms. Pippin became the Associate Articles Editor of the Indiana International and Comparative Law Review. She has published two articles, one in the International and Comparative Law Review, entitled "The Ancient Chinese Secret: A Comparison of Chinese and American Mediation" in 1992. Ms. Pippin's second article was published in the 1997 Indiana Law Review, entitled "Recent Cases in Worker's Compensation Law".

Ms. Pippin is a member of the Indianapolis Bar Association, where she has served on the Women in Law Executive Committee for the past five years, and the Indiana State Bar Association where she serves on the Pro Bono Committee. She is admitted to practice law in the State of Indiana, the United States District Court for the Southern and Northern Districts of Indiana.

Ms. Pippin is a former Deputy Attorney General where she defended State Agencies in Worker's Compensation cases as well as represented the Worker's Compensation Board's Second Injury Fund. She has practiced with the firm of Riley Bennett & Egloff, and Meridian Insurance Company, primarily handling personal injury and worker's compensation cases. In November, 2003, Ms. Pippin began working with Wagner Reese, LLP. Ms. Pippin focuses on worker's compensation cases.

Jonathan Armiger

Jonathan T. Armiger grew up in Indianapolis and attended the Kelley School of Business at Indiana University, Bloomington, receiving his B.S. in Marketing in 2007.

Mr. Armiger graduated cum laude from Indiana University Maurer School of Law in 2011. While in law school he served on the Indiana Law Journal as an Associate and Notes and Comments Editor and participated in the Sherman Minton Moot Court Competition and Trial Competition. While in law school, Mr. Armiger interned for the Marion County Public Defender Agency.

After obtaining his Juris Doctorate, Mr. Armiger worked as an associate attorney for a personal injury firm for several years, then opened his own practice, Armiger Law. He joined Wagner Reese, LLP in 2014.

Mr. Armiger is licensed to practice law in Indiana, including the U.S. District Courts for the Northern and Southern Districts of Indiana, and is a member of the Indiana State Bar Association, the Indiana Trial Lawyers Association, and the Indianapolis Bar Association.

Mr. Armiger lives in the Indianapolis area with his wife and two daughters. He enjoys spending time with his family and friends and attending community events.
