Firm Overview

VanderWoude & Roma, PLLC is a law firm which specializes in matrimonial and employment matters in Westchester, Putnam, and Dutchess Counties in New York. Our office is conveniently located off I-84 and the Taconic State Parkway.

Our firm prides itself on providing a comprehensive legal approach to its clients. We feel that it's our responsibility as "counselors" to not only zealously advocate for you but to consider how your case will affect you emotionally and financially long after it is concluded. Because no two clients are the same, this approach allows us to accurately evaluate each client independently and chart the best course of action tailored to their specific needs.

The path to a successful outcome for our clients starts with an open line of communication. It's imperative to our representation that you not only understand the various stages of your case, but are an active participant. We treat each case with the personal care and attention it deserves, keeping our clients informed throughout the entire process and encouraging them to call or email us with any questions or concerns they have.

Along with the emotional stress associated with divorce or any other legal matter, is the added worry of how to pay for an attorney. VanderWoude & Roma believes that exceptional legal representation should be affordable to all. We charge reasonable hourly rates, and in some cases, we are even able to get a portion of your legal fees paid for by the other side. We will work with you no matter what your financial situation to ensure you are represented by an experienced and caring attorney who is looking after your best interest instead of accumulating excessive "billable hours."

How did your firm decide on the primary area of practice(s)?

V&R specializes in matrimonial, employment and construction matters. We handle other areas of law, but our concentration and major caseload is in those three areas.

Matrimonial
When Neil began his law practice, it was pure happenstance that a majority of the first cases through the door were matrimonial, but it evolved into a good fit. The legal side of matrimonial law requires patience, math skills, and a requisite ability to separate signal from noise. Clients often display a healthy mix of anger, shock, and fear. Divorce attorneys need to sift through the rubble in order to help clients rebuild. When Jerry joined the firm, and then after him Rachel, they also exhibited the compassion necessary to sustain a divorce practice. V&R has developed a set of strategies that are focused on helping the client manage emotions and expectationshelping mothers who have been out of the workplace to plan their reentry, helping fathers to even out and apply broader parenting skills. No good matrimonial attorney leaves his or her business at the office. It is a conscious and often introspective decision to remain in the practice of matrimonial law; it is an emotionally draining specialty. What keeps us in the mix is the successful transition of our clients into new lives and some sense that we have avoided unnecessary damage. We are particularly gratified when clients are able to co-parent and their children prosper.

Employment Law
We came to employment law because we root for the little guy. Invariably employment cases pit a single unprepared worker against a company who has the records, the money, the power, and the means to intimidate other employees. Attorneys are not always available, and these clients can rarely pay up front. The laws seem clear and protective, but the Courts do not make it easy. Since the passage of these laws, there are strings of cases which make it increasingly more difficult for plaintiffs to prevail. Surviving motions to dismiss and motions for summary judgments is an ordeal. Suing large companies and sometimes state agencies is also often a David and Goliath storyyou just have to be good with a slingshot.
We pursue cases under the Fair Labor Standards Act (FLSA), under the Family Leave Medical Act (FMLA), under Title VII and 1983 civil rights laws, and for Workers' Compensation and unemployment. These events are often catastrophic for our clients, leaving month to month income people with no mortgage money, no health insurance, and little spirit to continue. As with divorce, losing a job is rated as a top-five traumatic life event. People often judge their worth by their employment, which puts the employer in the disproportionately powerful position of not only shutting down their finances but shutting down their pride as well. Often, we do this work, because we know that we are the last resort.

Construction Law
The path to construction law was clearly marked by Neil's and Jerry's previous experience. Neil was a design-build contractor and Jerry is from an electrical contracting family and also worked for years as a general contractor. Both are familiar with the issues facing contractors, both big and small.
This is, once again, often the story of big versus little, of architects, owners, or even general contractors taking advantage of hard-working men and women whose first goal is simply to do good work.
Many of these small contractors are experts in their fields, but they are not equipped to navigate the complex and overwhelming paperwork requirements. At some level, V&R wants the small company craftsmen to be able to pay attention to their work while we help them manage the bureaucratic issues.
