At Van Der Walde & Associates, we practice only personal injury law. Our focus only on personal injury law, combined with over 20 years industry experience, have enabled us to become leaders in the field. Our fee is 33 1/3 % of the recovery if the case settles before a complaint is filed and litigation commences; thereafter the fee is 40%.

$395 per hour for Paul Van Der Walde; $275 for Eva Silva or any contract attorney.

Paul D. Van Der Walde is the firm's trial attorney and is responsible for managing all cases at the firm. Associate attorney Eva Silva has been at the firm for more than 8 years and does the majority of legal research and writing, including assisting with trial work. Paralegals Julia Valencia and Edlina Melehan keep the firm running and are responsible for calendaring, scheduling, obtaining all necessary documentation to support claims for damages, and preparing legal pleadings as well as correspondence. Irma Rodriquez rounds out the team as the firms number cruncher and administrative assistant.

Unless a case is settled by demand and offer, almost every case involves some form of dispute resolution.

What is your firm's point of view regarding clients educating themselves on legal issues?

They should educate themselves by hiring a lawyer that they trust to analyze and explain the legal issues presented in a case. Otherwise, the information that can be found online is only as good as the person who provided the information, they and may not be qualified, or able to discuss the legal issues appropriately.

No, we are personal injury litigation attorneys only.

Paul D. Van Der Walde

Paul Van Der Walde received his Doctorate in Jurisprudence in 1993, and went into practice as a defense attorney for a local insurance defense firm. After spending a year watching insurance companies take advantage of plaintiffs, Paul joined a Bay Area civil litigation practice and specialized in helping plaintiffs in personal injury cases. He became a partner of Cornell & Van Der Walde Law in 1995, and in 1997, Paul founded Van Der Walde & Associates. For the past two decades, Paul has tried cases in Santa Clara County courtrooms, where he has become a known face to judges, attorneys and legal professionals.
