Unlike some estate planning attorneys, however, they can also guide you through and demystify the probate process after a person has died. Estate planning is the process where consideration is given to making sure that a person's assets are distributed in accordance with their wishes after death and minimizing or eliminating potential estate taxes and other expenses. Included in the estate plan are usually a Will, a General Durable Power of Attorney, a Living Will, a Health Care Proxy, and, in certain instances, a Trust.

It is extremely important to have the guidance of an experienced and knowledgeable estate planning attorney when drawing up these documents. Probate is the process where the will of a person who passed away is filed with the Surrogate's Court with other required papers. The Surrogate's Court will then grant a decree declaring that it was, in fact, the person's valid Last Will and Testament and giving the named Executor the authority to act on behalf of the estate.

The probate process can be complicated with numerous legal requirements. For example, petitions, inventories, and accountings need to be filed. Negotiations with creditors may occur. Tax returns may need to be filed. Finally, assets may need to be sold and ultimately will need to be distributed properly and timely to beneficiaries. Therefore, it is a good idea to seek the assistance of an experienced attorney in this area.

Karen DeFio

As a Partner and Consult Attorney at Tully Rinckey PLLC, Karen brings substantial New York State and Federal Trust and Estate Law experience. She performs initial consultations for a wide range of legal matters, including those relating to trusts and estates, Federal and New York Estate and Income Tax, Business succession planning, Medicaid planning, probate and estate administration and litigation. Karen also practices in the areas of Creditors' Rights, Real Property and Corporate Law.

With nearly two decades of legal experience, Karen combines her vast and varied knowledge in estate planning, tax planning, Medicaid planning, special needs planning, corporate law and real estate law to determine the best, specifically-tailored plan for her clients. Each plan takes all of the client's necessary and relevant considerations and priorities into account in order to construct an effective strategy that makes the most sense for the client involved. At Tully Rinckey PLLC, Karen concentrates her practice on every facet of estate planning (including estate and income tax planning and Medicaid planning), probates and estate administration, appearing in Surrogate's Court on contested matters and preparing tax forms and other necessary estate documents. Karen is a frequent lecturer on estate matters and has written and edited informational articles on estate law for various publications.

Karen is a member of the New York State Bar Association and is admitted to the United States Supreme Court, United State District and Bankruptcy Courts for the Northern, Southern and Western districts of New York. She is also a member of the Onondaga County Bar Association. Karen formerly served in leadership roles with the New York State Bar Association as the Secretary of the Young Lawyers Section as well as the Liaison to the Trusts and Estates Section of the New York State Bar.

Karen received her juris doctorate from Albany Law School, cum laude. Karen also received a concentration with honors in Estate Planning from Albany Law School. She received a Bachelor of Arts in Political Science from the State University of New York at New Paltz.
