My practice is primarily tailored to address two separate elements; the first facet addresses the various legal problems small businesses face daily. I assist in the formation of the business, ensuring all formalities are met, and draft and negotiate various contractual agreements. The second prong of my practice addresses debt relief, such as Chapter 7, 11, and 13 bankruptcy, creditor harassment, garnishments, foreclosure, and wrongful repossession. Services Offered For Fixed Fees?
Wherever possible I offer a fixed fee for my services. First, it is unfair to the client if the ultimate cost of handling the legal matter is unknown. Second, a fixed fee ensures that the client receive efficiency on the part of the attorney. My fixed fee model is based on the following formula: $75 per hour x projected number of hours + a 10% premium. Therefore, the client knows the cost up front before they are asked to commit to any legal agreement. I typically charge $1,700 for basic Chapter 7 bankruptcies, which includes the $300 filing fee and additional fees associated with the mandatory debt counseling program. I charge a bit more for Chapter 13 bankruptcies because of the added complexity. I also offer payment plans spread out over a several months. However, I do require a small retainer up front where a lump sum payment is not possible. How did your firm decide on the primary area of practice(s)?

Small and medium businesses are the backbone of America. Because my wife is a small business owner, I witness daily the difficulties that small businesses face. I want to ease the burdens and protect small businesses from future liability. I became involved in debt relief and consumer protection work because many individuals facing such problems are hardworking Americans who had little control over the problems they now face. I've had family members embroiled in that situation, with an attorney who ignored their calls and their case. I never want my clients to feel that helplessness or that level of stress. I want them to know that I can relate to them and care about their problems as much as they do.

What is your firm's point of view regarding clients educating themselves on legal issues?

The better educated the client is about their legal matter, the better their questions, and the better we can help them achieve their legal goals. One of the reasons the Law Offices of Tim Sutherland was founded was to educate clients on particular legal matters so that those clients can implement appropriate safeguards and policies.

Is your firm willing to review documents prepared by clients?

I encourage and welcome the review of documents prepared by clients. Such review is limited to making sure forms and other standard documents have been properly filled out. Please also note that pre-prepared contracts and other agreements are typically much more difficult and time consuming to revise than having me draft an agreement from start to finish.

Is your firm willing to coach clients who want to represent themselves?

I offer reduced fees in situations where a client wants to represent themselves. One example would be where a client is served with a lawsuit from a credit card company. I may charge a reduced fee to prepare the legal documents for the client, but the client would handle all correspondence with opposing counsel and appear in court on behalf of him or herself. However, such an arrangement is limited to the facts of the case and I can only make such an assessment on a case by case basis.

I began my legal career at the premier boutique law firm Michel & Associates, handling various business matters relating to firearms. I reviewed contracts, handled copyright and trademark issues, and ensured compliance with state and local regulatory laws. I carried this experience over to the Clackamas County District Attorney's office, where I prosecuted domestic violence charges and was solely in charge of weekly court hearings for several domestic violence programs. I learned the value of trial and witness preparation and have applied these skills to my civil litigation work.

Ever since I was able, I have worked. Whether it was as a delivery driver for a pizza franchise or working for a veterinarian clinic, I've experienced firsthand what it is like to scrape by month after month to pay for school, rent, and the various other costs associated with daily living. I understand how hard it is save and pursue your dreams and how equally easy it is have that ripped away from you. Because my wife runs a small business, I have the unique experience of seeing daily the problems that small business owners typically face. Her experiences help my practice on a daily basis to better advise other business owners.

I'm thorough in my representation, making sure I've covered all of the angles associated with my client's case before proceeding. I provide my clients with a roadmap of how their matter will be handled, so they always know where I'm at with their case. If I don't know the answer to a particular problem, I am upfront and truthful with the client, and I learn the answer. I'm a personable and enthusiastic person who is attentive to the needs of my clients. I've seen what happens to a client when their attorney does not keep them abreast of their case. That's why I maintain at least bi-weekly contact with my clients and provide, at their discretion, critical portions of their file in a secure online platform for their review. I also do my best to return emails and phone calls within 24 to 48 hours.

Personal interests:

I'm a baseball fanatic. In the rare instance I take time off from zealously representing my clients, I play softball and watch the Seattle Mariners. I also love hockey, history, and playing the occasional strategy war-game with friends online. My wife is my best friend, so typically you will find us together at local farmer markets, festivals, or sporting events.
