Law Offices of Thomas P. Kelly III

Firm Overview

I share an office with my father, Thomas P. Kelly Jr., who has been an attorney in Santa Rosa for more than 40 years. I am a licensed attorney in California, Oregon, and the District of Columbia. I have worked in the legal field in California, Oregon, and Texas.

I am focused on individual bankruptcy, litigation to stop wrongful foreclosure, and defending individuals from wrongful debt collection practices in Sonoma County, California.
Example cases A family came to see me very late after they learned that their house was going to be sold at a foreclosure sale in less than twelve hours. We bought a pizza, and prepared and filed the bankruptcy case in less than an hour. The foreclosure was halted.

How did your firm decide on the primary area of practice(s)?

When people come in to see me for the first time regarding personal bankruptcy, there is a cloud over them. They are facing crippling debts, sleepless nights, and constant phone calls. Once they realize they do not have to face this alone, that cloud lifts. That's the best part of the job.

What is your firm's point of view regarding clients educating themselves on legal issues?

In some matters, the client is the best person to handle a legal matter. The client has lived it. The attorney did not. However, as matters become more complex, or if you are facing determined opposition, then you need the assistance of an attorney.

Is your firm willing to review documents prepared by clients?

Under some circumstances, of course. However, it will depend on what is being considered.

Is your firm willing to coach clients who want to represent themselves?

I frequently face this situation, and my goal is to provide help if I can. But the map is not the terrain. The legal system is an adversary process, and coaching is no substitute for a prepared and disciplined attorney working to protect your interests.

Thomas P. Kelly III

The firm is focused on individual bankruptcy, litigation to stop wrongful foreclosure, and defending individuals from wrongful debt collection practices in Sonoma County, California.
My legal education started at nine years old while I was drawing with crayons and attended contract classes taught by my father at Empire Law School. My strength is that I was originally trained as a litigator. Most bankruptcy attorneys do not make frequent appearances in court, but I routinely appear in state court on litigation matters as well as in federal and bankruptcy courts. If a creditor breaks any of the rules, I am prepared to start whatever litigation is necessary to put a stop to it. My style is generally informal. I only wear a suit on days when I am making a court appearance. I try to keep the bankruptcy process as low-key as possible because my clients do not need someone else putting pressure on them.Personal interests: I studied classical and medieval history in college, and still read for fun on this subject. I greatly enjoy travel, especially in England because I have joint citizenship between England and the United States. I try to get out of the office to go back-packing when I can, or sometimes just go for a hike in Annadel.
